SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMENDMENT 0002

ProjNet Bidder Inquiries and Government Responses provided below:

Bidder Inquiry ID: 9344846

Bidder Inquiry: On page 91 of the referenced solicitation, it states:

“At least one project shall be provided for the prime Offeror (the entity signing the SF1449). If the Offeror is comprised of more than one member via a teaming agreement, joint venture (JV) agreement, or other appropriate instrument, relevant project experience should be submitted for projects completed by the Offeror as the proposed collective. If the JV does not have shared experience, projects may be submitted for the constituent members. In this event, the Offeror should indicate what role(s) the member actually performed on the submitted project and what role is proposed for that member for this project if it is awarded the contract.”

And, per 13 C.F.R. 125.2(g):

When an offer of a small business prime contractor includes a proposed team of small business subcontractors and specifically identifies the first-tier subcontractor(s) in the proposal, the head of the agency must consider the capabilities, past performance, and experience of each first-tier subcontractor that is part of the team as the capabilities, past performance, and experience of the small business prime contractor if the capabilities, past performance, and experience of the small business prime do not independently demonstrate capabilities and past performance necessary for award.

Thus, an agency must consider the capabilities, experience, and past performance of first tier subcontractors as the experience of the prime contractor where:

1. The prime contractor is a small business;

2. The prime contractor proposes a “team” of small business subcontractors that are identified in the proposal;

and

3. The prime contractor does not independently demonstrate the capabilities and past performance necessary for award.

To clarify, as long as there is a teaming agreement in place, is it permissible for all of the five projects to come from other team member firms and NOT the Prime?

Response to Bidder Inquiry: Reference page 91, Section B.1.b, the second-to-last paragraph reads, “If the JV does not have shared experience, projects may be submitted for the constituent members. In this event, the Offeror should indicate what role(s) the member actually performed on the submitted project and what role is proposed for that member for this project if it is awarded the contract.” If appropriate, teaming agreements are in place as required by the solicitation and it is permissible to submit projects for the constituent members. Offeror should indicate what role(s) the member actually performed on the submitted project and what role is proposed for that member for this project if it is awarded the contract.

Bidder Inquiry ID: 9345334

Bidder Inquiry: To better demonstrate the Offeror’s capabilities to perform the various types of work described in the PWS (Item C.2 – scope of work), will the District expand or remove the relevant project minimum requirements as defined on page 91 of the RFP.

“At a minimum, a project considered relevant must include:

i. Dredged material Testing and Evaluations under Clean Water Act (CWA), Section 404 or Marine Protection, Research, and Sanctuaries Act, Section 103 performed in accordance with federal technical guidance manuals including USEPA/USACE “inland Testing Manual” (CWA, Section 404) or USEPA “Green Book” (MPRSA, Section 103) and applicable USEPA Regional Implementation Manual, and ;

ii. Conduct Dredged Material collection and field sampling in support of dredged material testing and evaluations and/or taking possession of dredged material samples in the field through chain of custody procedures in support of dredged material collection and field sampling.

A project meeting the requirement of “I” and “ii” will be considered relevant. A project not meeting both “I” and “ii” will NOT be considered relevant.”

Response to Bidder Inquiry: Reference page 5, Performance Work Statement (PWS), Section C.1. reads, “General. The purpose of this contract is to provide dredged material evaluations in accordance with the Marine Protection, Research, and Sanctuaries Act (MPRSA), Section 103/Clean Water Act, Section 404 and related services…” The District will NOT expand or remove the relevant project minimum requirements as defined on page 91 of the RFP. The requirements are integral to the successful execution of the District’s navigation mission and civil works program.

Bidder Inquiry ID: 9345338

Bidder Inquiry: Performance’s page count referenced on page 90 of the RFP?

Response to Bidder Inquiry: Page 90 of the solicitation, Section 1.a. Factor I – Management Approach reads, “The summary narrative descriptions should not exceed five (5) single-sided pages, total.” Also, on page 90 of the solicitation, Section 1.b.1. Factor II – Past Performance reads, “The Offeror may submit up to five (5) example projects or contracts…” and “Each example project submitted for consideration shall not exceed four (4) pages (single-sided).” So, a maximum of 20 pages for Past Performance will be allowed.

Bidder Inquiry ID: 9345341

Bidder Inquiry: Are PPQs excluded from Factor II – Past Performance’s page count referenced on page 90 of the

RFP?

Response to Bidder Inquiry: Yes, PPQs are excluded from Factor II – Past Performance’s page count reference on page 90 of the RFP.

Bidder Inquiry ID: 9345337

Bidder Inquiry: Would a 10 day extension to the submission deadline be considered to allow adequate time to assess the District’s responses and incorporate any changes into the Offeror’s submission?

Response to Bidder Inquiry: ProjNet closes 10 days before the Proposal due date in order to allow for any necessary Solicitation Amendments and to give the Contractor time to make final revisions to their Proposal based on those Amendments. A 10-day extension will not be granted at this time.

Bidder Inquiry ID: 9350962

Bidder Inquiry: This inquiry is in regards to Attachment J.1 (Schedule of Services), Table 2 (Analytical & Toxicological Bid Schedule), lines 0002AK and 0002AL regarding species selection (0002AK Leptocheirus plumulosus (estuarine marine amphipod), 0002AL Ampelisca abdita (estuarine marine amphipod), Neanthes arecendentata (polychaete worm).

Should Line 0002AK list the two interchangeable amphipod species (with one being chosen based on grain size and availability) and line 0002AL include solely the marine polychaete Neanthes arecendentata?

Response to Bidder Inquiry: Organisms listed in Attachment J.1 (Schedule of Services), Table 2 (Analytical & Toxicological Bid Schedule), lines 0002AK and 0002AL regarding species selection (0002AK Leptocheirus plumulosus (estuarine marine amphipod), 0002AL Ampelisca Abdita (estuarine marine amphipod), Neanthes arecendentata (polychaete worm) represent those previously required and approved by the USEPA, Region III on previous Norfolk District MPRSA evaluations. All species used for future whole sediment bioassays and bioaccumulation studies will be coordinated and approved by the USEPA.
