PERFORMANCE WORK STATEMENT

M&R Service Contract for Life Technologies PCR and Flow Cytometry Instrumentation, DRD

Vision Statement Procurement of a Service Contract that assures consistent and calibrated operation of BioTesting Branch (BTB), Edgewood Chemical and Biological Center/Dugway Proving Ground, PCR and Flow Cytometry laboratory instrumentation.

1 Introduction The purpose of this service contract is to establish an agreement for a contractor certified by Life Technologies Inc. (or for Life Technologies Inc., itself) to provide yearly preventative maintenance and as-needed repair services to BTB for its PCR and Flow Cytometry instrumentation. See Exhibit 1 (section 3.1) for a list of covered equipment.

1.1 Mission

To maintain operation of PCR thermal cyclers, robotic sample loaders, and the flow cytometer, commensurate with good laboratory practices (GLP), good manufacturing practices (GMP), good clinical practices (GCP), and ISO 17025 standards.

1.2 Background

The BTB utilizes real-time quantitative PCR and flow cytometry for Test and Evaluation (T&E) sample analysis and quality assurance/quality control (QA/QC) of materials used to test biological defense systems.

1.3 Scope

This service contract covers maintenance and as-needed repair services for each of 12 instruments. Nine of the instruments were previously procured by BTB; three new instruments will be procured while this contract is in effect, and two off-contract instruments will be traded in for credit as part of the procurement. The final number of instruments to be maintained on this contract will therefore number 12 (after the three new instruments manufacturers warrantee has expired). See Exhibit 1, below (section 3.1), for a list of these equipment items.

2 General Requirements The contractor shall provide services required to maintain the Life Technologies PCR and flow cytometry instruments and keep them operational and ready for use at all times to support the BTB mission.

2.1 Non-Personal Services

The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.

2.2 Business Relations

The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification and resolution. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

2.3 Contract Administration and Management

The following subsections specify requirements for contract, management, and personnel administration.

2.3.1 Contract Management

The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations at BioTesting Branch (ECBC Dugway) and the contractor's corporate offices.

2.3.2 Contract Administration

The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.

2.3.3 Personnel Administration

N/A

2.4 Subcontract Management

The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after notification to the Procuring Contracting Officer (PCO) or Contracting Officer Representative (COR). Cross teaming may or may not be permitted.

2.5 Contractor Personnel, Disciplines, and Specialties

The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the contract and employ qualified personnel with appropriate combinations of education, training, and experience.

2.6 Location and Hours of Work

Accomplishment of this PWS requires work at BTB. Normal workdays are Monday through Thursday except US Federal Holidays. Workers typically work ten (10) hours per day, forty (40) hours per week, 0700 to 1730. The technical point of contact and/or Contract Officer Representative are expected to be available during those hours.

2.7 Travel/Temporary Duty (TDY)

N/A

3 Performance Requirements The following section specifies the Performance Objectives and Performance Elements for the contract.

3.1 The Contractor shall provide annual certification, preventative maintenance and repair for all equipment listed in Exhibit 1 (below) to be fully functional and operational per Original Equipment Manufacturer (OEM) standards. Labor, parts, consumables, travel, rental, lodging, profit, and general & administration shall be included.

Performance Standards

1) The contractor shall be certified to work on the BTB equipment (see Exhibit 1, section 3.1) by the original equipment vendor, Life Technologies Inc.

2) The contractor is expected to provide initial preventative maintenance and recertification of all nine BTB-owned instruments within 30 days after receipt of purchase order. This includes travel, labor and cost of parts (and after completion of service, the systems must operate to manufacturer’s operational specifications).

3) The contractor expected to provide an unlimited number of demand on-site service visits, including travel, labor and cost of parts (and after completion of service, the systems must operate to manufacturer’s specifications) for repairs to contracted equipment.

4) The contractor is expected to begin providing these services within one (1) business week starting from the point a service call is placed. If the instrument(s) cannot be returned to service within two business days of technician arrival at BTB, contractor shall replace those instruments with loaner Life Technologies instruments within two-and-one half weeks starting from the point a service call was originally placed.

4 Special Requirements This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.

REAL ID Act – 5 Jan 2016 Background: The REAL ID Act of 2005 establishes minimum standards for the production and issuance of state-issued driver licenses and identification cards which include requirements for a photograph and certain biographic information, such as name, DOB, gender, height, eye color & address. State-issued driver licenses and identification (ID) cards from states not meeting the standards cannot be used for accessing Federal facilities beginning 10 Jan 2016, unless the issuing state’s compliancy deadline has been extended by the Department of Homeland Security

(DHS).

As of 16 June 2016, DHS indicates Driver Licenses and ID cards from the following states/territories are not compliant with the standards of the REAL ID Act:

Am. Samoa, Minnesota, Missouri, Washington

23 other states are pursuing compliancy for their programs and have an extended compliancy deadline of 10 Oct 2016; Alaska, California, New Jersey and South Carolina are included in the extended compliancy deadline list. The current round of extensions will end on October 10, 2016.

Current Status: Since many states are not yet compliant with the Act, DoD is pending a final policy implementation date. Once final implementation guidance is received from DoD, visitor control centers will no longer accept a non-REAL ID driver’s license for vetting without an additional form of identification which is specified in Directive Type Memorandum (DTM) 09- 012, Attachment 4:

• United States Passport or United States Passport Card

• Permanent Resident Card/Alien Registration Receipt Card (Form I-551)

• Foreign passport with a temporary (I-551) stamp or temporary (I-551) printed notation on a machine readable immigrant visa

• Employment authorization document that contains a photograph (Form I-766)

• In the case of a nonimmigrant alien authorized to work for a specific employer incident to status, a foreign passport with Form I-94 or Form I-94A bearing the same name as the passport and containing an endorsement of the alien’s nonimmigrant status, as long as the endorsement has not yet expired and the proposed employment is not in conflict with any restrictions or limitations identified on the form.

• Current/valid driver’s license from a Real ID Act-compliant state or state with a REAL ID Act extension for implementation

• Driver License or ID card issued by Federal or Local Government Agencies meeting REAL ID standards with photo, name, DOB, gender, height, eye color & address

• School identification card with a photograph

• U.S. Military or draft record

• U.S. Coast Guard Merchant Mariner Cards

• Transportation Worker Identification Card

• Native American Tribal Document

All persons requesting unescorted access will continue to be vetted through the National Crime Information Center, prior to being issued a locally produced ID or pass. If a visitor requesting access does not have REAL ID Act compliant form of identification and cannot provide supplemental identity proofing documents, they must be escorted at all times while on the installation.

For the most current information concerning state-by-state compliance with the REAL ID Act, please visit https://www.dhs.gov/current-status-states-territories.
