Contracted Lead-Based Paint Project Requirements for Non-Housing Projects

1. Lead Occupational Safety and Health Administration (OSHA) Lead Compliance Plan Submittal. The contractor shall prepare an OSHA Lead Compliance Plan and submit it for Government approval. The plan shall be in accordance with Lead in Construction Standard 29 CFR 1926.62. The plan is required for abatement of lead-based paint which exceeds 0.06% by weight. The OSHA Lead Compliance Plan shall include but is not limited to the following items:

a. Detailed work procedures of the project in accordance with OSHA regulations: Lead in Construction Standard 29 CFR 1926.62, and OSHA Hazard Communication Standard 29 CFR

1910.1200. The detailed work procedures shall include sketches depicting work area, engineering controls to protect the workers, public and the environment, sign posting procedures, notification procedures for building occupants, and site cleanup procedures.

b. Personal Protective Equipment (PPE) shall be used on the project so a description of the PPE shall be included in the plan. Use of PPE may be reduced or eliminated if the contractor submits a negative exposure assessment and the Government approves it.

c. Personal air sampling shall be performed on the project per 29 CFR 1926.62 (d)(3)(i) so a statement stating that it shall be performed must be included in the plan. The contractor shall submit the analytical results of personal air sampling within 2 business days. Note: do not include The Privacy Act of 1974 as amended (5 USC 552a) information (name and social security number) when reporting the analytical results. The air monitoring and analytical laboratory services contractor shall be certified/licensed by New York State (NYS).

d. Hazardous waste disposal procedures. “Hazardous waste” is defined in 6 NYCRR Part 371, Identification and Listing of Hazardous Wastes (3 September 2005). The hazardous waste shall be containerized and labeled per 49 CFR 172.400 (General Labeling Requirements).

Containers for the hazardous waste shall comply with 49 CFR 172.101 (Hazardous Material Table) and 49 CFR 173.XXX (Packaging) where XXX is listed in 49 CFR 172.101 for each hazardous material, and the containers shall be Performance Oriented Package Specification (POPS) certified. The Watervliet Arsenal will dispose of the hazardous waste after the contractor has properly containerized and labeled it. Note: hazardous lead solid waste is defined as the waste material containing 5 parts per million or greater of lead per 6 NYCRR PART 371 Identification and Listing of Hazardous Waste (3 Sep 05).

e. Lead containing solid materials that are not defined as hazardous waste shall be disposed of by the contractor as construction/demolition debris.

f. Physical description & location of the clean changing area and the hand washing facilities.

g. Include a statement that the contractor shall make medical surveillance, as described in 29 CFR 1926.62 (j), available to all project employees if any project employee’s personal air

20 Oct 06 sampling analysis results exceed the lead air action level of 30 micrograms per cubic meter as an 8 hour time weighted average.

2. Required Submittals

a. For each employee who participates in the lead paint project the contractor shall submit proof of current OSHA lead training, as described in 29 CFR 1926.62 (l), for every worker and at least one supervisor who shall work on the project.

b. For each employee who participates in the lead paint project the contractor shall submit copies of each employee’s respirator fit test results and a Physician’s written opinion on his or her ability to wear a respirator.

c. Provide copies of Material Safety Data Sheets (MSDS) for all chemicals being used during the job.

d. Provide copies of Lab NYS Certification/License.

e. Provide copies of air sampling results.

f. Provide copies of Air Monitoring sampling plan.
