CONTRACTOR RESPONSIBILITY, PREAWARD SURVEY:
In order to determine a contractor's responsibility for purposes of contract award in accordance with FAR Part 9, the contractor is required to provide a statement regarding previous experience and past performance in performing comparable work, information related to the business organization, financial resources, and/or plant to be used in performing the work (see Section 00 22 10). All offerors will complete and return the Preaward Survey as part of the Price/Cost proposal. Failure to submit the Preaward Survey in conjunction with the price proposal will not of itself render the offer unacceptable.
Determination of Contractor Responsibility will be completed in accordance with FAR 9.104-1:
If the contractor or subcontractor does not already have sufficient resources demonstrated in the completed Preaward Survey, acceptable evidence of "the ability to obtain" the required, adequate resources (all of the resources discussed in FAR 9.104-1) normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award to rent, purchase or otherwise acquire the needed facilities, equipment, other resources, or personnel.
The Preaward Survey as a tool used by the Government in determining responsibility of the offeror is submitted as part of the Price/Cost proposal and is separate from the technical proposal's response to the technical evaluation criteria found later in this section. Some of the information required from the offeror for completion of the Preaward Survey and the technical proposal may be duplicative but it is necessary that the information be provided in full in both places and that the Price/Cost proposal and the Technical proposal be separate documents. DO NOT state, for example, in the technical proposal, "See Price/Cost proposal for past performance information".

http://www.publications.usace.army.mil/ http://www.wbdg.org/ccb/ccb.php
Pledges of acceptable assets shall be in the form of (1) evidence of an escrow account and/or (2) a recorded lien on real estate. If this is an RFP, failure to provide required documentation described herein may cause the offeror to be deemed "unacceptable".
BID GUARANTEE FORM AND AMOUNT:
The offeror shall furnish a separate bid guarantee in accordance with the solicitation provision titled "Bid Guarantee", FAR 52.228-1. In accordance with FAR 28.101-2 the bid guarantee amount shall be at least 20 percent of the "bid price" but shall not exceed $3 million. When the penal sum is expressed as a percentage, a maximum dollar limitation may be stated. If there are option line items on the CLIN Schedule, the term "bid price" is hereby defined as the total bid not to include any amount for line items designated as "options". In bids/proposals that contain "additives", the "bid price" is defined as the total of all bid items including additive line items. FAR 28.106- 1 states that a Standard Form (SF) 24 shall be used for the bid bond. In accordance with FAR 28.202(a)(1), corporate sureties utilized must appear on the list contained in the Department of Treasury Circular 570 titled "Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and Acceptable Reinsuring Companies."

SECTION 00 22 10
PROCUREMENT ACQUISITION
BASIS OF AWARD,
GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS,
EVALUATIONS, AND CONTRACT AWARD
1. OVERVIEW.
1.1. This is a “Single Phase Lowest Priced Technically Acceptable Request for Proposals” solicitation for South Sacramento County Streams Project Flood Damage Reduction Group Florin Creek from Franklin Blvd to Highway 99 (Contract 2D1) in Sacramento, California. The Contracting Officer will award a firm fixed-price contract to the responsive and responsible offeror whom the Source Selection Authority determined had the lowest priced technically acceptable (LPTA) proposal, conforms to the solicitation, and is fair and reasonable.
1.2. Overview of the Source Selection Process. The Lowest Price Technically Acceptable (LPTA) source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Proposals are evaluated for technically acceptability but not ranked using the non-cost/price factors.
1.3 Offeror’s are advised that the Government intends to make awards on the basis of initial technical acceptable proposals without conducting discussions with offeror’s, but reserves the right to conduct discussions if determined by the Source Selection Authority to be necessary [see FAR Part 14.501(a)].
Therefore, the initial proposal should contain the offeror’s best terms from a technical and price standpoint.
2. BASIS OF AWARD.
The contract resulting from this solicitation will be awarded to the lowest priced offeror who submits a technically acceptable proposal. Technical acceptability is based upon the three (3) non-priced (technical) factors: Experience and Capability and Past Performance. Within three days after the date of contract award, and in accordance with FAR 15.503, the SSA will notify all unsuccessful offerors in writing. If available, the SSA will also provide a formal debriefing to all offerors who request it. The debriefing team will consist of the SSA and others as determined by her to be appropriate. Debriefings are to be conducted in compliance with the provisions of FAR 15.506 for post-award debriefings.
However, if the first offeror (lowest priced offeror will be evaluated first) is deemed technically acceptable, then no other offeror non-priced proposal will be evaluated and debriefings will not be available. If the first offeror is not deemed unacceptable, a debriefing will be offered to the offeror deemed “not technically acceptable”.. This will apply to any offeror deemed unacceptable in the technical evaluation process.
2.1. ELIGIBILITY FOR CONTRACT AWARD
In accordance with the requirements of Part 9 of the Federal Acquisition Regulation (FAR), no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective prime contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.
