52.212-2 Evaluation—Commercial Products and Commercial Services
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Technical, Past Performance, and Price
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Addendum to 52.212-2 Evaluation—Commercial Products and Commercial Services
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Evaluation Factors
This evaluation will utilize comparative analysis IAW FAR 12.203(c)(2) to provide the best value to the Government. Award may be made to other than the lowest priced quote, if the Government determines that a price premium is warranted due to technical merit.
However, the closer the merits of the technical quote are to one another, the greater will be the importance of price in making the award determination. In the event two or more technical quotes are determined technically equivalent, award may be made to the lower priced quote provided the price is reasonable. Responses to this solicitation will be evaluated against the following factors:
Factor 1: Technical
Factor 2: Past Performance
Factor 3: Price
Factor 1: Technical.
The quoter shall provide technical information based off of the requirements of the Purchase Description (PD). The information shall provide, at a minimum, the following information:
(a) Subfactor 1 Supply Chain & Material Availability: The Offeror shall provide information to substantiate their capacity to source, inventory, and deliver the extensive range of materials (from heavy aggregate and concrete to delicate electrical and HVAC components). Examples include established distributor relationships, warehousing capabilities, and inventory depth.
(b) Subfactor 2 Rental Equipment Fleet Management: The Offeror shall provide their operational plan for mobilizing and demobilizing commercial-grade equipment to LEMC.
The plan shall include details to meet the 24-hour equipment replacement guarantee and routine maintenance/inspection procedures.
(c) Subfactor 3 Past Experience: The Offeror shall provide at least three recent and relevant Government or private sector projects completed within the past three years that demonstrates the ability to perform the requirements in this solicitation. The Offeror shall identify the contract title, contract number, dollar value, client name and address.
Mere re-statements, of the requirements or statements from the quoter that the quoter is compliant that do not include proof that the quoter can demonstrate the aforementioned items, are unacceptable.
If the quote is determined unacceptable in any of the technical evaluation factors or subfactors, the quote may not be considered for award.
In addition to the information submitted by offerors, the Contracting Officer may consider other information reasonably related to the evaluation factors, to include the personal knowledge of the competitor's commercial and Government customers and past performance databases. The Government may consider any other value-added benefit offered in its best value determination.
The Contracting Officer is not obligated to evaluate all information submitted by each offeror. For example, the Contracting Officer may curtail evaluation of an offeror's submission if at any point the Contracting Officer determines the competitor is unlikely to provide best value.
The Contracting Officer may communicate with an offeror at any time during the evaluation without regard to the FAR Part 15 rules concerning competitive range determinations and negotiations. The Contracting Officer may also identify the offeror most likely to provide best value and hold negotiations solely with that offeror to finalize the order and/or negotiate more favorable terms for the Government.
Factor 2: Past Performance.
A. The Government will evaluate the quoter’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PD.
B. Quoters shall submit all relevant information on Government and/or commercial contracts for the prime offeror and each major subcontractor, those subcontractors expected to perform twenty (20) percent or more of the effort, in performance or awarded during the past three years, from the issue date of this Request For Quote (RFQ), which are relevant to the efforts required by this RFQ. The Government may consider a wide array of information from a variety of sources but is not compelled to rely on all of the information available.
C. Quoters shall include the most recent and relevant efforts (within the past three years) in their quote. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its quote will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the quoter in its quote and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System (NAICS) 324121. Data used in conducting performance risk assessments shall not extend past three years prior to the issue date of the RFQ but may include performance data generated during the past three years without regard to the contract award date.
Factor 3: Price.
(a) Sample Project Pricing for Evaluation Purposes: Offerors must propose unit prices for all 25 items listed in the Sample Project Bill of Materials (BOM) pricing schedule below. This Sample Project BOM represents a typical troop support asphalt, milling, and site preparation project and will be used as a standardized tool to evaluate the relative price competitiveness and reasonableness of proposals for initial IDIQ award. A proposal that fails to price all items may be rejected as nonresponsive and excluded from further evaluation. The proposed prices are for evaluation purposes only to establish the IDIQ award pool and shall not establish binding ceiling prices, as actual pricing will be competed and established at the individual delivery order level.
1. Because this is a Multiple Award IDIQ contract where delivery orders will be dynamically competed, the Government will evaluate offerors’ initial price proposals using a representative Sample Project Bill of Materials (BOM) to select the best-value pool of contractors.
2. Non-Binding Evaluation Pricing: The unit prices proposed below are strictly for initial evaluation to determine price reasonableness and to support source selection. These prices are not binding ceiling prices for future delivery orders. Actual pricing will be competed and determined fair and reasonable at the individual delivery order level, allowing contractors maximum flexibility to adapt to market fluctuations and material cost shifts.
3. Master IDIQ CLIN Value: The actual IDIQ contract CLINs will have a pre-determined, non-evaluated value of $4.5 Million for each contract period, established by the Government. This value is uniform for all awardees and is not used for competitive price evaluation.
4. Evaluation Pricing: Offerors must input a fully burdened unit price for all 25 items in the table below. Unit prices should reflect current standard market rates, inclusive of standard commercial packaging, manufacturer warranties, and delivery to LEMC.
5. Equipment Rental (Items 1–10): Proposed monthly rental rates must include delivery (mobilization) and pick-up (demobilization) of the equipment, as well as routine maintenance.
6. Calculations: Extended prices must be calculated by multiplying the specified Quantity by the proposed Unit Price. In the event of a mathematical discrepancy between the Unit Price and the Extended Price, the Unit Price shall govern.

(b) Options Evaluation: The IDIQ contract structure consists of a five (5) year base period and one (1) five (5) year option period. The Government will evaluate offers for award purposes by adding the total price for the option period (calculated using the option period pricing instructions below) to the total price for the basic/base period requirement on the Sample Project BOM. This option evaluation is conducted to assess the offeror's long-term relative pricing model. The Government may determine that an offer is unacceptable if the option escalation rate is significantly unbalanced or unrealistic. Evaluation of options shall not obligate the Government to exercise the option(s), nor does it establish binding rates for future delivery orders.
To evaluate the 5-year Option Period in accordance with FAR 17.202, Offerors must specify their proposed Option Period Price Escalation Rate. This rate represents the estimated long-term escalation the Contractor projects for their pricing models under a potential option period, utilized strictly to compare offers on a standard basis.

Total Evaluated Price (TEP) Calculation:
• Base Period Evaluated Price: Calculated as the sum of the Proposed Extended Prices (Quantity × Proposed Unit Price) for all 25 items in Attachment A.

52.229-11 Tax on Certain Foreign Procurements-Notice and Representation (Jun 2020)
(a) Definitions. As used in this provision-
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area of the United States.
United States person as defined in 26 U.S.C. 7701(a)(30) means
(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;
(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and
(5) Any trust if-
(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and
(ii) One or more United States persons have the authority to control all substantial decisions of the trust.
(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.
(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C- 1(d)(5) through (7). The Offeror may claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the
IRS.
(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that
(1) It ___ is ____ is not a foreign person; and
(2) If the Offeror indicates "is" in paragraph (d)(1) of this provision, then the Offeror represents that-I am claiming on the IRS Form W-14 ___ a full exemption, or ___ partial or no exemption [Offeror must select one] from the excise tax.
(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then-
(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract; and
(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.
(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.
