STATEMENT OF WORK

STATEMENT OF WORK

This specification describes the requirements of the inspection and as needed maintenance, repair, and re-charging of portable fire extinguishers owned by the United Stated Military Academy at West Point. The Contractor shall furnish, and deliver as required, services for the inspection and maintenance of various types of portable fire extinguishers located in various United States Military Academy at West Point buildings, facilities. The estimated quantities of the various types and sizes of fire extinguishers is the best available and most accurate information that may be provided to contractor (see Appendix 1). If during the servicing of locations it is determined that other fire extinguishers exist, the contractor should service the extinguisher as required. The West Point Fire Department also reserves the right to add or delete fire extinguishers.

SERVICE STANDARD

The Contractor shall provide inspection, maintenance, repair and recharging of all portable fire extinguishers in accordance with the most recent addition of the National Fire Protection Association’s Standard for Portable Fire Extinguishers (NFPA 10). It shall also comply with Occupational Safety and Health Standard 1910.157 entitled Portable Fire Extinguishers.

QUALIFICATION/CERTIFICATION

The Contractor shall assign a trained, licensed technician(s) to provide this service, trained in providing portable fire extinguisher inspection, maintenance, servicing, testing and recharging.

This technician(s) shall have the appropriate servicing manuals, proper tools, recharge materials, lubricants, expellants and manufacturers recommended replacement parts specially listed for use in the extinguisher. Proof of trained and/or licensed technician must be submitted.

REPLACEMENT WHILE SERVICING

Fire extinguishers removed from service for maintenance or recharging shall be replaced by a “LOANER” fire extinguisher suitable for the type of hazard being protected and shall be of at least equal rating. If an extinguisher is replaced with a “LOANER” the original must be brought back and placed into service no later than five (5) calendar days from the removal date as indicated on the written report. The contractor shall provide a means of tracking the “LOANER” extinguishers. If service or repairs are anticipated to take longer than five (5) calendar days, the contractor shall notify the contracting officer’s designated representative in writing with the reason for the delay and an estimated completion date.

OBSOLETE/CONDEMNED FIRE EXTINGUISHERS

The Contractor shall be responsible for disposal of all condemned/obsolete fire extinguishers in accordance with local, state and federal laws. Condemned or obsolete fire extinguisher information shall be annotated on the required report provided to the contract manager.

WARRANTY

Services and supplies furnished under this contract shall be covered by the most favorable commercial warranties the contractor gives to any customer for such services and supplies. If a commercial warranty is applicable to services and supplies being furnished under this contract, one copy of the warranty will accompany the services and supplies at the time of delivery. Said warranty shall be in addition to the rights inferred on the Government by this contract and to the extent said commercial warranty restricts or conflicts with any clauses, terms, conditions of this contract, the contract shall take precedence over the commercial warranty.

TAGS or LABELS All weather tags or labels intended for recording inspections, maintenance, or recharging shall be utilized and placed on the front of the fire extinguishers.

SCHEDULING

ANNUAL INSPECTION PROCEDURES

In conjunction with NFPA 10 requirements a yearly inspection of all fire extinguishers shall include a check of at least the following items:

1. Location in designated place

2. No obstruction to access or visibility

3. Pressure gauge reading or indicator in the operable range or position

4. Fullness determined by weighing or hefting for self-expelling-type extinguishers, cartridge-operated extinguishers, and pump tanks

5. Condition of tires, wheels, carriage, hose, and nozzle for wheeled extinguishers

6. Indicator for non rechargeable extinguishers using push-to-test pressure indicators

7. Verifying that operating instructions on nameplates are legible and face outward

8. Checking for broken or missing safety seals and tamper indicators

9. Examination for obvious physical damage, corrosion, leakage, or clogged nozzle

FIVE YEAR MAINTENANCE

The required five (5) year maintenance of extinguishers shall be conducted in accordance with National Fire Protection Association’s Standard for Portable Fire Extinguishers (NFPA 10).

When applicable maintenance procedures are performed during periodic recharging or hydrostatic testing, the 5-year requirement shall begin from that date.

HYDROSTATIC TESTING

The hydrostatic testing of extinguishers shall be conducted in accordance with National Fire Protection Association Standard for Portable Fire Extinguishers (NFPA 10). Extinguishers shall be refilled to operating conditions upon completion of the test.

CORRECTIVE ACTION

When an inspection of any fire extinguisher reveals a deficiency in any of the conditions listed in the NFPA Standard immediate corrective action shall be recommended to the West Point Fire Department via provided written report.

RECORD KEEPING/WRITTEN REPORT

A report of the inspection, testing, and maintenance performed for each fire extinguisher, including replacement parts utilized, shall be submitted to the contract office representative after each day of work.

INVOICING

The Contractor shall submit an informational invoice to the contract office representative. The Contractor shall include the contract number, item number and services performed in each invoice.

ANNUAL BUILDING/FACILITY INSPECTION SCHEDULE

Each area has a four (4) month time frame for completion. See appendix A for approximate total number of extinguishers.

North Area- January, February, March April Central Area- May June, July, August South Area- September, October, November, December

INSTALLATION/SITE ACCESS

The contractor must submit the following items in order to obtain appropriate credentials to access the installation and buildings, facilities.

d. Employee’s social security number, for those without a SSN, a working visa or resident alien number must be provided.

The Contract Office Representative will make appropriate appointment in conjunction with Contractor for the identification cards to be issued. If credentials are lost or stolen then a signed letter requesting replacement from the Contractor must be submitted to Contract Office Representative.

CRUDENTIALS DISPLAY

All identification badges shall be prominently worn/displayed in available manner. Safety related exceptions to this requirement shall be addressed with the Contract monitor.

CONTRACT COMPLETION, RETURN OF CRUDENTIALS

The Contractor shall return all credentials no later than five (5) working days after contract completion to the Contract Monitor. All credentials shall be turned in collectively by the Contractor, not incrementally/individually by the contractor employees. Failure to return credentials IAW Contract Completion shall result in withholding $25 for each unreturned badge.

POST AWARD MEETING

Upon award, on a mutually agreeable date, the Contractor shall meet with Contracting and Contract Office Representative to review and approve inspection scheduling. At this meeting, the Contractor shall be prepared to provide a tentative date to accomplish the specified work.

The meeting shall take place at West Point FD Headquarters, 664 Eichelberger Road, West Point, NY 10996

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL

CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)

(a) Definition. As used in this provision--

Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203- 19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.

(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR

STATEMENTS (JAN 2017)

(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.

(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.

(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. L. 113-235), and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions) use of funds appropriated (or otherwise made available) is prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

(f) The Contractor shall include the substance of this clause, including this paragraph (f), in subcontracts under such contracts.

52.204-22 ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017)

(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror's practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively advantageous to the Government and the Offeror.

(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

Technical and past performance, when combined, are . (Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (NOV 2017)

ALTERNATE I (OCT 2014)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
