AMENDMENT 0001
ProjNet Bidder Inquiries and Government Responses provided below:
Bidder Inquiry ID: 9334355
Bidder Inquiry: Will projects where the dredged material testing program is 100% complete (Section 103 permit issued and dredging initiated) but other phases of the project are ongoing (i.e., the task order is still open) be accepted to meet the requirement for recency to be 100% complete?
Response to Bidder Inquiry: Please see Solicitation requirement Page 90, Section B.b.1.a), which states, “Projects provided must be 100% completed projects and have been completed within the last six (6) years, as of the immediately preceding the date of issuance of the solicitation.”
Bidder Inquiry ID: 9334638
Bidder Inquiry: Page 18 section b. (2) of the RFP specifies that the required analyses for VOCs and SVOCs should be from EPA TCL and TAL metals from ITM list. The pricing sheet (Table 2) requires "Specific analytes and Target Detection Limits shall conform to the Inland Testing Manual (ITM) or as required by KO and/or USEPA RIM."
There seems to be some room for interpretation in these requirements. Are we correct to assume that specific analyte lists and required detection limits will be defined at the task order level?
Response to Bidder Inquiry: Yes, specific analyte lists and required detection limits will be defined at the Task Order level.
Bidder Inquiry ID: 9334639
Bidder Inquiry: Attachment J.2 Table 2 provides one row per analysis with multiple potential sample media listed for each analysis. Laboratory pricing in some cases is media-dependent and therefore one unit price per analysis will not accurately reflect analytical costs. For example, tissue samples require a preparation step prior to analysis.
We recognize the intent of the pricing sheet to enable evaluation of reasonableness AND to set contract pricing for subsequent award, so we respectfully request that the Government consider allowing the inclusion of a sample preparation charge, as appropriate, at the task order level for those media/methods that require it.
Response to Bidder Inquiry: There may be instances when sample preparation charges are needed. When necessary sample preparation charges will be defined at the Task Order level specific to the requirements of the dredged material evaluation.
Bidder Inquiry ID: 9334640
Bidder Inquiry: Page 18 section b. (2) of the RFP lists several tests that labs need to have the capability for that are not listed in the pricing sheet (eg., explosives, TPH (GRO, DRO, HRO), biological and limnological parameters (not defined), radioactivity (methods not specified), and hazardous waste characterization. Will the Government accept a statement from the laboratory that they have the capability to provide these tests as sufficient for the purpose of this proposal?
Response to Bidder Inquiry: Yes, the Government will accept a statement from the laboratory that they have the capability to provide these tests.
Bidder Inquiry ID: 9334641
Bidder Inquiry: Page 95 Section L 3. F and Note 3. on Table 2 states that subcontractor markup shall not exceed 5%. Please define "markup" – is it G&A and/or profit or some other factor?
Response to Bidder Inquiry: As described on page 95 Section L, C.3.f, Subcontractor markup (not to exceed 5%) is intended to cover the prime contractor’s costs that are expected to be directly incurred through the subcontractors work under Task Orders issued under the contract.
Bidder Inquiry ID: 9334642
Bidder Inquiry: Attachment J.1 Table 1 – Line 0005 is the sum of Line 0001 (Average Weighted Labor Subtotal), Line 0002 (Analytical and Toxicological Subtotal from Table 2), and G&A and Profit (Lines 0003 and 0004) applied to Lines 0001 and 0002. While we understand Line 0005 is being used for evaluation purposes only, the Subtotal in Line 0002 already includes a markup (see preceding question), which presumably means G&A and profit have already been applied to analytical costs. If so, we request that the formula in Table 1 be changed so that Lines 0003 and 0004 be applied to Line 0001 only, to avoid double counting.
Response to Bidder Inquiry: Table 1 will not be revised as the comment recommends. G&A and subcontractor mark-up are intended to account for the Prime Contractors costs for work and subcontractors work under Task Orders under the contract.
Bidder Inquiry ID: 9337117
Bidder Inquiry: Given that USACE issued this Solicitation as an RFP and not an SF330, we respectfully request that the District consider providing Offerors with 45 days to provide proposal responses. This time is particularly useful for the development of PPQs during the summertime vacation season.
Response to Bidder Inquiry: We have considered your inquiry and have decided the solicitation closing date will remain the same. Per FAR 5.203(c), there is no minimum response time for commercial contracts and that a 30-day response time is sufficient for this solicitation.
Bidder Inquiry ID: 9337175
Bidder Inquiry: Please clarify the Utilization of Small Business Requirements relative to FAR clause 52.219-8, which was highlighted as a requirement. Is the District requesting that key subcontracts – 20% or greater – must be small businesses?
Response to Bidder Inquiry: Clause 52.219-8 provides the definitions of the different types of Small Businesses that are eligible to submit under this 100% Small Business Set Aside solicitation. With regards to 20%, see page 88 of the Solicitation, Section A, No. 7 “Joint Venture and Team Arrangements.” The section reads, “all offerors proposing a Joint Venture, key subcontractor (performing 20% or more of the prime contract)…” where the 20% is related to those proposals submitted by a Joint Venture. The solicitation mentions “key subcontractors” and does not require them to be a large or small business, just that they are a “key subcontractor performing 20% or more of the prime contract.”
Bidder Inquiry ID: 9337182
Bidder Inquiry: Please clarify if the District believes that laboratories, which are a significant cost, are considered as Key and will therefore require teaming agreements? Such agreements with a commodity services is counterintuitive to competitive procurement of said services and could result in a higher cost to the government.
Response to Bidder Inquiry: Refer to page 88 Section A, No. 7 “Joint Venture and Team Arrangements,” with regards to the meaning of “key” and associated requirements of the solicitation.
Bidder Inquiry ID: 9341554
Bidder Inquiry: Please confirm that all exhibits, figures, and tables submitted on 11 x 17 inches in size will be counted as one page each.
Response to Bidder Inquiry: Yes, exhibits, figures, and tables submitted on 11 x 17 inches in size will be counted as one page each.
