Bids/proposals that are opened by security personnel due to a Contractor’s failure to comply with mailing instructions will be evaluated based on the information in the packets received by the Contracting Officer. If any required information is not in the bid/proposal packet when received by the Contracting Officer, it will be conclusively presumed that the bidder/offeror failed to include such information with its bid/offer. Allegations that information must have been removed by security personnel will notbe grounds for acceptance of information after the time set for receipt of bids/proposals. Therefore, bidders/offerors are warned to exercise due care and mail all bids/proposals to the address indicated in the solicitation (above).
NOTE: When submitting bids, fill out each year and carry total to Section B of the solicitation.
SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
EVALUATION FACTORS FOR AWARD
M.1. The Government will evaluate bids received in response to this solicitation solely on the basis of price and price related factors.
M.2. PRICE EVALUATION. The price analysis techniques in 15.404-1 (b) may be used as guidelines as per guidance provided in Subpart 14.408-2. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information may be required from the bidder to support the proposed price. The schedule being used at the time of exercising of the option will dictate the price for that option period task list items.
M.2.1. Total Evaluated Price: The total evaluated price will be a single numeric value, not to exceed 2 decimal places, calculated by the Government, which will be the value used to determine the lowest price and apparent winning bid. The steps and formulas utilized to calculate the Total Evaluated Price are as follows:
The Government will review the total prices listed at Section B of the Solicitation to determine the apparent winning bid using the following method:
Total price for CLIN 0001, Base period, plus total price for CLIN 1001, Option One, plus total price for CLIN 2001, Option 2 = Evaluated price to identify the apparent low bidder. (CLIN 0001 + CLIN 1001 + CLIN 2001= total evaluated price.)
Individual task list or schedule item calculations will be verified for accuracy prior to award. The total prices listed in Section B of the solicitation shall match the totals calculated on the task list for the corresponding ordering period (CLIN 0001 Base Period, CLIN 1001 Option 1, CLIN 2001 Option 2)
M.3. RESPONSIVENESS OF BID. For a bid to be determined responsive and considered for award, the bid must comply in all material respects with the invitation for bids. Such compliance enables bidders to stand on an equal footing, and maintain integrity of the sealed bidding system (Subpart 14.301).
In order to be considered responsive the Bidder:
ꞏ Shall be currently registered in SAM, https://www.sam.gov/portal/public/SAM/ ꞏ Shall submit a complete sealed bid package prior to the cutoff for receipt of bids, ꞏ Properly completed and signed bid, with Original Signature
ꞏ Acknowledgement of all Amendments (if any), ꞏ Fully completed Section B and Task List sheet (the schedule). The task list sheet for that ordering period will become the established FIRM FIXED PRICE Task List to be used when pricing task list items for each task order.
ꞏ Shall not qualify the terms and conditions of the solicitation in the submitted bid ꞏ Shall comply with the instructions of the solicitation.
ꞏ A Bid Guarantee is required and shall be provided in the amount of twenty percent (20%) of the overall bid, not to exceed $3,000,000.00.
(Bidders must use the Standard Form (SF) 24 if providing a bid bond as the bid guarantee).
Non-Responsive bids will not be considered for contract award.
RESPONSILBITY DETERMINATION. In Accordance with FAR Part 9.1, Purchases shall be made from, and contracts shall be awarded to, responsible prospective contractors only.
To be determined responsible, a prospective contractor must -- ꞏ Have adequate financial resources to perform the contract, or the ability to obtain them (see 9.104- 3(a));
ꞏ Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
ꞏ Have a satisfactory performance record (see 9.104-3(b) and Subpart 42.15). A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history, except as provided in 9.104-2;
ꞏ Have a satisfactory record of integrity and business ethics (for example, see Subpart 42.15);
ꞏ Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors). (See 9.104-3 (a).)
ꞏ Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a)); and ꞏ Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
No purchase or award shall be made unless the contracting officer makes an affirmative determination of responsibility. In the absence of information clearly indicating that the prospective contractor is responsible,the contracting officer shall make a determination of nonresponsibility.
