Questions & Answers – 15 June 2020
1. Question: In regards to Attachment 1 - Notice of Limited Distribution Materials, “Condition 1: The potential offeror qualifies by meeting the limited dissemination criteria stated in the distribution statement of the requested material.”
What is meant by “the limited dissemination criteria stated in the distribution statement of the requested material”?
Answer: Each Department of Defense distribution statement (A, B, C, D, E, or F) contains specific criteria as to whom materials may be released. Condition 1 of the PM SPE limited distribution material access policy states that IF (1) the potential responder provides verifiable evidence that they are within the group already designated as eligible for receipt of the material by the distribution statement itself, THEN (2) we will distribute the material to them.
Examples:
Example 1: The distribution statement of the requested material is C. Distribution Statement C states that the distribution is authorized to U.S. Government Agencies AND their contractors...
(1) The requesting entity provides VERIFIABLE evidence that they have an active contract with a U.S.
Government Agency (could be with DoJ, DoE, DoS, DoD, and so on). (2) The Government then verifies that claim via independent Government sources and upon verification distributes the requested material.
Example 2: The distribution statement of the requested material is D. Distribution Statement D states that the distribution is authorized to Department of Defense AND U.S. DoD contractors only...
The requesting entity provided VERIFIABLE evidence that they have a contract with a non-DoD U.S.
Government Agency (say DoJ). In this example, they would not qualify for distribution by Condition 1. If we were to give the requestor the documents, the requestor would have to be granted an exception via Condition 2.
Example 3: The distribution statement of the requested material is D. Distribution Statement D states that the distribution is authorized to Department of Defense AND U.S. DoD contractors only...
(2) The requesting entity provides VERIFIABLE evidence that they have an active DoD contract (e.g., DLA, Air Force, Navy). (2) The Government then verifies that claim via independent Government sources and upon verification distributes the requested material.
Questions & Answers – 25 June 2020
