The Contractor shall furnish all necessary management, personnel, materials, supplies, tools, equipment, fuel, and vehicles, except as otherwise provided herein, required to perform once per yearly application of herbicide and emergent growth for vegetation control at eleven (11) specified U.S. Army Corps of Engineers (USACE) projects, as specified and in strict accordance with all Terms, Conditions, General, Specific and Technical Provisions, Drawings, Attachments, Appendices, etc., contained herein or incorporated by reference. PERIOD OF PERFORMANACE
PRIOR TO INITIATING WORK, the Contractor shall coordinate with the relevant COR and Lockmaster at each location for date of actual service. Servicing shall take place once per annum, at a date and time of the relevant Lock Master's discretion between Date of Award and 30 June of the Base Year during regular hours of operation at each site. For Option Years 1 and 2, the timeframe is between 01 May and 15 June during regular hours of operation.
Please reference the Contract Number W911WN23P30XX (TBD) on all invoices.
NOTE: In lieu of submitting a hardcopy invoice to the USACE Finance Center (UFC) in Millington, TN via the United States Postal Service per the contract instructions in Block 18a, an electronic invoice may be submitted via email per the instructions in Attachment 1 to this task order.:

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days;
provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (OCT 2022)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. PESTICIDE APPLICATION, PITTSBURGH DISTRICT LOCKS AND DAM
1. WORK TO BE PERFORMED
(a) The Contractor shall furnish all necessary management, personnel, materials, supplies, tools, equipment, fuel, and vehicles, except as otherwise provided herein, required to perform once per yearly application of herbicide and emergent growth for vegetation control at eleven (11) specified U.S. Army Corps of Engineers (USACE) projects, as specified and in strict accordance with all Terms, Conditions, General, Specific and Technical Provisions, Drawings, Attachments, Appendices, etc., contained herein or incorporated by reference.
(b) Working Hours. Normal working hours, except as otherwise specified herein, shall be Monday through Friday, 7:30 a.m. to 3:00 p.m. Eastern Time (ET). Work inside Government buildings or other secured areas shall be performed during the above referenced work hours. Work that interferes with other ongoing functions at the project shall be scheduled around normal working hours, as specified by the COR.

2. GENERAL REQUIREMENTS
For the purposes of this contract, “Pesticide Application” includes the use of herbicides, insecticides, fungicides, larvicides and rodenticides. The Contractor shall provide ground application services for pesticides at the locations indicated in Section 1(c) of this Performance Work Statement, and as shown in Exhibits 1-7. A kill rate of 95% of the target pests shall be considered the standard for pesticide application on the project. The Government allows the use of only general-use (nonrestricted ) pesticides. COR approval is required before application of any pesticide.
a. Use of Pesticides. The use of pesticides by the Contractor shall be in accordance with the project’s approved Annual Pest Control Plan. All pesticide applications planned by the Contractor shall be included in this plan. The Contractor shall submit pesticide application plans for each calendar year to the COR by 01 December of the preceding year.
b. Application shall be done in accordance with all local, state, and federal laws. A minimum of one state-certified applicator shall be supervising all pesticide application work. Proof of certification shall be submitted to the COR prior to starting pesticide application.
c. All safety standards shall be followed including manufacturer's recommendations. The pesticides shall be mixed and applied in accordance with the manufacturer's specified application rate. All proper precautions shall be employed to prevent the pesticides from contaminating surrounding areas. The Contractor shall furnish and use a spray pattern indicator which is inert and biodegradable in all spraying operations. When requested by the COR, the Contractor shall provide barricades and/or proper signs to protect the public from exposure to the pesticides. The Government reserves the right to inspect the equipment to be used at any time and to require its removal from the worksite if it is found to be unsafe. The Contractor must provide adequate safety equipment and ensure its use during applications.
d. All pesticides must be approved by the COR prior to their use on Government property. The Government allows the use of only general-use (non-restricted) pesticides. The Contractor shall mix and store all pesticides off the project.
e. Following each application of pesticides, a "Pesticide Application Record", CELRP Form 1031 Appendix IX, shall be completed by the Contractor and submitted to the COR within seven (7) calendar days after the application.
f. Nuisance Insects. If nuisance insects (including but not limited to wasps, hornets, and yellow jackets) are observed to be swarming or to have a nest within the limits of any area maintained under this contract, the Contractor shall take the necessary steps to exterminate and remove the insects and nest. No separate payment will be made for removal of insects.
3. FEDERAL HOLIDAYS
Holiday Work. The eleven Federal holidays observed are:
New Year's Day (January 1st) Martin Luther King Day (3rd Monday in January) President's Day (3rd Monday in February) Memorial Day (Last Monday in May) Juneteenth (June 19th) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th)
When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday.
When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work shall be scheduled around the above listed Federal holidays except as specified herein or as approved by the COR.
4. SAFETY REQUIREMENTS
The Contractor shall comply with all current provisions of the Occupational Safety and Health Act (OSHA) in addition to the requirements of the Corps of Engineers Manual, EM 385-1-1, "Safety and Health Requirements Manual" (see http://www.usace.army.mil/CESO/Pages/EM385-1-1.aspx). If the Contractor fails or refuses to promptly comply with safety and security requirements as specified herein, the Contracting Officer may issue a stop work order for all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made subject to a claim for extension of time or for excess costs or damages to the Contractor. The Contractor will not be paid for work not performed as a result of the stop order.
5. DAMAGE REPORTS
In all instances where Government property and/or equipment is damaged by Contractor employees, a full report of the incident and extent of such damage shall be submitted to the COR within two work days of occurrence.
6. DEFICIENCIES
(a) REPERFORMANCE. If any of the work performed does not conform to contract requirements, the Government may require the Contractor to perform the work again at no cost to the Government. When the defect in work cannot be corrected by reperformance, or cannot be corrected in the specified time frame, the Government may, by separate contract or otherwise, perform the work and charge the Contractor any costs incurred by the Government that are directly related to the performance of such work. The actual cost includes, but is not limited to, labor costs including benefits, transportation, and materials.
(b) Contract Deficiency Report (CDR) (DD2772). A CDR will be issued to the Contractor for any failure to perform. The CDR describes the deficiency or problem and will be discussed with the Contractor or his representative when it is issued. The Contractor shall provide his written response on the CDR form within 24 hours of issuance. The Contractor's response shall identify the cause and corrective action taken and identify corrective actions. The COR will evaluate the Contractor's response and record the corrective action to be taken, which may include deductions in payment. Upon finalization of the CDR, the Contractor and the COR shall sign the form and the Contractor will be given a copy of the completed form. Should the Contractor not concur with any decision or finding, the Contractor may so state, in writing, and request a final decision by the Contracting Officer. The Contracting Officer will review all CDRs issued; CDRs will also become a part of the permanent contract file.
7. QUALITY ASSURANCE.
The Government will monitor the Contractor's performance in each functional area under this contract and reserves the right to use whatever additional surveillance procedures it deems appropriate. Contractor performance will be monitored by the contracting officer to ensure compliance. The Government reserves the right to change methods of inspection as deemed necessary.
8. SECURITY REQUIREMENTS.
1. ANTI-TERRORISM/OPERATIONAL SECURITY (AT/OPSEC) per ENG Form 6055.
i. AT/OPSEC 1. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures.
