FAR 8.405-6 Limited Sources Justification Under the General Services Administration

Federal Supply Schedule Program

1. Contracting Activity: U.S. Army Mission and Installation Contracting Command (MICC-Ft. McCoy), 1108 South R Street, Ft. McCoy, WI 54656.

2. Description of Action: The Directorate of Plans, Training, Mobilization, and Security (DPTMS) requests a Basic Purchase Agreement (BPA) for live fire target system parts for the existing live fire target system at Ft. McCoy, WI. The new action will be a BPA utilizing an existing Federal Supply Schedule (FSS), under the General Services Administration (GSA) FSS Program, , Inc., formerly known as

Projected award is August 2021 and fiscal year 2021, Annual Operations and Maintenance Army Reserve (OMAR) funds will fund the acquisition, for the initial call. Additional calls placed against the resultant BPA will be funded with appropriate fiscal year funds. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: This acquisition is for the procurement of live fire target system parts from InVeris Training Solutions, Inc for the live fire target system at Fort McCoy, WI. This action will be a Firm-Fixed Price, Blanket Purchase Agreement (BPA) for 4.75 years, with an option to extend up to 6 months.

Estimated Total Value:

4. Authority Cited: Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et. Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by FAR 8.405-6 and substantiated by FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

5. Reason for Authority Cited:

a. This acquisition is for the procurement of live fire target system repair parts for the existing target system at Fort McCoy, WI that was originally supplied b

Market research has shown has no authorized retailers and is the only company that can supply compatible parts as this is a proprietary system to their company. provided a current letter of sole source, dated 30 March 2021. In this letter, stated that all of their components for their equipment have been fabricated for, and rigorously tested with and for the specific equipment in use on Fort McCoy. Additionally, has stated that using other manufacturer’s parts would invalidate any existing warranties. Therefore, failure to purchase parts for the current live fire target systems will result in inoperability of the live fire ranges. Should the live fire ranges become inoperable, numerous tenant and transient training Soldiers and Units on Fort McCoy will be unable to conduct required marksmanship training and qualification requirements.

In addition to the negative impact on soldiers/units’ training and readiness because of inoperable target systems on the live fire ranges, failure to purchase target parts to maintain the current live fire target systems would result in: 1) Duplication of costs already invested in the existing operational target systems to purchase completely new target systems for Fort McCoy; and 2) as components of the target systems wear out or break, these systems will become inoperable and unavailable for live fire training since other manufacturers’ brand parts are not compatible with the existing brand systems.

b. Alternatives. The procurement of different live fire target systems would result in a duplication of costs to the government; essentially replacing the presently functioning target systems with a new system. In performing market research, there are other companies that can provide new live fire target systems, but the Government would nevertheless encounter the same situation with a new target system; the repair parts are proprietary and would need to be procured from the same company as the target system. Fort McCoy has invested over in acquiring stationary and mobile infantry and armor live fire targets. To replace the existing target system with a new system today is now estimated at approximately . Because of the nature of live fire, maintenance of the targets averaged approximately annually over the past 5 year period. Introducing a new system would not be practical or cost effective. It is in the best interest of the Government to maintain the current system and prevent any disruption to training. If we are not able to repair the target systems, this will result in delays for Soldier and Unit training/readiness. Soldiers and Units would not be able to obtain their required marksmanship and qualification requirements when the existing target systems become inoperable due to lack of repair capabilities.

c. Impact if this limited source request is not approved. The majority of the components within targets are made specifically for or by InVeris. All of the CPU cards communicate with proprietary communication software. Although the Government’s TRACR range operating system is designed to communicate with the Future Army System of Integrated Targets, the targets communicate through a software translator. These computer boards, microchips, mounting brackets, linkages, power supplies, radios, wiring harnesses and connections are all specific to During dismounted training exercises, back pack wireless controllers are utilized to run scenarios and as well as troubleshooting targets on site.

These controllers and their components are also specific to proprietary communication. All of this software is patented and licensed by the company.

The Government is not able to repair the targets as components wear out, weather related damages occur (lightning strikes/flooding/rodent damage) and targets break.

This will lead to a reduction in valuable training time for all scheduled units, ultimately leading to complete mission failure on all automated live fire ranges. DPTMS would not be in compliance with Training Circular (TC) 25-8 standards for training ranges nor be able to support weapons qualification IAW TC 3-20.40, TC 3-22.240, TC 3-22.249, TC 3-22.50 and gunnery exercises. Fully operational live fire ranges are essential to the success of DPTMS and Fort McCoy as a whole.

6. Actions to Increase Competition: As stated previously, market research revealed that InVeris is the only source capable of supplying compatible parts for the existing proprietary live fire training systems. Under the previous justification, approved 29 January 2016, the planned actions to increase competition was to ensure that prior to BPA calls, the Government searched for sources capable of supplying compatible repair parts. The Government completed these actions by seeking new technology advancements and conducting market research prior to calls. A sources sought notice was posted to beta.SAM.Gov on 18 December 2020 with responses due 30 December 2020 by 3:00 PM CST. No responses were received. Market research will be conducted throughout the life of the BPA and prior to the BPA calls to determine if there are any other suppliers that can meet the contract requirements.

7. Market Research: As stated previously, a sources sought synopsis identified no viable alternatives. In addition, market research of mandatory sources resulted in no further identification of any other capable vendors. There is an optional use GSA Federal Supply Schedule (FSS), .

that will be used for this BPA. Due to the proprietary nature of the required parts, there are no subcontracting opportunities.

Currently, Fort McCoy places BPA calls under BPA , awarded to Me now formally known as , to acquire parts for the live fire target systems. This BPA is set to expire on 31 July 2021. now formally known as current GSA contract option expires 30 April 2026. Due to being the only source that can provide the compatible parts for

Fort McCoy's existing live fire target systems, this procurement will be awarded as a sole source BPA against the existing GSA FSS,
