About this file

This document is a Questions and Answers amendment for solicitation W911RX-26-Q-A004, related to forklift rental for a military installation. Key details include government-provided diesel fuel with a fuel card for refueling at approved locations, and forklift specifications of 7.5 FT long forks with a 7.5 FT spread. The solicitation is a small business set-aside contract with specific subcontracting limitations, requiring the prime contractor to perform at least 50% of the work and not subcontract more than 50% to non-similarly situated entities. The government prefers closed-cab forklift units due to weather and environmental considerations within FRKS (likely Fort Riley, Kansas).

Answer: As a small business prime contractor on a federal set-aside contract, you can subcontract to a large business. However, there are important limitations you must follow to ensure compliance with the Small Business Administration (SBA) and Federal Acquisition Regulation (FAR) requirements. FAR 52.219-4. The Limitation on Subcontracting rule is in place to prevent small business from acting as a pass-through entity for large business on contracts intended for small business participation.

6. We are preparing to submit a bid as a prime contractor for this solicitation and want to ensure full compliance with the “Limitations on Subcontracting (Oct 2022)” clause.

Specifically, we would like guidance on determining whether our proposed subcontractor qualifies as a “similarly situated small business entity” under this project.Could you please clarify what documentation or criteria the Government requires to confirm a subcontractor’s small business status for this solicitation?

Answer: Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded.

When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract; FAR 52.219-14 (e) (1). For service and supply contracts that are set aside for small businesses, the small business prime contractor is generally required to perform at least 50% of the work. This means you cannot subcontract more than 50% of the total contract amount to businesses that are not "similarly situated." A large business is not considered a similarly situated entity.

Therefore, any work you subcontract to a large business will count toward the 50% subcontracting limitation.

7. Do these units these need to be cab units or open cab?

Answer: Preferably these should be closed cab due to weather and environmental considerations within FRKS.
