If your company is not already actively registered, please register in the SAM database at https://sam.gov. If your company is currently registered and close to expiring, begin/complete the process for SAM registration renewal.
a. A Unique Entity ID is required for SAM registration. If your company does not have a Unique Entity ID, obtain one by calling 800-333-0505.
b. Whether your company is a current or new registrant in the SAM database, your registration must indicate that you are a provider of NAICS 532420 or a NAICS of similar business size, under the Goods – Services section of the registration to be eligible to receive a contract for this solicitation.
c. If the prospective awardee for this solicitation is not actively registered in the SAM database by close of solicitation, including NAICS 532420 or a NAICS of similar business size, under the Goods – Services section, depending on mission requirements, the Government reserves the right to proceed to award to the next otherwise successful, registered offeror.
8. REPRESENTATIONS AND CERTIFICATIONS REQUIREMENT. Prospective contractors must also complete electronic annual representations and certifications (FAR 52.212-3 Alternate I Offeror Representations and Certifications – Commercial Products and Commercial Services (Deviation 2023-O0002)) to include the DFARS Representations and Certifications at https://sam.gov in conjunction with required registration in the System for Award Management, https://sam.gov, database by the solicitation closing date to be eligible to receive an award for this solicitation.
9. EVALUATION OF QUOTATIONS. This section supplements clause 52.212-1, which is included elsewhere in this solicitation. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The Government intends to evaluate quotations and award a contract without discussions with Offerors. Therefore, the offeror’s initial quotation should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotations if such action is in the public interest; accept other than the lowest priced quotations; and waive informalities and minor irregularities in quotations received.
a. Quotations will be evaluated, and award shall be made based on the lowest price that meets the purchase description. Technical acceptability shall be based on meeting all the minimum requirements of the Technical Criteria in the Purchase Description section and the terms and conditions of the solicitation and resultant contract.
b. Price will be evaluated to determine if the Offeror’s quoted price is fair and reasonable. Price shall be evaluated at estimated quantities multiplied times their respective unit prices found in the RFQ not to exceed two (2) decimal points. The Government may determine that a quotation is unacceptable if prices are significantly under or over market pricing.
c. In the case of discrepancy between a unit price and an extended price listed in the Item number, the unit price will be presumed to be correct, subject, however, to correction to the same extent and in the same manner as any other mistake.
d. In response to this RFQ, quoters shall submit supporting documentation explicitly showing how the technical criteria and contract terms and conditions will be met. Supporting documentation can be documents such as capability statements, teaming arrangements, brochures, pamphlets, screenshots, etc. of the proposed item that specifically lists the technical criteria and can be compared to the technical criteria in the solicitation.
10. ALTERNATIVE DISPUTES RESOLUTION. In furtherance of Federal policy and the Administrative Dispute Resolution Act of 1990 (ADR Act), Public Law 101-552 and FAR Clause 52.233-1(g), the Contracting Officer will try to resolve all post award acquisition issues in controversy by mutual agreement of both parties. Interested parties are encouraged to use alternative dispute resolution procedures to the maximum.
