About this file
This memorandum documents a limited source justification for a firm fixed price requirements contract to be awarded to Monaco Enterprises, Inc. The contract is for preventative maintenance and inspection of the Monaco D21 emergency management system software and hardware at Fort Drum, New York. The total potential value of the base year and four option years is unspecified. Monaco Enterprises, Inc. is the original manufacturer and sole provider of maintenance for the proprietary Monaco D21 system currently used by Fort Drum's Emergency Communication Center. Market research found no other qualified vendors due to the exclusive licensing arrangement and need for trained technicians. Award is planned for no later than February 2024 using Fiscal Year 2024 Operations and Maintenance funds.

4. Authority: Select the appropriate authority below:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
Fort Drum’s Emergency Management system is the Monaco D21 system, manufactured by Monaco Enterprises Inc. (MEI). The Fort Drum Emergency Communication Center (ECC) currently uses the MEI Computer Aided Dispatching database to assist dispatchers in tracking emergency resources and documenting pertinent information about emergency responses. Without this software, tracking emergency resources on the installation would be difficult and much less efficient. Losing this software could create a significant negative effect on the life, health, and safety of the Fort Drum Community. To maintain such a complex and vital system, the equipment and software requires periodic inspection and maintenance performed by trained and experienced personnel in this specific brand of equipment and software. This system is primarily comprised of proprietary codes developed my MEI and licensed directly to the end user.
MEI retains exclusive ownership of this code and does not license third parties to alter or add to the software or equipment. Because MEI retains exclusive ownership of all proprietary codes and does not license to third parties, they do not train or certify outside companies to maintain their equipment.
Alternatives: Outside companies not certified by Monaco could possibly provide parts of the service but would not be able to update central receiving software or test propriety features. In addition, alterations and services provided by outside companies to the system software or hardware may limit MEI’s ability to provide support in the event of software or equipment failure and can invalidate any current warranties in effect.
Another alternative is to replace the entire emergency management system; however, it is not in the Government’s best interest to procure a new emergency management system. It is more cost effective to maintain the currents system.
Impact if justification not approved: A lack of maintenance could create a significant negative effect on the life, health, and safety of the Fort Drum Community as a fully functioning Emergency Management system is vital during an emergency response.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed.
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)
