QUESTIONS & ANSWERS
Q1: If there are service locations outside of the 150 mile requirement, could the items be shipped from base to nearest service location?
A1: No, In accordance with PWS paragraph 5.3.2. “The Contractor shall provide pickup and delivery service. This service shall include loading, unloading, segregating, transporting, counting and obtaining necessary documentation for items picked up or delivered. The Contractor shall provide their own vehicles and they shall be maintained in a safe operating condition at all times.”
Q2: Who is responsible for testing (Army or Vendor) for potential hazardous material on the clothing? If Vendor is required to identify hard metals in the garments, do you have a standard testing procedure for potential hazardous material? (or recommendation for testing procedures?)
A2: The Contractor is responsible for testing. The Government does not have a standard testing procedure.
A survey has been conducted by the U.S. Public Health Command at various 88th RD shop locations and results have determined that heavy metals are present and exceeded the Brookhaven National Laboratory’s (BNL’s) recommended guidelines for lead and cadmium. (PWS 1.1) In accordance with PWS paragraph 5.6. “Regulatory Compliance. The Contractor shall comply with all Federal, State and local environmental protection rules, regulations, and laws governing the handling, cleaning or disposal of used protective clothing.”
Q3: With firm fixed price, can vendors add an upcharge when hazardous materials are found in the garments and using PPE to handle and clean?
A3: No, According to FAR 16.202-1 A firm-fixed-price contract provides for a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.
Q4: As repairs and hazardous material cleaning may take longer then stated turnaround time, can replacement garments be provided while garments are repaired or decontaminated?
A4: In accordance with PWS paragraph 5.3.2., “The Contractor shall ensure that there are adequate numbers and sizes of protective clothing available at each shop location for employee use between deliveries.”
Q5: Would there be option years after the 12 month period of performance?
A5: There are no option years included with this contract.
Q6: Will the Army provide list of questions and answers; from all vendors - to all vendors who asked?
A6: Yes, with a solicitation amendment posted on www.beta.sam.gov.
