e. KEY CONTROL:

(1) Keys will be provided to the Contractor for access to facilities, rooms and other areas necessary to perform work under this contract. Access to restricted areas shall be requested and provided through the COR. At no time are keys provided to the Contractor in performance of work under this contract to be removed from Fort Hood. Contractor employees shall retain keys in their possession only while physically performing work required by the task order. All keys not issued to a shift shall be secured in a locked key box provided by the Contractor. Only the

Contractor's Project Manager and supervisors are permitted to have possession of master keys.

(approved) submittal form will become part of the official contract file.

g. CONTRACT PROGRESS PAYMENT REQUESTS:

(1) In accordance with DFARS 252.232-7003, the Contracting Officer hereby determines that the use of electronic submission of construction progress payments in

Wide Area Workflow (WAWF) is in conflict with FAR guidance for submission and approval of construction invoices; and, further, WAWF does not contain an appropriate template for construction invoices; and, manipulating the available template is unduly burdensome and inappropriate for the Government and the Contractor. A copy of this section of the clause must appear on every invoice. The following procedures shall be followed in the submission of non-electronic payment requests specified below.

(2) Invoices shall be submitted on Fort Hood Form 355 (form to be provided by the

Officer for certification. All invoices shall have attached all certified payroll records for the period being billed, and a Subcontractor Payment Register (See FAR Clause 52.232-5). All final invoices shall be marked "FINAL QUANTITIES RECEIVED AND ACCEPTED". Invoices that do not meet all of the above criteria will be rejected.

(3) For projects negotiated with a 30-day or shorter performance period, no progress payments will be authorized. The Contractor shall be entitled to bill the Government for such projects only after completing a final inspection (and clearing any punch list generated), completion of any applicable O&M classes (to be coordinated with the COR), submission of final paperwork (i.e., as built drawings, DD 1354), and after confirming all certified payroll records have been submitted to the Government). The final invoice shall be submitted directly to the Contracting Officer and be accompanied by the Contractor's final release from liability statement.

(4) For projects negotiated with a longer performance period, progress payments are authorized one time each month, up to 80% of the project cost, but only after approval of a construction progress schedule, and only in the amounts verified on subsequently approved progress reports. Progress payment invoices will not be processed in the same week as the progress report is submitted. No progress payments are authorized above the 80% mark. See paragraph "b" above for eligibility to process the final invoice.

h. APPLICATION OF WAGE RATES AND FRINGE BENEFITS:

(1) For the application of the wage rates and fringe benefits contained in the Decisions of the

Secretary of Labor, attached to and a part of this contract, all work required within five feet outside the residential building lines shall be considered residential construction. Work involving construction, alteration or repair (also renovation and modernization) of barracks, hospitals, fire stations, office buildings, administration and service buildings, training facilities, motor pools, warehouses, and recreational buildings and facilities, as well as all work required within five feet outside the building lines, shall be considered building construction.

(2) Highway construction rates apply to the construction, alteration or repair of sidewalks, roads, streets, highways, runways, taxiways, alleys, trails, paths, parking areas and other similar, non-building projects.

i. DOCUMENTATION TO SUPPORT SUBCONTRACT AWARDS:

1413 (Statement and Acknowledgment) to the Contracting Officer. Each subcontract shall contain, as a minimum, the Contract Number, Task Order Number, and Title. The subcontract must clearly identify what the subcontractor will be performing in relation to other trades on the job. All subcontracts shall contain the anticipated period of performance that correlates with the approved Progress Schedule for that Division of work. A sample format shall be submitted for

Contracting Officer approval prior to commencement of work under this contract.

(2) FAR Clause 52.222-11, entitled "Subcontracts (Labor Standards)", requires that the clauses listed therein be physically inserted in all subcontracts. However, if the Contractor subcontracts by means of purchase orders or other informal types of contractual situations, compliance will be considered provided if clauses are attached to the subcontract form. Written acknowledgement by the subcontractor of these Labor Standards is required. Incorporation by reference does not constitute compliance.

j. DEVIATION FROM PROPOSED LIST OF SUBCONTRACTORS:

(1) Each task order proposal shall contain a list of proposed subcontractors (see Clause

52.000-4017, Task Order Execution (Apr 08). The Government reserves the right to request replacement of any subcontractor that has demonstrated less than professional behavior, has been found to be in violation of any other condition of performance stipulated elsewhere in this contract, or if the Contracting Officer has knowledge or complaints regarding non-payment to its personnel, suppliers or providers. The Contractor SHALL NOT employ illegal aliens in the performance of this contract. Any subcontractor found to be providing labor through illegal means shall be removed from the installation without exception.

(2) In instances where subcontractors are removed or replaced, the Contractor shall notify the

Contracting Officer, in writing, of substitutions within 24 hours of the action taking place.
