For bidding purposes, Contractor is to provide unit pricing and extended totals for each item on the Bid Schedule (TE-2) for each year. Contractor is to insert each period’s grand total (sum of extended total of all items) in the spaces provided in Section B (base period grand total provided at CLIN 0001, first option period grand total provided at CLIN 1001, second option period grand total provided at CLIN 2001, and so on up to CLIN 4001). To be considered responsive, the bidder must provide the completed bid schedule for the base and all option years with their bid and transfer the grand total for each period to Section B. Unit prices shall not exceed two decimal places.

The bid schedule (TE-2) will be incorporated into the resultant contract.

The Government reserves the right to order the maximum quantities. The line item quantities listed in the Bid Schedule are for variable items which are to be purchased by the Government only after the specific need for the item has been identified. Once the basic contract is awarded a pre-construction conference will be scheduled. All of the items available for award (all the items in the Bid Schedule under the main contract) will be reviewed by the government and contractor and the specific line items needed to complete the first job will be inserted on a bid schedule. The government will prepare a separate bid schedule for each job and the total for all jobs ordered under that task order will be the price inserted in CLIN 0001, or the respective CLIN for the current option year, of the task order. The separate bid schedules will be included as part of the task order as back up documentation.

Bids shall be evaluated using the estimated quantities set forth in the Bid Schedule (TE-2) for each year. Since the government does not know when or if a building or money will become available, the same quantities are repeated in each year and listed in the base and each option year.

Contractors are referred to EPA’s list of EPA-designated products available at http://www.epa.gov providing products that contain recovered materials.

In accordance with FAR 52.232-34(b) and 52.204-99 a contractor shall be registered in the SAM database prior to submitting an invoice and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

RAPID GATE

RAPIDGate Program:

The RAPIDGate Program enables electronic verification of identity and access privileges at Fort McCoy’s access control points (ACPs), thereby improving security and streamlining access to the installation.

Access Privilege Management

Companies choosing to participate in the RAPIDGate Program will have streamlined access onto the installation. Participants will have access through all gates that size permits (Main Gate, Gate 5, Gate 15 and Gate 20) and will only be subject to RANDOM vehicle inspections. At the Main Gate RAPIDGate participants will be able to utilize either lane, enabling fast access onto the installation through that gate.

Companies choosing not to participate in the RAPIDGate Program will be required to access the installation through the Main Gate, utilizing the commercial lane only. To enter the installation a pass is required for each person. Currently the maximum pass period is 30 days. Effective December 1, 2010, maximum day pass will be reduced to 14 days and on April 1, 2011 only a one day pass will be issued. To obtain a pass, you will be required to go to Vehicle Registration at the Welcome Center, show identification (i.e. driver’s license), vehicle registration, proof of insurance, contract award letter and/or bill of lading to obtain a pass to the installation. NO PASSES WILL BE ISSUED AT THE GATE. Vehicle Registration hours are Monday – Friday 7:30a.m. – 4:00p.m. Significant delays may result from choosing to access the installation by obtaining a one day pass. In which The Government will not be held responsible for any access delays. Contractor may not at any time request consideration as a result of choosing to access the installation using the day pass process.

Enrollment/Registration

Companies that service Fort McCoy may enroll in the RAPIDGate Program by calling 1-877-RAPIDGate (1-877-727-4342). The Program will confirm with the installation that the company has legitimate business on the installation. Once the company has enrolled, its employees can register at the self-service Registration Station located at the Fort McCoy Welcome Center.

The RAPIDGate Program confirms the individual’s employment status with the company, and then performs identity authentication and background screening. Employees who qualify are issued a personalized RAPIDGate ID Badge. The Program performs background screening on a regular basis to verify continued eligibility in the Program.

Questions about the Fort McCoy RAPIDGate Program should be addressed to info@rapidgate.com with the subject line RE: RAPIDGate Program, or to the Physical Security Branch, Directorate of Emergency Services at 608-388-4694.

Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below. BONA FIDE NEED

Defense Finance and Accounting Service Regulation (DFAS-IN Reg 37-1) requires that work under contracts awarded (includes Delivery Orders if applicable) near the end of the fiscal year by appropriations cited herein commence by 1 January of the following calendar year. Commencement can be physical on-site work or documentary evidence that costs have been incurred or materials have been ordered. It is anticipated that the notice to proceed or delivery order will be issued in sufficient time to comply with this regulation. However, the Contractor shall not commence work until after the date he receives the notice to proceed or delivery order. Note: Bonds and mobilization costs do not meet the intent of this requirement.

