H-1.2. Ordering Procedures for Delivery Orders.

(1) Prior to issuing a request for delivery order proposal, the Government will use the estimated price of each delivery order in order to determine if it is within the magnitude of this contract.

(2) ORDERING: To clarify the contract clause 52.216-18 "Ordering" the following shall apply:

a. Proposals for each delivery order will be requested in writing. A request for delivery order proposal will be issued by the Contracting Officer. Any type of request for delivery order proposal shall not be interpreted as a Notice to Proceed with the work.

b. The Government request for proposal will delineate (1) statement of work; (2) location of work; (3) character and extent of work; (4) technical requirements; and (5) time period(s) within which the work must be performed.

c. The Contracting Officer intends to provide fair opportunity to all MATOC pool members in accordance with FAR 16.505(b) or prepare a written determination for exception to the fair opportunity process, if applicable, and ensure it is approved at the appropriate level.

d. Delivery orders will be firm-fixed price (FFP). The contractor shall prepare a proposal to perform the work and submit their proposal in writing to the individual and within the time specified in each request for proposal.

e. Each delivery order may be discussed by the contractor and the Contracting Officer, as necessary, to develop a mutual understanding of:

1) Type and scope of work to be accomplished, including accuracy criteria.

2) End product required by the Contracting Officer.

3) Existing site conditions, survey control, and other available data.

f. Time periods within which required work must be accomplished may be negotiated and will be defined in each delivery order placed against the basic contract. Each delivery order will contain the agreed to statement of work, project to be performed, specific deliverable items, and the firm fixed price for performing the work.

(3) If a project under a delivery order cannot be awarded under this MATOC for reasons such as, but not limited to, no interest, no receipt of proposals, price cannot be determined fair and reasonable, etc, then the project may be solicited to the awarded contractors under W911WN22R0002 or by other acquisition methods.

H-1.3. Notice to Proceed.

The contractor shall commence work upon receipt of a properly executed delivery order or modification to a delivery order (unless bonding is required – then upon approval of the bonds) and complete the work within the time specified in each delivery order or modification to each delivery order.

H-1.4. General Wage Decision.

Applicable wage rates will be identified for all Delivery Orders issued under this contract current as of the time of award of the delivery order.

H-1.5. Required Insurance for Work Performed on a Government Installation.

The Contractor shall procure and maintain during the entire period of performance of a delivery order the following minimum insurance only when the delivery order requires work to be performed on a Government installation:

a. Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers.

b. General liability. Bodily injury coverage with minimum limits of $500,000 per occurrence shall be required. Property damage coverage with a minimum limit of $100,000 per occurrence shall be required.

THUS, THE COMBINED SINGLE LIMIT SHALL BE AT LEAST $600,000.00.

c. Automobile Liability Insurance. Automobile liability insurance is required on the comprehensive form policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage.

Prior to commencement of work under an applicable delivery order, the Contractor shall furnish a Certificate of Insurance to the Contracting Officer for approval. The Certificate of Insurance shall be for a minimum 12 month duration. A new Certificate of Insurance shall be furnished 10 calendar days prior to expiration date of prior certificate. If no approved certificate is received prior to the expiration period, all work will be stopped pending receipt of an approved certificate.

The Certificate of Insurance shall contain an endorsement to the effect that any cancellation or material change adversely affecting the Government's interest shall not be effective: (1) for such period as the laws of the State in which this contract is to be performed prescribe or (2) until 30 calendar days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
