Firm Fixed Price Economic Price Adjustment-Labor and Material Instructions for Adjustment for the Single Award IDIQ contract.

The government anticipates awarding a Firm Fixed Price Economic Price Adjustment-Labor and Material in accordance with FAR 52.216-4. This contract type was selected in order to provide the flexibility needed to address the SCoE requirement’s ability to attract and retain hard to fill MOS Instructors based on unknown competitive salaries in the commercial market place. This adjustment is subject to adjustment of loaded labor rates listed in the schedule.

Process for Adjustment:

1) The contractor shall notify the contracting officer within 60 days, if at any time during the performance of this contract the loaded labor rates set forth in the schedule increase or within such further period as may be approved in writing by the contracting officer. The notice must include the contractor’s proposal for an equitable adjustment in the contract loaded labor rates. The proposal must address the causes; the effective date; and the amount of the increase attributed to loaded direct labor rate(s); evidence to demonstrate the competitive market place price influence to the increase and total price of the equitable adjustment.

2) Promptly upon receipt of any notice and required data, the contracting officer and the contractor will negotiate an equitable adjustment (and its effective date) in the contract unit prices to reflect any change in the cost of performance of this contract due to changes in loaded labor rates set forth in the schedule.

Limitations.

1) Upward adjustment does not apply to services required to be performed before the effective date of the adjustment.

2) The Contractor shall continue performance pending agreement on, or determination of, any adjustment and its effective date.

3) Adjustment for any change in labor rates (including fringe benefits) must result in a net change of at least 3 percent of the current total contract price.

4) The contracting officer can postpone the negotiations until an accumulation of increases in the labor rates in the schedule results in an adjustment of at least the allowable 3%.

5) Aggregate of the increases in any contract labor rate shall not exceed 10 percent of labor rate (limit can be adjusted by the contracting officer).