ORDERING PROCEDURES

a. As the need exists for performance under the terms of this contract, the Contracting Officer or his/her authorized representative will notify the contractor, in writing, requesting the contractor attend a “Joint Scoping Meeting”. The written request will detail the specific date, time, and location of the meeting plus a brief explanation of the work being scoped.

b. Within two working days of receipt of this notification, the contractor shall respond to the Contracting Officer, or his/her authorized representative, with a verbal or written confirmation. If scheduling conflicts occur, they can be resolved at this time.

c. The Joint Scoping Meeting will be performed on the work site(s) between the contractor, the Contracting Officer or his/her authorized representative (Contracting Officer’s Representative). At this meeting the following will occur:

(1) The project will be broken down into the appropriate tasks necessary to complete the entire project. The items from the bid schedule for that particular year will be used for this purpose.

(2) Measurements of the project area will be taken to determine the quantity of each task required.

(3) The agreed upon items and quantities will be multiplied times their respective unit prices found in the bid schedule (TE-2). When all quantities are extended and totaled, the sum will be the quantity amount on the CLIN for the Task Order. These items will be determined prior to work commencing and the government and Contractor will jointly scope the project to determine which of these items will be needed for that particular job, and will also agree on the measured quantity for each item.

(5) Absent exceptional circumstances, the parties will be bound to the job price determined at the Joint Scoping Meeting. These are the items from the bid schedule which will be reflected on the CLIN of the Task Order.

(6) Project performance time will be agreed upon as one of the last items of the on-site Joint Scoping Meeting. This will be done by applying the procedures found in the specifications.

d. Task Order (s) will then be issued using a DD Form 1155. Each Task Order will include the following information:

(1) Date of Task Order.

(2) Contract number and Task Order number.

(3) Scope of Work (to include a brief description under the CLIN and performance period).

(4) Accounting and Appropriation Data:

(5) Notification of the requirement that work must commence or costs must be incurred before 1 January, in accordance with DFAS-IN Regulation 37-1 (if applicable).

(6) Any other pertinent data.

e. The contractor should realize that circumstances may prohibit the Government from issuing the Task Order after the Joint Scoping has occurred. If such circumstances arise, the Government is not obligated to reimburse the contractor for any costs incurred in attending a Joint Scooping Meeting.

f. The Government may take 60 days to issue a Task Order after a Joint Scoping has occurred. Orders to be issued more than 60 days after scoping will require re-affirmation by the contractor prior to issuance. If a project(s) is negotiated in a period of performance and is not issued until after that period of performance expires; the project(s) will require another Joint Scoping Meeting or price adjustment based on current period of performance prices.

The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.

Union Identifiers

An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.

Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rate.

Non-Union Identifiers

Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.

Survey wage rates will remain in effect and will not change until a new survey is conducted.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

END OF GENERAL DECISION

CONTRACTOR PERFORMANCE INFO

1. Purpose. IAW with FAR Subpart 42.1500 contractor past performance information (PPI) is relevant information for future source selection purposes regarding a contractor’s actions under previously awarded contracts. It includes, for example, the contractor's record of conforming to contract requirements and to standards of good workmanship; the contractor's record of forecasting and controlling costs; the contractor's adherence to contract schedules, including the administrative aspects of performance; the contractor's history of reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the contractor's business-like concern for the interest of the customer. Contractor past performance information is one of the tools that support Army efforts to acquire best value and is used to evaluate performance risk in source selection. The feedback provided by the government to the contractor in collecting PPI, and the knowledge that PPI will be used in future source selection decisions, should result in improved performance and a greater contractor focus on customer satisfaction.

2. Assessment Period. Performance Assessment Reports (PAR) shall be prepared IAW AFARS Subpart 42 upon physical completion of the contract. If the period of performance will exceed 18 months, an “interim” assessment report shall be prepared at the completion of 12 months performance and annually thereafter until the contract is physically complete. An out-of-cycle or “addendum” report may be prepared if there is a need to record an extraordinary event prior to the next regularly scheduled evaluation or if it is necessary to report a meaningful occurrence during the period between physical completion of the contract and contract closeout. Additionally, addendum reports may be prepared to record contractor’s performance relative to contract closeout and other administrative requirements (e.g. final indirect cost proposals, technical data, etc.).

