SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
EVALUATION AND BASIS FOR AWARD
1. BASIS FOR AWARD
In accordance with FAR 15.304(c)(1)(ii), the Government intends to award a contract to each qualifying Offeror. A qualifying Offeror is an Offeror that is determined to be a responsible source in accordance with FAR Subpart 9.1, Responsible Prospective Contractors, submits a technically acceptable proposal that conforms to the requirements of the solicitation, and the Contracting Officer has no reason to believe the Offeror would be likely to offer other than fair and reasonable pricing. FAR 15.304(c)(1)(ii) permits Contracting Officers to evaluate cost or price only at the delivery order levels, if the multiple-award contract under which the orders are being placed are for the same or similar services and a contract award was made to each and all qualifying Offerors. The Contracting Officer has confidence the Government will receive fair and reasonable pricing at the delivery order level.
The award will be made based on the appropriate consideration given to the two (2) evaluation Factors: (1) Capacity and Capability and (2) Past Performance. To receive consideration for award, a rating of Acceptable must be achieved in both Factors.
The source selection process will be conducted in accordance with FAR Subpart 15.3, Source Selection procedures.
Offers will be evaluated using the criteria listed below. Non-compliance with the RFP requirements may raise serious questions regarding an Offeror’s technical ability or past performance, and may be grounds to eliminate the proposal from consideration for contract award. Failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP will be considered unacceptable. A proposal that is orderly and sufficiently documented will be easy for the Government to understand, and will enable the Government to perform a thorough and fair evaluation.
2. FACTORS TO BE EVALUATED
The following evaluation factors will be used to evaluate each proposal.
Factor 1: Capacity and Capability: Each Offeror’s qualifications, certifications and equipment/resources will be evaluated to determine that the Offeror has the capacity and capability to successfully perform the work.
Factor 2: Past Performance: The quality of each Offeror’s recent and relevant past projects will be evaluated to determine if the offeror can successfully perform the required effort.
Evaluation of each Offeror’s proposal shall address each factor as it applies to the RFP to include the submission requirements and statement of work. A detailed explanation of the evaluation criteria for each factor is set forth below in the “Evaluation Approach” of this section.
3. EVALUATION APPROACH
A Source Selection Evaluation Board (SSEB) comprised of representatives of the U.S. Army Corps of Engineers will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. The number and identities of Offerors will not be revealed to anyone who is not involved in the evaluation and award process or to other Offerors. Proposals will be evaluated based on the factors described herein, and the basis of award is per FAR 15.304(c)(1)(ii). All proposals will undergo a compliance review to ensure that all required forms and certifications are complete, and the proposal conforms to the RFP. The overarching evaluation approach for all factors is as follows.
(1) Factor 1 - Capacity and Capability Evaluation Criteria.
An Offeror’s Factor 1 Capacity and Capability submission will be evaluated according to the following criteria.
i. Narrative affirmatively details the size of an indoor facility large enough to fabricate and/or refurbish 17’ x 30’ tainter valves, 3.5’ diameter x 22’ long floating mooring bitts, 10’ x 5’ sector gears, and 10’x10’x6’ gate hoists as complete units;
ii. The proposal submission shall provide shop painting certifications to include an SSPC QP 3 either
Enclosed or Covered Shop Painting Contractor and/or AISC SPE either Enclosed (SPE-P1) or Covered (SPE-P2); and,
iii. A statement identifying who will perform the installation work to include any respective enforceable teaming agreement(s) or enforceable letter(s) of commitment, as applicable.
Rating Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
(2) Factor 2 - Past Performance Evaluation Criteria:
The Government will evaluate the Offeror’s record of past performance to ascertain the probability of successfully performing the required efforts of the solicitation projects to be procured. There are three aspects to the past performance evaluation; recency, relevancy, and quality.
The first aspect of the past performance evaluation is the recency of the past performance. Recent means the contract has been completed and performance occurred within the past six (6) years from the issue date of this solicitation.
Based on this criteria, an Offeror’s past performance submissions will be determined either “recent” or “not recent.”
Submissions deemed not recent will not be evaluated further.
Once a project is determined to be recent, the second aspect of the past performance evaluation is the relevance of the Offeror’s past performance information. For this acquisition, relevant past performance is defined as:
i. Contract experience with a significant feature of work being fabricating structural components for federal local, state or federal locks, dams or flood risk management facilities in a fabrication plant of similar size as proposed under FACTOR 1: CAPACITY AND CAPABILITY (through self-performance or sub-contracting);
OR
ii. Contract experience with a significant feature of work being refurbishment of structural components for federal local, state or federal locks, dams or flood risk management facilities (through self-performance or sub-contracting);
OR
iii. Contract experience with a significant feature of work being installation of fabricated structural components at a federal local, state or federal lock, dam or flood risk management facility (through self-performance or sub-contracting).
Past performance submissions deemed recent, but not relevant, will not be evaluated further.
After past performance submissions are determined recent and relevant, the quality of the recent and relevant past performance will be rated either "Acceptable" or "Unacceptable."
Adjectival Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
If a final CPARS record and final PPQ record exist for a particular project and the ratings conflict; the CPARS record shall govern.
Past Performance will be rated “Acceptable” if all submitted projects are determined recent and relevant and contain “Would recommend for similar requirements in the future” or similar recommendations and the ratings on past performance records must contain “Satisfactory” or greater ratings.
Past performance will be rated “Unacceptable” if any individual recent and relevant past performance contains a “Would not recommend for similar requirements in the future” or similar recommendation or a rating of less than “Satisfactory” was assigned to any individual submission, unless the Offeror's comprehensive past performance information provides the Government with a reasonable expectation the Offeror will successfully perform the required efforts.
In addition to the PPQ or CPARS, the Government may use recent and relevant project data independently obtained from other Government or commercial sources or from any other sources available to include, but not limited to:
Federal Awardee Performance and Integrity Information System (FAPIIS) or Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program/Project Managers and Contracting Officers; and consider any information the Offeror submits which explains any problems encountered on the identified contract and the Offeror’s corrective actions.
4. DEBRIEFING OF OFFERORS
Offerors may request a debriefing in accordance with FAR 15.505 Preaward Debriefing of Offerors or FAR
15.506 Postaward Debriefing of Offerors.
