52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
II. Addendum to FAR Clause 52.212-2 Evaluation – Commercial Items
Evaluation Factors for Award
1. Basis for Contract Award. This is a Lowest Price Technically Acceptable source selection conducted in accordance with Federal Acquisition Regulation (FAR) FAR 8.405-1 Ordering procedures for supplies, and services not requiring a statement of work, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single contractor who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose offer is technically acceptable, conforms to the solicitation requirements, and whose quote, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the lowest price technically acceptable.
2. Award for All of the Work. The Government intends to award one contract as a result of this solicitation. As set forth in FAR 52.212-1 (g), the Government intends to evaluate quotes and award a contract without discussions with contractors. Therefore, the contractor’s initial quote should contain the contractor's best terms from a price and technical standpoint. The Government reserves the right to clarify quote if the Contracting Officer later determines them to be necessary.
3. Evaluation Criteria. Meets or Exceeds. Contractor’s quote shall be evaluated in accordance with criteria below.
Contractor shall meet or equal salient characteristics listed in solicitation. Quotes will be evaluated in accordance with the evaluation criteria listed below. The quote will be evaluated under three (3) evaluation factors: Technical, Past Performance, and Price.
Factor 1 – Technical. The product will receive a rating defined below.
Table 1. Technical Factor Acceptable/Unacceptable Ratings Rating Description Acceptable Quote clearly meets the requirements stated in the evaluation criteria Unacceptable Quote does not clearly meet the requirements stated in the evaluation criteria.
Factor 2- Past Performance. The Past Performance Factor will receive one of the ratings defined below.
Table 2. Past Performance Acceptable/Unacceptable Ratings Rating Description Acceptable Based on the offerors performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror performance record is unknown.
Unacceptable Based on the offerors performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable. Past Performance must be both recent and relevant. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the date of issuance of this solicitation. To be relevant, the effort must be similar in nature of work, size, and complexity. Offerors must submit Relevant Experience and Past Performance on the attached sheets (See instructions for submittal).
Factor 3 – Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 8.405-1. Through these techniques the Government will determine whether prices are reasonable.
4. A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful contractor within the time for acceptance specified in the solicitation shall result in a binding contract without further action by either party.