2.2. THE TECHNICAL EVALUATION FACTORS:
a. The Government will evaluate the technical proposal that is deemed lowest price first and if the offeror is deemed technically acceptable, the Government will not evaluate any other proposals. If the lowest priced proposal is deemed “Not Technically Acceptable”, then the next lowest priced offeror will be evaluated. The technical evaluation is based on how well the proposal addresses each of the three evaluation factors, listed below and further described in the Technical Proposal Volume. Each of the evaluation factors will be evaluated by the Government and an adjectival rating of “Acceptable” or “Not Acceptable” determined by consensus of the Government evaluation board. There are no relative weights assigned to the factors.
b. The evaluation factors correlate directly to the main organizational tabs identified in the proposal submission instructions in the Technical Proposal Volume. However, any information contained in the technical proposal can nonetheless be considered by the Government in its evaluation under any factor.
FACTOR 1 - EXPERIENCE AND CAPABILITY
FACTOR 2 - NETWORK ANALYSIS SCHEDULE (NAS)
FACTOR 3 - PAST PERFORMANCE
2.3. GENERAL TECHNICAL EVALUATION CRITERIA
a. The evaluation shall be conducted in accordance with FAR Subpart 15.101-2 -- Lowest Price Technically Acceptable Source Selection Process. For this procurement, only one technical proposal may be submitted by each offeror. Offerors should submit a proposal that is complete without the need of additional explanation or information. The Government intends to make a final determination regarding a proposal's acceptability solely on the basis of the proposal as submitted. If it is determined in the best interest to the Government, the contracting officer may proceed without requesting further information from any offeror; however, the Government may request additional information from offerors of proposals that have been found to be Unacceptable, an example would be for the Government to clarify administrative issues that would clarify a minor issue and make an offeror Acceptable.
b. Technical Proposals will be rated at the factor level and will be evaluated in terms of Acceptable or Unacceptable. The Government’s intent is not to hold discussions, but if discussions are held, it will be in accordance with FAR 15.306. If discussions are held with offeror whose proposals are considered Unacceptable and a request for proposal revisions are requested, the revised proposal will be re-evaluated in accordance with the criteria in the solicitation. After completion of discussions and evaluation of any revised proposals, the proposal shall be determined as acceptable or unacceptable. If determined unacceptable, a notice of unacceptability will be forwarded to the offeror’s upon completion of the proposal evaluation and final determination of unacceptability.
c. The offeror’s conformance with the specified format and submission requirements will be considered during the technical evaluation. Failure to comply with the formatting and/or submission requirements may be seen as indicative of the type of problems that could be expected during contract performance.
Lack of conformance will result in a Unacceptable rating, in addition to any other impacts on the evaluation. Material omission(s) may cause the technical proposal to be rejected as unacceptable.
d. Technical proposals which do not provide the specified information in the specified location in accordance with the submission instructions may be deemed Unacceptable. The Government is under no obligation to search for information that is not in the specified location. The offeror’s failure to include information the Government has indicated should be included will result in the proposal being “Unacceptable” if inadequate detail is not provided.
e. Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit three pages in response to an item with a two page limitation, the information on the first two pages would be evaluated but the information on the third page would not be evaluated. If an bidder were to submit a fold-out sheet (e.g. 11”x17”) in response to a one-page limitation where fold-out sheets were not authorized, only the information that could reasonably have been submitted on one 8-1/2 x 11 inch sheet would be evaluated. If a offeror were to submit three 8-1/2 x 11 inch pages in response to a one not-to-exceed 11 x 17 inch page limitation, only the information that could reasonably have been submitted on one 11 x 17 inch sheet would be evaluated. If an offeror submitted alternates that were not requested the information will not be evaluated.
f. Past Performance Evaluation. The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements and will be evaluated in accordance with FAR 15.101-2(b)(1). The past performance evaluation will considers each offeror’s demonstrated recent and relevant record of performance that meet the contract’s requirements but the comparative assessment does not apply to LPTA source selections. Past Performance can include offerors past or current contracts (including Federal, State, Local Government and private industry of similar project requirements).
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined in the context of “unknown” shall be considered “acceptable.”
2.4. EVALUATION OF THE PROPOSAL
a. When applicable, the Price Evaluation Preference for HUBZone Small Business Concerns will not be applied to this procurement. The Price Evaluation Adjustment for Small Disadvantaged Businesses will not apply to this procurement as it is currently suspended for Department of Defense.
b. Information required to be submitted in the Price volume in addition to the executed SF 1442 with acknowledgement of amendments and the completed pricing schedule will be used to determine the bidder’s eligibility for contract award in accordance with paragraph 2.1 above (for example, the bidder’s representations and certifications; the bid guarantee; the offeror’s pre-award survey information; and the offeror’s small business subcontracting plan). The Government may enter into exchanges with offerors about such information without it constituting discussions, subject to applicable FAR limitations; FAR 28.101-4, Noncompliance with bid guarantee requirements; and 52.219-9, ALT II, Small Business Subcontracting Plan.

