ADDITIONAL INFORMATION

EMPLOYEE IDENTIFICATION

The contractor shall be responsible for providing positive identification of employees as required by the Security Office at Pine Bluff Arsenal. Prior to beginning work or receiving a notice to proceed, the contractor shall identify with the Pine Bluff Contracting Division and Security Office points of contact who shall be responsible for identifying employees, subcontractors, vendors and delivery personnel. One identified point of contact shall personally accompany any contractor personnel, subcontractors, vendors, or delivery personnel to be badged to the Security Office. Employees or other personnel arriving without an identified point of contact will not be badged.

Any delays caused by improper identification of employees shall be at the contractor's expense and no time extensions shall be allowed for such delays.

NOTICE OF POSSIBLE DELAYS

During the time a contractor is working on the Arsenal he may, from time to time, be working in an area where munition test exercises are conducted. While it is not the Arsenal's policy to interfere with a contractor during these test exercises, delay may occur. These delays may involve contractor personnel being withdrawn from an area or being denied access for a period of time. The length of time and frequency of these delays will be held to a minimum. No claim shall be submitted for less than five (5) man-hours per month. Claims may be submitted under the Changes Clause of the contract.

INSPECTION AND ACCEPTANCE (PBA) (AUG 90) (4306I):

Inspection and acceptance will be at destination, unless otherwise provided herein. Until delivery and acceptance, and after any rejections, risk of loss will be on the contractor, unless loss results from negligence of the United States Government.

DELIVERY OF MATERIALS

It is the responsibility of the contractor or subcontractor to inform their vendors or truck drivers of the prime contractor's name, contract number and work site. Pine Bluff Arsenal is a controlled access installation therefore, subcontractors, vendors, or delivery persons who do not possess the above information and other proper identification as required by the Security Office may be denied access to Pine Bluff Arsenal. Any delay caused by such denial will be at the contractor's expense and no time extensions for such delays will be allowed. Contractors will provide escorts for suppliers' trucks from the perimeter gates to job site when required.

PERFORMANCE EVALUATION OF CONTRACTOR

a. As a minimum, the contractor's performance will be evaluated upon final acceptance of the work. However, interim evaluation may be prepared at any time during contract performance when determined to be in the best interest of the Government.

b. The format for the evaluation will be Standard Form 1420, and the contractor will be rated either outstanding, satisfactory or unsatisfactory in the areas of Contractor Quality Control, Timely Performance, Effectiveness of Management compliance with Labor Standards, and Compliance with Safety Standards. The contractor will be advised of an unsatisfactory rating overall, prior to finalization of the evaluation, and all contractor comments will be made a part of the official record. All Performance Evaluation Reports with overall unsatisfactory or which cite outstanding performance are forwarded to the Office of the Chief of Engineers in Washington, DC, as are all reports in excess of$200,000.00. These reports will be available to all DoD Contracting Officers for use in determining contractor responsibility.

UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT PERSONNEL

(PBA) (AUG 90) (4417).

Contracting Officer's Representative will be so designated in writing to the contractor and the scope of his authority will be set forth therein.

b. No information, other than that which may be contained in an authorized modification to this purchase instrument duly issued by the Contracting Officer, may be considered a valid obligation. Information received from any other person employed by the U.S. Government will not be considered grounds for deviation from any stipulation of this purchase instrument or referenced drawings and/or specifications.

Since the absorption of phosphorus extends over a period of hours, attempts at inducing vomits shall be continued until countermanded by a physician. Animal or vegetable fats or oils will not be given as these increase the rate of absorption.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
