c. The Contractor's liability for the removal of a vessel wrecked or sunk without fault or negligence is limited to that provided in Sections 15, 19, and 20 of the River and Harbor Act of March 3, 1899 (33 U.S.C. 410 et.seq.).
1.16 FLOATING PLANT AND TOWBOAT
a. The Contractor shall notify the Contracting Officer, in writing, at least thirty (30) days in advance of the date he proposes to use a floating plant above or below the immediate vicinity of the Locks and Dam (within the confines of the designated lockage arrival points). The Contracting Officer will advise the Lockmaster so that action is coordinated with traffic in a timely manner. Priority lockage can be authorized at the request of the Contractor.
b. Stationing of floating plant above the immediate vicinity of the Locks and Dam will be prohibited whenever river flows are sufficient to require a total Dam gate opening exceeding 50 feet. Stationing of floating plant below the immediate vicinity of the Locks and Dam will be prohibited whenever river flows are sufficient to require a total Dam gate opening exceeding 25 feet. Projected increased river flow which may require total Dam opening to exceed the referenced 50 or 25 feet, of total Dam gate opening and/or possible accidents, will require the Contractor to immediately remove the floating plant. Therefore, the Contractor shall
DOCUMENT 00 80 00 Page 11 furnish the Contracting Officer a list of all the Contractor's key personnel, along with telephone numbers where they may be contacted day or night, so that on a short notice the floating plant may be removed from the vicinity of the Dam.
c. If the Contracting Officer or Lockmaster at Greenup Locks and Dam is unable to contact the Contractor or his key employees, or if after contact the floating plant is not removed within four hours following notice, the Government will take the necessary action required to have the floating plant removed from the immediate vicinity of the Locks and Dam. All costs and any damages resulting from the removal shall be at the expense of the Contractor.
d. The floating plant cannot be left unattended while stationed in the immediate vicinity of the Locks and Dam, unless written permission is obtained from the Contracting Officer for each and every occurrence.
e. Mooring facilities are available for use within the Auxliary Lock Chamber during the execution of the construction operations. Plant shall not be moored in lock chambers or on lock walls where it will affect navigation. This area shall be vacated before the upper pool elevation reaches 516.50 or at the direction of the Lockmaster.
f. The Contractor shall also provide a towboat with adequate horsepower and twin screws to handle the floating plant being utilized, or shall obtain a contract with a reputable towing or marine service company to provide towboat services on an as-needed basis. The towboat shall be available within four hours of notice of need to abandon the work position, as directed by the Contracting Officer, on a 24-hour-a-day, seven-day-a-week basis, anytime the Contractor's floating plant is on station at the Locks and Dam. Note: The towboat does not have to be on station but shall be available on notice to reach the project site as specified above. For the purpose of construction, the Contractor must have a copy of 33 CFR 207.300, "Regulations Prescribed by the Secretary of the Army for Ohio River, Mississippi River above Cairo, Ill., and their Tributaries, Use, Administration and Navigation" which can be obtained electronically at https://ecfr.io/Title-33/pt33.3.207#se33.3.207_1300.
1.17 FLOOD OUTAGE
During the course of the contract, high river flow conditions will develop in varying degrees. The Contracting Officer or the Lockmaster will inform the Contractor as to when he will be required to remove his floating plant from the work area to meet the requirements above. At above 50 feet of total Dam opening, the Lockmaster will make an evaluation of pending river conditions and will inform the Contracting Officer as to whether the Contractor shall be required to remove his floating plant.
a. Total gate openings of 50 feet and 25 feet referred to in the specifications equate to 175,000 cfs and 88,700 cfs, respectively. It is imperative that the Contractor maintain close communication with the Lockmaster throughout this contract and to ascertain expected river conditions for the remainder of the work day and the short term future.
b. The stage duration curves, Contract Drawings S-702 through S-705, represent the results of a statistical analysis of historical stage data for the lower gages, on a monthly basis. For any given stage, these curves can be used to determine the percentage of time for which that particular stage could be expected to be equaled or exceeded on a
DOCUMENT 00 80 00 Page 12 monthly basis or for any given month. The historical stage hydrographs shown on Contract Drawings S-701 illustrate the variation in the lower pool for the period of record FY 2003 through FY 2015. For the lower pool hydrographs the gage datum is 473.0 feet.
