Justification Review Document For Sole Source - FAR Part 13.501*

(*Format follows FAR 6.303-2, but modified to reflect FAR subpart 13.5 procedures)

Program/Equipment: Billeting and Feeding Services provided by the USS Hornet.

Authority: 10 U.S.C. 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(b)(1)(i) unique supplies or services available from only one source or only one supplier with unique capabilities. The USS Hornet provides the unique opportunity to replicates a real-world Port Supply Activity simulating vessel berthing.

10. Other Facts:

a. Procurement History: The USS Hornet was secured in fiscal year 2022 through an offload to the Department of Justice / Federal Prison Industries-Fleet Business Group.

11. Impact if justification is not approved:

a. Dissolved training opportunity: The requirement contains two basic services that may be contracted to other establishments but will dissolve the intent of providing a realistic training environment.

b. Cancelation of event: The organizations’ budget would not be able to support an alternative acquisition strategy. The training event would have to be cancelled and the expected training audience would experience a reduced readiness rating.

13. Fair and Reasonable Cost Determination: The basic service of providing lodging and catering on the local economy would increase cost to the government. The current Per Diem Rate, per soldier, for Oakland, CA is in lodging and in meals.

These services provided by the USS Hornet has a cost that is less than the combine Per Diem Rate.

14. Contracting Officer Certification:

I certify that this justification is accurate and complete to the best of my knowledge and belief.

Approval

Based on the foregoing justification, I hereby approve the procurement of (state equipment/services being procured and total dollar value) on an other than full and open competition basis pursuant to the authority of 41 U.S.C. 1901 as implemented by FAR 13.501, subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
