DETERMINATION FOR OTHER THAN FULL AND OPEN COMPETITION
(SIMPLIFIED ACQUISITION PROCEDURES – BRAND NAME)
1. Contracting Activity:
U.S. Army Corps of Engineers, Huntington District, CELRH-DCT-C, 502 8th Street, Huntington, WV, 25701
2. Description of Action:
The action hereby submitted for approval is for a brand name procurement of repair services and replacement parts for a Manitowoc crane located at the Pittsburgh Engineer Warehouse and Repair Station (PEWARS). The cost for the supplies and services exceeds Government Visa purchase thresholds. This will be procured as a commercial service using FY17 funds.
3. Description of Supplies/Services:
The purpose of this procurement is for a contractor to assess, replace, and repair existing rollers on the Derrick Boat 65 barge-mounted Manitowoc 3950W Crane (Serial Number 396030) to include supplying all parts, labor, materials, and other equipment necessary to furnish, install, calibrate, and test the repaired rollers in accordance with the attached specifications. The materials and services provided to install the specified components for this Manitowoc crane shall be accomplished by an authorized representative of the manufacturer, Manitowoc Cranes, Inc., with specialized experience on Manitowoc cranes. In addition, all equipment and materials to be furnished under this specification shall be Original Equipment Manufacturer (OEM) parts to insure compatibility, reliability, longevity, and safety.
All work will be completed at the PEWARS. The total estimated cost of these parts and services is approximately $150,000.00 including labor, travel, and shipping.
4. Authority Cited:
FAR 13.106-1(b)(2), as the existing equipment inventory precludes consideration of products manufactured by another company, as the services described herein consist of maintenance and repair of load-handling equipment per EM 385-1-1 16.A.15.
5. Reason for Authority Cited:
The minimum Government need is to procure replacement parts for the above mentioned Manitowoc crane and to have those parts installed by a professional who is familiar with this exact type of crane. Per the EM 385-1-1, replacement parts for load bearing equipment shall be obtained from the original manufacturer, if possible.
Therefore, the use of brand name descriptions is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
6. Efforts to Obtain Competition:
In accordance with FAR 5.101 and 5.102, competition will be obtained by posting a solicitation to Federal Business Opportunities (FBO) to allow all interested vendors to submit quotations for the required products and services. Vendors will be provided no less than fifteen (15) business days to submit quotes. Based on market research, it has been determined it is in the best interest of the Government to consider quotations submitted by large and small businesses due to lack of available small business sources, in accordance with FAR 19.502-2(a).
7. Actions to Increase Competition:
As stated in Number 6 above, this procurement will be solicited via FBO to allow for maximum practicable competition. No actions have been taken to further increase competition.
8. Market Research:
Market research was conducted by querying the manufacturer’s database for authorized representatives within reasonable travel distance to the crane’s location of Pittsburgh, PA. In addition, market research was conducted on the Small Business Administration’s Dynamic Small Business Search website to identify small business interests that may provide the required products and services. Based on the market research results, there is not a reasonable expectation that two or more small business concerns will submit competitive offers.
9. Interested Sources:
Several large business vendors in the region have expressed interest in this procurement. To date, no other sources have been explored.

11. Statement of Actions:
Competition is being restricted to brand name supplies and services due to agency requirements. However, it has been determined it is in the best interest of the Government to consider offers submitted by both large and small businesses to ensure maximum practicable competition.