1.18 PERFORMANCE EVALUATION OF CONTRACTOR
It is the Corps' standard operating procedure that the Contracting Officer evaluate the Contractor's performance and prepare a performance report using the web-based application CPARS (Contractor Performance Assessment Reporting System) for construction contracts of $650,000 or more. After an evaluation (interim or final) is written by the Corps, the Contractor has a 60-day period to access, review and comment on the evaluation. Accessing and using CPARS requires having specific software, called PKI certification, installed on the user's computer. The certification, a Department of Defense requirement, was implemented to provide security in electronic transactions. The certification software could cost approximately $100-$125 per certificate, per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.gov. The Contractor is encouraged to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition, owned or controlled, and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, CONSTRUCTION EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE, REGION II. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, RENTAL COSTS. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
(d) When actual equipment costs are proposed and the total amount of
DOCUMENT 00 80 00 Page 13 the pricing action exceeds the Simplified Acquisition Threshold (SAT), the Contracting Officer shall request the Contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. 1.3 DESCRIPTION OF WORK
1.3.1 General Project Features
a. The general description of the work of this contract consists of furnishing all materials, equipment, labor, layouts of work features, and supervision needed to accomplish work on the indicated middle wall lock monoliths related to removing the existing concrete slabs, excavating the existing fill material, sealing concrete cracks, placing controlled low-strength material (CLSM), installing reinforcement and placing structural concrete on the indicated middle wall monoliths of the Greenup Locks located on the Ohio River. The monoliths contained in this contract are the middle wall monoliths M8 thru M12 as the base contract and middle wall monoliths M19 through M24 as Option 1. Option 2 consists of reconstructing the access road to the project. This work is to be accomplished after the work on the middle wall monoliths has been completed. A layout of the lock wall monoliths is shown in the As-built reference drawings provided in the contract drawings.
b. The Greenup Locks and Dam project is an active navigation lock operated 24/7 located at river mile 341.0 on the Ohio River. Original construction of the project was completed in 1962. The existing structures consists of a 1,042-foot long dam and two (2) lock chambers (a 110' x 1200' main chamber and a 110' x 600' auxiliary chamber). The locks have a 30-foot lift and the dam maintains a normal upper pool elevation of 515.0 feet using nine (9) tainter gates. The project also includes a hydroelectric generating unit and a bridge that connects U.S. Route 52 in Ohio to U.S. Route 23 in Kentucky. The main lock chamber is formed by the river wall and the middle wall and the auxiliary lock chamber is formed by the middle wall and the land wall.
c. Due to the depth of the V-notch in the monoliths and the upper pool elevation, it is possible water will infiltrate into the V-notch when
SECTION 01 00 00 Page 2 the water level in the chamber is above elevation 512.0 which is the invert elevation of the V-notch. Normal upper pool elevation is
515.0. If water does infiltrate the V-notch and impacts the
Contractor's work by impeding concrete placement or formwork installation, the main chamber will be closed to traffic as outlined in Paragraph LIMITED WORKING AREA AND TIMES.
d. The upper and lower pool elevations are subject to change due to river conditions. Contract drawings S-701 through S-705 provide the historical data of the Lower Pool Stage. The historical data includes hydrographs from FY2003 through FY2015 and the monthly duration curves.
1.3.2 Soil Investigation and Analytical Results
Soil samples were obtained by the Government of the existing fill material and sent to a laboratory for testing. The soil samples were tested for solvents, hydrocarbons, heavy metal, and dioxin. One soil sample was obtained from each monolith M8 through M12 and M20 through M24. The five soil samples taken from M8 through M12 were then combined and a single composite soil sample was obtained. A soil sample for M20 through M24 was obtained in the same manner. In the laboratory test results, the soil samples are referred to as "Sample #1 Upstream" and "Sample #2 Downstream". The composite soil sample obtained from M8 through M12 corresponds to "Sample #2 Downstream" and the composite soil sample obtained from M20 through M24 corresponds to "Sample #1 Upstream". A summary of the results is provided below, A copy of the complete testing results is included at the end of this section.

1.3.3 Limited Working Area and Times
During the time of performance of this contract, the auxiliary chamber will be inactive with the main chamber being the only chamber available to pass navigation traffic. During the course of this work it may become necessary for the main chamber to be closed to navigation traffic. To reduce the impact to the navigation industry, any main chamber closures shall be limited to one 10-hour long period during daylight hours each day. Outside of this 10-hour period the main chamber shall be open to all navigation traffic. If the contractor places any equipment or materials in the main chamber during the closures, the contractor will need to remove their
SECTION 01 00 00 Page 3 equipment and materials from the main lock chamber and its approaches to permit navigation traffic to utilize the main chamber. The Contractor will be permitted to place their floating plant in the auxiliary lock chamber unless river conditions dictate otherwise as specified in Section 00 80 00
