4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition is conducted under the authority of United States Code (U.S.C.) 10 U.S.C. 2304(c)(1) or 41 U.S.C.

3304(a)(1).

5. Reason for Authority Cited:

Only Source Validation: Radiometrics is the only company can provide the required services because these are unique systems which were all designed and built by their personnel.

Radiometrics is the Original Equipment Manfacturer for the following systems and have the expertise to maintain the following systems. Radiometrics designed the Microwave Profiler (MP) product line and Raptor Branded Radar wind profiler product line that Dugway required services completed on . The equipment and their systems are proprietary. Radiometrics is the only authorized contractor that is authorized work on the equipment. The contractor does not have any distributors.

Impact if not completed: All West Desert Test Center testing would no longer have the ability to track weather many other test parameters related to atmospheric conditions. The alternative to get equivalent weather and radar support would be to purchase a complete new system of boundary radars, wind profilers and radiometers. This equipment would be approximately $6,000,000 to purchase and thousands of hours would be needed to build up the expertise and support systems required to support the current equipment.

An immediate halt to testing any product that required weather and tracking capability would result in a yearly loss to DPG WDTC of approx $15,000,000 per year.

6. Actions to Increase Competition: A sources sought was posted to FBO on 20 August, 2019.

No interest from industry was the result, which was expected. The government customer will continue with the current system and will begin exploring new system potential for future commercial radar/radiometer and wind profiler system that would be supportable by more than one source.

7. Market Research: A sources sought posted on FBO on 20 August, 2019 yielded no interest from industry.

8. Other Facts: Multiple purchase of upgrade equipment, service opportunities, etc. have been advertised on FBO in the past 15 years and no other company has expressed interest in the requirements.

9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

10. Reviews: I have reviewed this justification and find it adequate to support limiting competition:

Legal counsel certification:

11. Best Value Determination/Fair and Reasonable Cost Determination: I hereby determine that the order represents a fair and reasonable price to the Government. Additionally. The MICC- DPG office will ask for “other than certified” cost/price information to show labor rates, overhead, material costs, etc. are fair and reasonable PER FAR Part 15.

This determination will be made using the following: price analysis and IGCE