3. Completion Due Date. The government will complete the PAR within 60 days after the end of the assessment rating period.

4. Evaluators. The Contracting Officer and the Contracting Officer’s Representative will jointly complete the performance assessment.

5. Contracts Performance Elements. The contractor’s performance shall be assessed in accordance with elements and rating system set forth in AFARS Subpart 42.

6. Contractor Review. The Contracting Officer will furnish a copy of the PAR to the contractor requesting that the contractor submit comments, rebutting statements, or additional information to the Contracting Officer within 30 calendar days of receipt. Failure to respond within the designated timeframe will be taken as agreement with the assessment.

7. Contract Concurrence. Where a contractor concurs with, or takes no exception to a PAR, such report shall be considered final and releasable for use in source selection and other deliberative purposes.

8. Contractor Rebuttal. Where a contractor takes exception to a performance report, the Contracting Officer will review the contractor’s rebuttal or comments and make appropriate changes. If the Contracting Officer makes changes, the changed rating will be reflected in the narrative. The Contracting Officer will make all reasonable efforts to reconcile the report and the contractor’s comments. However, it is not necessary that they reach agreement on the report where such is clearly impracticable. The contractor’s rebuttal or comments shall be made part of the PAR.

9. Resolving Disagreements between the Government and the Contractor. In the event disagreements between the parties regarding the PAR occur, the Contracting Officer will review the rebuttal and make appropriate changes. If no agreement is reached, the PAR is forwarded to the Reviewing Official (Director of Contracting) along with the Contracting Officer’s Findings and Recommendation and supporting documentation. The decision of the Reviewing Official is final. Copies of the PAR and the contractor’s response and review comments, if any, shall be retained as part of the evaluation.

10. Release of Contractor Performance Evaluation Information. The evaluation will not be released to other than government personnel and the contractor whose performance is evaluated. The performance evaluation information will be input in the Construction Contractor Appraisal System (CCASS) or Past Performance Information Management System (PPIMS) databases (or Government system in use at time of the evaluation), which are consolidated repositories for all Army PPI.

11. Source Selection Information. Departments and agencies will electronically access the PAR information to support future award decisions.

5152.209-4000 LEVEL 1 AT AWARE

(a) Pursuant to Department of Defense Instruction Number 2000.16, “DoD Antiterrorism (AT) Standards,” dated October 2, 2006, each contractor employee requiring access to a Federally-controlled installation, facility and/or Federally-controlled information system(s) shall complete Level I AT Awareness Training on an annual basis and receive a certificate of completion. The training is accessible from any computer and is available at https://atlevel1.dtic.mil/at/. The contractor is responsible for ensuring that all applicable employees have completed antiterrorism awareness training and shall certify that their workforce has completed the training through the submission of completion certificate(s) to the Contracting Officer and the Contracting Officer’s Representative (if appointed) within five working days after contract award or prior to access to a Federally-controlled installation or information system.

(b) In the event that the automated system at https://atlevel1.dtic.mil/at/ is not available (e.g., server problems), Level I AT Awareness Training can be provided by a qualified instructor. However, if the training is not completed online, the Level I AT Awareness Instructor qualification must be coordinated with the Installation Antiterrorism Officer (or Installation Security equivalent) and the resultant name(s) of approved instructors shall be provided the contracting officer or designee along with all associated cost or schedule impacts to the contract.

(c) Antiterrorism performance (Level I AT Awareness Training attendance and compliance) may be documented as a performance metric under the resultant contract, and be part of past performance information in support of future source selections.

FAR 52.204-99 System for Award Management Registration (August 2012) ( DEVIATION)

1. Definitions. As used in this clause –

“Central Contractor Registration (CCR) database” means the retired primary Government repository for Contractor information required for the conduct of business within the Government.

“Commercial and Government Entity (CAGE) code” means –

1. A code assigned by the Defense Logistics Agency (DLA) Logistics Information Service to identify a commercial or Government entity; or

1. A code assigned by a member of the North Atlantic Treaty Organization that DLA records and maintains in the CAGE master file. This type of code is known as an “NCAGE code.”

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

“Data Universal Numbering System+4 (DUNS+4) number” means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-charater suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

“Registered in the SAM database” means that –

1. The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the SAM database;

1. The Contractor’s CAGE code is in the SAM database; and

1. The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record “Active”. The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process.

“System for Award Management (SAM)” means the primary Government repository for prospective federal…
