Justification for Other than Full and Open Competition US Army Corps of Engineers, Sacramento District
FAR 6.302-1 Only One Responsible Source
W91238-15-R-0027
1. Contracting Activity: US Army Corps of Engineers, Sacramento District, 1325 J Street, Sacramento, CA 95814-2922
2. Description of Action: A new competitive firm fixed-price construction contract which includes “brand name only” components. This Justification and Approval is relevant only to the components.
3. Description of Supplies/Services: The construction project, the Common Mission Control Center, Beale AFB, CA includes a requirement for One Responsible Source for (1) direct digital control (DDC) components, (2) the intrusion detection system (IDS), (3) the fire alarm transceiver, (4) door lock cylinders, and (5) aspirating smoke detectors.
(a) The DDC components used for Heating, Ventilation and Air Conditioning (HVAC) control shall be completely integrated into the Energy Management and Control System (EMCS) and as mandated by the Base Civil Engineer.
(b) The Intrusion Detection System (IDS) shall be completely integrated as mandated by Base Security Forces.
(c) The Fire Alarm Transceiver will allow complete integration with the fire alarm system and as mandated by the Base Fire Department.
(d) The door locks will allow a uniform, safe, and reliable keying system.
(e) The aspirating smoke detectors as mandated by the Base Fire Department and Alarm Shop.
4. Authority Cited: 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(c) and DFARS 206.302-1 – Only One Responsible Source and not other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: The purpose of this J&A is to obtain approval for procurement of non-competitive/specific equipment subject to the FAR.
(a) The Base EMCS was created to improve the overall reliability and efficiency of building
HVAC operations with regards to optimizing energy and labor use.
This system is a multiple LAN server based system, designed for maintenance management, trouble shooting, and energy management. It is required that the DDC controller integrates into the EMCS with communication protocol. The DDC support system is in compliance with Engineering Technical Letter (ETL-86-16). The use of the brand name description in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
(b) The IDS has been approved by HQ Air Combat Command and HQ Air Force Civil Engineer
Center.
(c) The Transceiver has been approved by HQ Air Combat Command and HQ Air Force Civil
Engineer Center. The fire alarm processing network requires the Transceiver in order to communicate with the central fire reporting system.
(d) The use of keying system has been approved by HQ Air Combat Command and HQ Air
Force Civil Engineer Center. These key systems assure safety, reliability, decrease costs for duplicate lock systems, and assure availability of standard parts for emergency and routine service. All locks shall be sub-mastered by the Beale AFB locksmith.
(e) The aspirating smoke detector has been approved by HQ Air Combat Command and HQ Air Force Civil Engineer Center. The smoke detector is utilized base-wide wherever ultrasensitive smoke detection is required. This detector is required to communicate with the base-wide central fire reporting system.
6. Efforts to Obtain Competition:
These system components are the only ones that can maintain a 100% seamlessly operable existing interconnected installation network. Based on the information provided in paragraph 5, efforts to obtain competition for these proprietary items are not feasible at this time. The proprietary nature of these items has been described above.
(a) No other effort will be made to obtain competition until a new EMCS is sought for the entire installation.
(b) No other effort will be made to obtain competition until a new Intrusion Detection System is sought for the entire installation.
(c) No other effort will be made to obtain competition until a new Fire Alarm Monitoring/ Reporting system is sought for the entire installation.
(d) No other effort will be made to obtain competition until a new Lock System is sought for the entire installation.
(e) No other effort will be made to obtain competition until a new aspirating smoke detector is sought for the entire installation.
7. Actions to Increase Competition and Remove or Overcome Barriers to Competition: The contract action will be synopsized in the Federal Business Opportunities website. Competition will exist among mechanical sub-contractors for the EMCS, security sub-contractors for the IDS, fire suppression/alarm sub-contractors for the transceiver and smoke detectors, and hardware sub-contractors for the keying system.
8. Market Research:
9. Interested Sources: Contractors responded to the Sources Sought as interested sources for the project acquisition.
10. Other Facts: Per FAR 5.102(a)(6) the contracting officer shall include the solicitation with the justification or documentation required by 6.302-1(c): None
