Section 00 21 00 - Instructions

INSTRUCTION TO OFFERORS

A. STATEMENT OF WORK

Replace Boilers:

Building 34 – the scope includes the replacement of two Branham boilers that are fired with #2 fuel oil. These are two low pressure heating water boilers. The two new boilers will be natural gas fired, high efficiency, low NOx boilers that will be connected to a new natural gas line pipe at a point that is 5 feet outside the building. This work will also include the removal of the existing fuel oil system including the pumps, storage tanks and the remaining fuel in the tanks.

Building 59 – the scope includes the replacement of two Hurst boilers that are fired with natural gas. These are two high pressure steam boilers. The two new boilers will be natural gas fired, high efficiency, low NOx boilers. This work will also include renovation to the mechanical room including the cleaning and painting of all mechanical room walls, providing new windows, replacing the lighting with new energy efficient LED lights; re-sizing the existing door to a 10 foot by 10 foot size so that the existing boilers can be removed from the building and the new boilers installed. Relocate electrical service as required for the new door. The Building 59 mechanical room is named/numbered “Building 79.”

Building 31, K Bay – the scope includes the replacement of two Superior boilers that are fired with #2 fuel oil.

These are two medium pressure heating water boilers. The two new boilers will be natural gas fired, high efficiency, low NOx boilers that will be connected to a new natural gas line pipe at a point that is 5 feet outside the building. This work will also include the removal of the existing fuel oil system including the pumps, storage tanks and the remaining fuel in the tanks.

Install New Natural Gas Line

Install Natural Gas Line - Provide a new natural gas supply line and service connections to various existing building and a proposed building at DLA Richmond; the new lines will supply Buildings 31, 32, 33, 34, 42 and the new Access Control Point (ACP) building. The work is being coordinated with the City of Richmond, who has supplied the gas line on the other side of the fence line, outside the base.

B. PROJECT DURATION

The project duration / contract completion dateis 270 calendar days fromthe notice to proceed.

2.0 PROPOSAL FORMAT & GENERAL INSTRUCTIONS

2.1 Submit only the electronic documents. Submit only the electronic files specifically authorized and/or required elsewhere in this section. Do not submit excess information, to include audio-visualmaterials, electronic media, etc. All pages shallbe numbered. A single side of a sheet of paper equals onepage.

2.2 PDF pages shallbe formatted to print on 8 ½ by 11 inch paper, unless another paper size is specifically authorized elsewhere in this section for a particular submission. Spreadsheets mustfit to 11” x 14” or 11” x 17” paper size unless specifically authorized in this sectionfor a particular submission. Do not usea font size smaller than 10, an unusal font style such as script, or condensed print for any submission. Allpage margins mustbe at least 1 inch wide,but may include headers and footers of the solicitation, project title and company.

2.3 “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal.

Offerors that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must be clearly marked in accordance with the instructions at FAR 52.215-1, Instructions to Offerors— Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data”.

2.4 In the case of an Offeror that is part of a large, multi-segmented business concern, provide information directly pertaining to the specific segment of the business concern (i.e., the division, group, unit, etc.) that will perform work under the prospective contract.

2.5 Proposal revisions shall be submitted as page replacements with revised text readily identifiable, e.g., bold face print or underlining. The source of the revision or amendment, e.g., Error, Omission or Clarification shall be included and be annotated for each revision. Proposal replacement pages shall be numbered and clearly marked “REVISED”, with the date of revision. Revised page will be submitted in a different color than the original pages being replaced.

3.0 BID GUARANTEE

A Bid Guarantee will be required for this solicitation. The penal sum of the bond for the task order will be required as stated in provision 52.228-1, Bid Guarantee. Scanned copy submission of the bid bond is required.

4.0 SUBCONTRACTING PLAN (CONSTRUCTION)

If the offeror is a large business and the offer amount exceeds $1,500,000.00, he shall submit a subcontracting plan within three days of bid opening and identified as the apparent low offeror in accordance with FAR 52.219-9 Alt I (Dev). The subcontracting plan shall be reviewed and approved by the Contracting Officer prior to award.

E. BID EVALUATION AND AWARD EVALUATIONS

In accordance with FAR 14.408-1, the Government will make a contract award (1) by written or electronic notice,

(2) within the time for acceptance specified in the bid or an extension and (3) to that responsible bidder whose bid, conforming to the invitation, will be most advantageous to the Government, considering only price and the price-related factors included in the invitation for bid.

Bidders are instructed to allocate all indirect costs to perform this contract, including but not limited to those costs it would expect to incur to perform or comply with the requirements of Division 01 of the Specifications, Overhead, Profit, and Bonding, in Contract Line Item Number (CLIN) 0001 of the Bid Schedule.

Bidders shall allocate all direct costs to perform the Gas Line work and replace the Boilers in Buildings 31, 34, 59, & 79, complete as indicated in the Specifications and shown in the drawings, in CLINs 0002 and 0003, respectively.

F. RESPONSIBILITY DETERMINATION (FAR 9.1)

In accordance with FAR Part 9.1, prior to awarding a contract, the Government will conduct a Responsibility Determination of the firm selected for award.

To be determined responsible, a prospective contractor must –

* Have adequate financialresources to perform the contract, or the ability to obtain them;

* Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

* Have a satisfactory performance record. A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history;

* Have a satisfactory record of integrity and business ethics;

* Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors);

* Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and

* Be otherwise qualified and eligible to receive an award under applicable laws and regulations

G. RESPONSIVENESS OF BIDS (FAR 14.301)

a) To be considered for award, a bid must comply in all material respects with the invitation for bids. Such compliance enables bidders to stand on an equal footing and maintain the integrity of the sealed bidding system.

b) Facsimile and emailed bids shall not be considered.

c) Bids should be filled out, executed, and submitted in accordance with the instructions in the invitation. If a bidder uses its own bid form or a letter to submit a bid, the bid may be considered only if --

a. The bidder accepts all the terms and conditions of the invitation; and

b. Award on the bid would result in a binding contract with terms and conditions that do not vary from the terms and conditions of the invitation.

d) In order for the bidder to be considered responsive the unit price must be filled in and must not past two decimal places.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. (c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $ 340,000 whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.233-2 SERVICE OF PROTEST (SEP 2006)

52.219-2 EQUAL LOW BIDS. (OCT 1995)

(a) This provision applies to small business concerns only.

(b) The bidder's status as a labor surplus area (LSA) concern may affect entitlement to award in case of tie bids. If the bidder wishes to be considered for this priority, the bidder must identify, in the following space, the LSA in which the costs to be incurred on account of manufacturing or production (by the bidder or the first-tier subcontractors) amount to more than 50 percent of the contract price.

(c) Failure to identify the labor surplus area as specified in paragraph (b) of this provision will preclude the bidder from receiving priority consideration. If the bidder is awarded a contract as a result of receiving priority consideration under this provision and would not have otherwise received award, the bidder shall perform the contract or cause the contract to be performed in accordance with the obligations of an LSA concern.
