About this file
This is a presentation deck from an Industry Day event scheduled for February 4, 2025, focusing on Phase 1A of the Norfolk Coastal Storm Risk Management (CSRM) project. The U.S. Army Corps of Engineers Norfolk District is planning multiple construction contracts including a Single Award Task Order Contract (SATOC) for floodwall construction valued at $250-300M with 4-6 task orders over a 5-year base period, and two separate pump station contracts - a Design-Build contract for Harbor Park Pump Station ($20-35M) and a Design-Bid-Build contract for Newton's Creek Pump Station with Tide Gate ($30-50M).
The Phase 1A scope includes construction of floodwalls, tide gates, sliding/swinging gate closures, living shoreline features, and pump stations with associated utility work. Key milestone dates include RFP release for the SATOC in late 2025/early 2026, with award planned for early 2027. The Harbor Park Pump Station Design-Build contract advertisement is planned for late 2025/early 2026 with award in summer 2026. A Project Labor Agreement will be mandatory for contracts over $35M. The project requires various environmental permits including VADEQ Water Protection Permit, Coast Guard permit/waiver, and other state/local approvals. The solicitation will use a two-phase approach under FAR 36.3 with evaluation factors including Management Approach, Past Performance, Technical Approach, Small Business Participation, and Price.

Last Industry Day, January 2023
Feedback from Industry informed same scope contract benefits; Pump Stations are stand-alone and floodwall are separate scopes.
Smaller scope TOs/contracts are more acceptable.
Long lead times for significant utility relocations.
Phasing the floodwall construction allows for construction to start sooner.

In accordance with EO 14063, Use of Project Labor Agreement for Federal Construction Projects, issued 4 Feb ‘22, mandates PLAs for large construction projects, with performance in the United States, with estimated contract cost of $35M
What is a PLA?
- A pre-hire collective bargaining agreement unique to the construction industry negotiated between one or more construction unions and one or more construction employers (the Government does not sign however, it would be incorporated into the contract).
– Establishes terms and conditions of employment for a specific construction project, including:
• Provisions that bind all contractors and subcontractors to the agreement;
• No-strike, no-lockout clauses; and
• Grievance/arbitration procedures.
- USACE will neither negotiate nor become signatory to a PLA.
- The Solicitation will require all prospective offerors to submit a fully negotiated PLA with its price proposal offer.
PROJECT LABOR AGREEMENT
The Solicitation will contain FAR 52.222-33 and the following language will be included:
Synopsis: “Offerors shall submit an offer subject to Project Labor Agreement (PLA) requirements in accordance with FAR 22.504, General requirements for project labor agreements. Any PLA reached pursuant to the PLA requirements in the solicitation does not change the terms of the contract or provide for any price adjustment by the Government.”
Solicitation, Supplementary Conditions Section 00 73 00: “Offerors shall submit a proposal subject to the Project Labor Agreement (PLA) requirement set forth in [insert section] of this solicitation. Any PLA reached pursuant to the PLA requirements in this solicitation does not change the terms of the contract or provide for any price adjustment by the Government. See FAR provision 52.222-33, Notice of Requirement for Project Labor Agreement, and FAR clause 52.222-34, Project Labor Agreement, for definitions and requirements pertaining to the use of a PLA on this contract.”
Submitted PLAs shall be reviewed for compliance with all statutes, regulations, Executive Orders, and agency/contract requirements as part of responsibility determination in accordance with FAR 9.1. Identified areas of non-compliance will be addressed with the offeror and corrected during discussions, if discussions are opened.
Award will only be made to an offeror with a compliant PLA

