About this file

This document provides an amendment to a solicitation for the fabrication and delivery of an upstream auxiliary miter gate at New Cumberland Locks and Dam.

The amendment revises technical specifications, adds new contract line items for spare diagonal end assemblies and awardable options, modifies language regarding time of delivery and option items, and updates special contract requirements. The base contract and first awardable option may be awarded together if sufficient funds are available, or the base contract could initially be awarded with the option executed later. The contractor must fabricate one miter gate leaf and deliver all items by barge to Pittsburgh by a specified date. Reimbursement for actual bond premium costs and temporary storage options are also included.

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

REQUIRED DELIVERY SCHEDULE

It is Government's intent to award the Base Contract and Option A together provided there are sufficient funds to perform this action. If sufficient funds are not available at contract award, only the Base Contract will be awarded at that time with Option A potentially being awarded at a later time according to the terms of the contract. The period of performance and delivery of the miter gates with associated items shall be as follows:

a. Base Contract with Option A executed at contract award. The contract period of performance shall be 24 months (730 days) from the Base Contract Notice to Proceed.

b. Base Contract awarded with Option A executed within six months (180 days) of contract award. The contract period of performance shall be 24 months (730 days) from Base Contract Notice to Proceed. No additional time will be added to the contract period of performance.

c. Base Contract awarded with Option A executed after six months (180 days) of contract award until the expiration of Option A listed in Paragraph H-4. The contract period of performance shall be 30 months (900 days) from the Base Contract Notice to Proceed.

Note: Awardable Option B and Awardable Option C may be exercised separately as necessary in the event the Government requires storage of the Upper Left Miter Gate Leaf and/or the Upper Right Miter Gate Leaf and their Associated Items for the Miter Gate. If exercised, Awardable Option B and Awardable Option C will be excercised no later than 30 calendar days prior to the completion date for the Base Contract or Awardable Option A, whichever is later.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days After Date Item No. Quantity of Contract

(a) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
