SECTION 00120

SECTION 00120 PROPOSAL EVALUATIONS AND BASIS FOR AWARD

1. GENERAL INFORMATION

1.1 ACQUISITION APPROACH. This is a competitive acquisition using the Low Price Technically Acceptable source selection process for the award of a firm fixed-price construction contract. This process will allow an award made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. This acquisition will use FAR Part 15 and is intended to minimize the complexity of the solicitation, the evaluation, and the source selection decision while maintaining a process designed to foster an impartial and comprehensive evaluation of the offeror’s proposals, leading to selection of the proposal representing the best value to the Government.

In accordance with FAR 19.705-2, the following actions were taken to determine whether a subcontracting plan is required for this acquisition: (a) determine if the proposed contractual action meets the dollar threshold ($1.5M for construction) at 19.702(a)(1); (b) determine if subcontracting possibilities exist by considering (1) if firms engaged in the business subcontract for performance or maintain sufficient in-house capabilities to perform work, and (2) likelihood for the need to prequalify products. A review of the requirements of the work indicates that subcontracting opportunities exist. This work requires a variety of disciplines to include structural, mechanical, electrical, controls, and equipment demolition and disposal. Based on this determination, if the offeror is a large business, a subcontracting plan is required to be submitted with the proposal.

As prescribed in FAR Part 19.708(b)(1), the solicitation includes FAR clause 52.219-9, Small Business Subcontracting Plan, Alternate II. The Small Business Subcontracting Plan is not a requirement for evaluation in source selection, but rather a requirement for award to a large business concern. The Subcontracting Plan will be incorporated into the resultant contract and the contractor’s implementation of Subcontracting Plan evaluated as part of the project evaluation completed in the Government’s Contractor Performance Assessment Reporting System (CPARS).

1.2 BASIS OF AWARD. Award will be made to the acceptable proposal meeting or exceeding the technical acceptability standards for non-cost factors and is the lowest price of all acceptable proposals. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors.

1.3 EVALUATION OF THE TECHNICAL PROPOSAL. The Technical Proposal will be evaluated based on the criteria identified in the individual attachments for the Factors. Failure to demonstrate the minimum acceptability standards under ANY factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

1.4 EVALUATION OF THE PRICE PROPOSALS

1.4.1 Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are reasonable for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

1.4.2 The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on a CLIN, element, or total price basis, and/or provide additional information in support of their price, prior to contract award.

2.6 Factor 2 – Past Performance

2.6.1 Submission Requirements:

2.6.1.1 Past Performance Information (PPI) is to be provided for the projects listed on the Offeror and Subcontractor “Experience Information” forms submitted in Factor 1.

Department of Defense (DoD) projects:

Offeror should submit a copy of the Government’s Contractor Performance Assessment Reporting

System (CPARS) Evaluations. If unable to provide the printed CPARS evaluations, provide written notification that current ratings are available so that the Government may obtain the printed evaluation.

Offerors should not request Past Performance Questionnaires (PPQ)s on projects that have final CPARS evaluations. If a PPQ is received on a project where a final CPARS evaluation exists, the CPARS evaluation will serve as the official rating of record for evaluation purposes.

Projects that do not have a CPARS evaluation:

Offeror shall forward a copy of the Past Performance Questionnaire (PPQ) to the points of contact (POC) responsible for monitoring performance under those contracts (Exhibit C of this solicitation).

Completed PPQs should be included with the proposal if at all possible. However, if necessary, they can be submitted directly to Contract Specialist, Dean Liguori by e-mailing completed documents to both of the following addresses:

LRE-Quotes@usace.army.mil and Dean.Liguori@usace.army.mil

NOTE: If PPQs will be submitted directly to Mr. Liguori it is recommended that Offerors include a list of the POC’s contact information. This information will be used to ensure that the PPQs are placed with the correct (Insert solicitation #) proposal. (i.e. If a subcontractor is submitting a PPQ directly to Mr. Liguori, instruct them to identify which Offeror’s proposal the PPQ should be placed with.) A reasonable attempt will be made to match the PPQs to the correct proposal. However, it is the Offeror’s responsibility to ensure the PPQs have been received by Mr. Liguori by the proposal due date.

Offeror shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.

However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offeror may submit PPQs they have previously received to be used on other RFPs as long as they pertain to the projects submitted in Factor 1, Sub-factor 1.

Any PPQs not received by the Contract Specialist by the proposal closing date will not be reviewed or evaluated.

2.6.1.2 Contractor Performance Assessment Reporting System (CPARS) and Past Performance Information Retrieval System (PPIRS) are the required sources of past performance information, when available. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/Unique Entity Identifier numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources whether identified by the proposal or not.

2.6.1.3 While the Government may elect to consider data from other sources, the burden of providing the required, detailed, current, accurate and complete past performance information rests with the Offeror.

2.6.1.4 New entities without past performance history shall include a letter with the proposal, stating that they have had no previous clients and that the minimum number of questionnaires cannot be provided. It is the Offeror’s responsibility to ensure that sufficient reference documentation is provided to substantiate the statement, as the Government may or may not make additional requests for past performance information from persons familiar with the Offeror’s performance history.

2.6.2 Evaluation Criteria

2.6.2.1 Documentation of satisfactory performance of projects with no adverse information with respect to criminal activity, evasion of taxes, or cooperation in the pursuit of small business goals will be considered to have met the minimum requirements of the Solicitation and will be rated “Acceptable”. CPARS, Past Performance Evaluation forms, FAPIIS and SAM records will be used to make these determinations.

2.6.2.2 Offers which do not demonstrate satisfactory performance of relevant projects will not be considered to have met the minimum and will be rated “Unacceptable”.

2.6.2.3 Offerors with no past performance information will receive an “ACCEPTABLE” rating for this factor. The

Government may obtain and evaluate past performance information from any source it deems appropriate. In assessing performance confidence, the evaluator may:

a) Evaluate present and past performance information through the use of questionnaires completed by the Offeror’s references;

b) Use data independently obtained from other Government or commercial sources, to include but not limited to Government databases;

c) Rely upon personal business experience with the Offeror;

d) Consider any information the Offeror submits which explains any problems encountered on the identified contractor and the Offeror’s corrective actions.

The evaluation may take into account Past Performance information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. The evaluation will also consider information provided relative to corrective actions taken to resolve problems on past or existing, contracts.

Current, Relevant, Trends: Evaluators will consider the performance information for currency, relevancy as well as trends in the performance while conducting its evaluation.

• “Current” means performance occurring within the last ten (10) years for the period beginning ten years prior to the solicitation release date. Within this period, performance occurring later in the period may have greater significance than work occurring earlier in the period.

• In assessing relevancy, the Government may evaluate an Offeror’s references for similarity of the construction methods. Trends in performance will be considered.

2.6.2.4 OTHER PAST PERFORMANCE CONSIDERATIONS

Evaluators may also consider the following issues when…