ENVIRONMENTAL CONSIDERATIONS AND
CONSTRAINTS
32ENVIRONMENTAL & CULTURAL RESOURCES PERMITS
NEEDED FOR PHASE 1A
- Virginia Department of Environmental Quality (VADEQ) Water Protection Permit/Section 401 Water Quality Certification
– For impacts to waters of the US, including wetlands
- USACE Regulatory – Regulatory Guidance Letter (RGL) 88-05 – USACE does not issue permits to itself for Civil Works Projects. USACE would need to be applicant/co-applicant
- VADEQ General Construction Permit/SWPP – Contractor requirement issued by City of Norfolk since DEQ has delegated their authority to the localities
- Virginia Marine Resources Commission (VMRC) –The Attorney General’s office has confirmed that no permit is required for the flood control project and related measures. However, Baylor Grounds in future phases must be reviewed by VMRC
- Local Wetlands Board Permit – Permit is not required. Exempt from City of Norfolk
- Chesapeake Bay Preservation Act (CBPA) – Will need clearance and is issued by City and currently working with the city
- Land Disturbance Permit from City of Norfolk – Contractor obtains before start of construction
- Coast Guard – Permit or waiver, for bridge over navigable waters at Newtons Creek
- State Historic Preservation Officers (SHPO) - Submittal of Phase 1 Survey
QUESTIONS AND ANSWERS SESSION
1. On Page 2, Paragraph 4 it states, “Phase 1 is further split into Phases 1A, 1B, and 1C/D, with the focus of this Industry Day on the Phase 1A – Floodwall Single Award Task Order Construction Contract (SATOC) and Pump Stations Contracts (Design- Build and Design-Bid-Build).” Please clarify if the Pump Stations Contracts (Design-Build and Design-Bid-Build) are included in the SATOC or will these pump stations be procured as stand-alone contracts? If stand-alone contracts, what is the timing of both designs AND construction activities for the multiple phases? To succinctly convey with information, perhaps the District could publish a table with the anticipated schedule and acquisition strategy (sample provided via email).
– Answer: This was answered on slides, 12, 14 and 15. The SATOC is planned for Phase 1A Floodwall only and the pump stations are planned as stand-alone contracts, Harbor Park (DB) and Newton’s Creek with Tide Gate (DBB).
2. On Page 2, Paragraph 5 it states, “The scope for Phase 1A may include, but is not limited to, new construction of a floodwall, tide gate, sliding or swinging gate closures, living shoreline features, and pump stations with required utility relocations and installation for the noted areas. The Contractor shall be required to perform all work in accordance with the access and security requirements of the customer for each project.” What are the “access and security requirements of the customer”? Will there be handling and storage requirements for project documents and deliverables (e.g. CUI)? Will there be clearance or citizenship requirements for personnel involved with the project?
– Answer: The access and security requirements are TBD, but will be included in the solicitation. Typically involves antiterrorism training.
QUESTIONS FROM INDUSTRY
3. On Page 2, Paragraph 6 it states, “Phase 1A will include Design-Build (DB) and Design-Bid-Build (DBB) construction.
Competitive contracts will be issued through DB or DBB infrastructure construction projects in support of CSRM within the City of Norfolk (location shown in Figure 1). It is anticipated that Phase 1A floodwall will be further phased into separate construction segments for constructability in a SATOC. The SATOC is anticipated to have four (4) to six (6) task orders for a shared capacity of approximately $250,000,000 with a five-year base ordering period and an optional six (6) month extension. The pump station at Harbor Park is anticipated as a DB contract and the pump station with tide gate at Newton’s Creek is anticipated as a DBB contract.” Please clarify if the Pump Stations Contracts (Design-Build and Design-Bid-Build) are included in the SATOC or will these pump stations be procured as stand-alone contracts? If stand-alone contracts, what is the timing of the advertisements and what is the approximate size of each contract. Please clarify what is meant by “The SATOC is anticipated to have four (4) to six (6) task orders for a shared capacity of approximately $250,000,000”. The term “shared capacity” seems to suggest a MATOC instead of a SATOC.
-Answer: This question was answered in the previous slides. The pump stations will be stand-alone contracts and not part of the SATOC. Harbor Park is planned for a Design-Build contract and Newton’s Creek Pump Station with Tide Gate is planned for a Design-Bid-Build contract. Advertisement for Harbor Park is anticipated late 2025 and Newton’s Creek advertisement date is TBD.
QUESTIONS FROM INDUSTRY CONTINUED…
4. On Page 3, the first sentence states, “There will be a two-phase solicitation in accordance with FAR 36.3 to establish the base for Phase 1A – Floodwall, Single Award Task Order Construction Contract (SATOC) award.” FAR 36.302 states “One solicitation may be issued covering both phases, or two solicitations may be issued in sequence.” Has the KO determined if there will be one or two solicitations in this case?
-Answer: The KO has not determined if there will be two solicitations at this time.
5. On Page 3, the second sentence states, “Funding sources for the proposed contracts may include Bipartisan Infrastructure Law (BIL), Construction General Federal funding, City of Norfolk funding, and any other authorized type of funding.” Please confirm that USACE will be the contracting agency regardless of the funding source.
-Answer: USACE will be the contracting agency for the SATOC and pump stations in Phase 1A.
QUESTIONS FROM INDUSTRY CONTINUED…
What are attainable small business goals for these contracts?
- Phase 1A Floodwall SATOC
- Harbor Park Pump Station
- Newton's Creek Pump Station and
Tide Gate
Industry input for SB goals needed now, as we are underway with Market Research.