3.1.3 Conditioning of Proposal.
Do not include exceptions to the terms and conditions of the solicitation in either the technical or bid price volumes. Inclusion of any standard company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the proposal/bid is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of the proposal/bid; see “Inquiries”, located in Section 00 21 16, for points of contact. Notwithstanding the above, the bidder must clearly describe in the proposal cover sheet submitted with the bid price volume any exceptions, within the proposal/bid, to the contractual and/or technical terms and conditions of the solicitation.

5 DETAILED SUBMISSION REQUIREMENTS AND EVALUATION CRITERIA FOR THE
TECHNICAL PROPOSAL
5.1 Preface – Prime Contractor/Key Subcontractor Introduction
a. The Offeror is required to propose a specific project team including key subcontractors for evaluation in response to this Request for Proposals. For purposes of this procurement, the terms “key subcontractors” are used to refer only to the prospective subcontractors whose qualifications, experience, and past performance will be evaluated by the Government as part of the source selection process. For reasons of efficiency, not all of the subcontractors critical to successful post-award contract performance have been included in this group. In order to streamline the proposal submission and evaluation process, please limit your submission to the information specifically requested. Information pertaining to other subcontractors not designated as “key” by the Government will be considered excess and will not be evaluated.
b. For the purposes of this procurement, a key subcontractor is defined as any subcontractor performing “key” major work elements for which capability information is required to be submitted for evaluation as part of the Offeror’s technical proposal. The Government has designated the following major work elements as “key”:
i. Earthwork construction effort
ii. Structural construction effort
iii. Concrete effort
c. The Offeror’s attention is directed to the clause in Section 00 73 00 titled “Key Personnel and Subcontractors”. In accordance with this clause, any post-award changes to the key personnel and/or key subcontractors in the accepted proposal will require Contracting Officer approval.
d. Provide a brief introduction narrative. Identify and provide the name, DUNS number, address, point of contact email address, and a brief description of the role and authority of each firm that will be involved in performance of this contract at the prime contractor and key subcontractor level. If the proposed prime contractor is a Joint Venture (i.e., mentor protégé), describe the relationship, role, and authority (to include management authority) of each firm. (Note: If a proposed firm has branch offices, provide information for each individual branch office that will perform work under the contract with its own workforce.) List the major work elements to be self-performed by the offeror’s in-house work force and by each key subcontractor. The submission is limited to two (2) 8-1/2”x11” pages for narrative.
e. The Government will not evaluate the Preface - Prime Contractor/Key Subcontractor Introduction. The purpose of this narrative is to provide a brief introduction for information purposes.
5.2 Tab 1 Factor 1- Prime Contract/Key Subcontractor Example Projects Experience and Capabilities:
5.2.1. General Information: The information provided under this tab will be used to evaluate the experience and capability of the offeror and proposed key subcontractors. The resumes and example projects will provide the primary basis for acceptability for the Government’s evaluation of the offeror’s qualifications and experiences. The Government is especially interested in relevant experience in the renovation of incised channels. Both examples can either be commercial or institutional. The Key Elements are: management of renovations of channel work between or adjacent to private/public property lines; maintaining safety for active streets; Limiting construction noise. Sequencing/Phasing
5.2.2. Submission of Factor 1 -Prime Contractor/Key Subcontractor Example Projects Demonstrating Experience and Capability
5.2.2. a. The offeror is required to submit “example projects” for each of the three (3) below capability areas that demonstrate the prime’s and/or key subcontractor’s experience and capability to successfully complete the example project. Each offeror must submit example projects (Prime contractor and key subcontractor) with a minimum of two (2) example projects but no more than three (3) example projects demonstrating experience in the key elements listed below. Example projects are a requirement for the prime and key subcontractor.
Each offeror’s example projects shall include:
1. Two (2) but no more than three (3) example projects, but no more than three, demonstrating the offeror’s construction/project management experience and capability as a prime contractor on a similar project and scope;
2. Two (2) but no more than three (3) example projects, but no more than three, demonstrating the experience and capability of the firm (prime or subcontractor) that will be performing the majority of the earth moving construction effort;
3. Two (2) but no more than three (3) example projects, but no more than three, demonstrating the experience and capability of the firm (prime or subcontractor) that will be performing the majority of the concrete construction effort.
5.2.2. b. Any prescribed page and formatting limitations shall be strictly adhered to and enforced by the Government. The Government may not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit four example projects in response to a requirement for three example projects, only the first three example projects will be evaluated and the information on the fourth project would not be evaluated.
5.2.2. c. Provide a Summary Matrix that indicates which submitted example project(s) demonstrates the experience(s) and capabilities of which firm (i.e. prime, subcontractor) will perform the capability area identified in paragraph 5.2.2.a above.
5.2.2. d. Formatting and Other Restrictions.
(1) Start the information for each example project on a new page. The submission is limited to 8-1/2” x 11” pages.
(2) Use the “Project Information Form” below which follows for submitting the example projects.
