1.44. TDY/Travel.

1.44.1. Definition: For the purposes of this contract, TDY is defined as the reimbursable travel costs and per diem associated with any Contractor direct labor employee (audit will confirm that the costs associated with the employee are attributable to the specified contract only, and no others) that is required to provide performance at a location that precludes a nominal commute from their home of record to the place of performance. The Government expects that the Contractor shall include the costs of any indirect employee travel associated with this contract in their indirect cost pool.

1.44.2. Authorization for TDY: The Contractor shall not incur TDY costs without the Contracting

Officer’s written authorization for the TDY. To request TDY authorization, the Contractor shall submit a written request that describes the purpose, place of performance, name/s of the Contractor personnel participating, itinerant schedule including identification of travel days, and the estimated costs by category.

1.44.3. Rates, Charges, Supporting Data, and References: The Government will only recognize mileage, meal, and lodging rates as identified for the specific place of performance in the then current Joint Travel Regulations (JTR) at https://secureapp2.hqda.pentagon.mil/perdiem/trvlregs.html?SMIDENTITY=NO or subsequent. For inclusion of incidentals as a reimbursable cost, the Contractor must also submit a justification that the conditions for entitlement (as described by the JTR) are a requirement of the contract. The Government will only recognize other TDY costs (such as airfare, vehicle rental, and fuel reimbursement) upon submittal of receipt copies to support the invoice and if the charges are identified as allowable by the JTR, are deemed fair and reasonable by the Contracting Officer, and can be justified as necessary to contract performance. The Government expects the Contractor to maximize any TDY vehicle occupancy so as to contain costs. Multiple employees on TDY shall maximize the occupancy of any TDY vehicle used so that the quantity, types, and capacity of the vehicles requested are the minimum required to perform the TDY functions. Lodging reimbursement shall be at the actual rates billed or the JTR rate identified for the location of performance (whichever is less) as supported by submittal of paid or charged receipt copies with the invoice. The Government may confirm any or all charges with the actual service providers or by other applicable data bases.

The Contractor shall invoice for TDY reimbursement as part of their regular invoice as specified by the contract. The Contractor may include reasonable indirect costs as part of their TDY charge, but no profit or fee charge will be acceptable.

1.44.4. Computation Methodology:

1.44.4.1. Per diem costs will be computed as follows: First day-75% of the meal rate. Last day- 75% of the meal rate and no lodging allowance. Extended TDY, as described by the JTR, shall be at the rates and terms allowed for extended TDY. No per diem charge will be allowed if the TDY distance is considered to be a nominal commute by the Contracting Officer. Lodging reimbursement shall be at the actual rates billed (up to the maximum allowed by the JTR for the specific TDY location) as supported by submittal of paid or charged receipt copies with the invoice. The Government may confirm charges with the service providers or by other applicable data bases.

1.44.4.2. POV Mileage, Fuel Costs: The distance of the Contractor’s direct labor employee’s normal commute will be subtracted from the total miles to/from the TDY site. The result will be the travel miles used to establish the invoice mileage charge. No mileage or per diem charge will be allowed if the TDY distance is considered to be a nominal commute by the Contracting Officer. Multiple employees on TDY shall maximize the occupancy of any charged TDY vehicle used so that the quantity, types, and capacity of the vehicles requested are the minimum required to perform the TDY functions. No TDY charges for costs incurred as in-and-around mileage/fuel shall be allowed. The Government may confirm invoiced charges by other applicable data bases.
