About this file

This document provides questions and answers related to solicitation number W911QY-22-R0022 issued by the Department of the Army Materiel Command Army Contracting Command Aberdeen Proving Ground. The solicitation seeks laser eye protection goggles and kits from vendors currently listed on the Authorized Protective Eyewear QPL (APEL). Questions cover product testing requirements, security clearances, pricing structures, and whether laser specification data is considered controlled unclassified information. Responses clarify that full product testing is not required for submission but may be at time of award, no security clearance is needed, vendors can propose their own pricing, and while laser specifications are CUI, commercial product descriptions without detail do not require submission through a secure site.

W911QY22R0022 – LEP Solicitation Questions and Answers 28 July 2022

1. Can a vendor qualify by similarity if they also have qualified on the previous contract? What do you mean by similarity? The products should use APEL platforms. The products will still be tested against MCEP requirements (MIL-PRF-32432A and measured for wavelength and OD laser protection values).

2. Would the Program Office specify the FAT tests and what is expected to be tested? Yes, go to column “2-year Recertification” in table VI of MIL-PRF-32432A (attached)

3. Is a SECRET clearance required for a vendor that is awarded this program? No

4. We have noticed that the price ranges line up with the previous LEP RFQ. We are wondering if the Government plans to revise the Step Ladder price ranges to line up with the currently requested quantities. The vendor can supply their own Step Ladder price ranges for our consideration.

5. Is the laser specification data considered controlled, or not. We see that the Near-infrared (NIR) and visible (VIS) wavelengths and optical density (OD) requirements are listed as CUI but all of the Solicitation documents as well as CUI data is available for Public download. The laser specification data is currently considered CUI.

6. As a follow-on to #5, if the specification data is CUI, should vendors upload proposals to a secure site rather than emailing to the Contracting office. The requirements are CUI, your products are COTS. If you are providing your COTS descriptions, then information is considered unclassified. You can state that you simply meet the CUI requirements without getting into detail, then that should not require uploading to a secure site.

7. We understand that 52.212-3 is required with the submission. The Solicitation indicates “Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. This single, consolidated list of representations and certifications for the acquisition of commercial items is attached to this solicitation for offerors to complete and submit with its offer.” We do not believe it’s been attached with the other Solicitation documents. 52.212-3 is now attached to the solicitation.

8. We see that the ‘Supply Requirements Document’ with the CUI data has been deleted. Will a new version of this document be posted? No, there will not be since the document contained CUI data.
