Section M - Evaluation Factors for Award
CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
a. The basis of award will be the Lowest Priced, Technically Acceptable offer. Offerors must receive a rating of Technically Acceptable in all factors/subfactors in order for their overall proposal to be determined Technically Acceptable.
b. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, and technical requirements.
c. The Government intends to make award without discussions, unless the Contracting Officer determines that discussions are necessary. Offerors should provide their most favorable prices in their initial offers.
(b) Non-Price Evaluation Factors and Subfactors: The offerer shall provide all information required for the
Government POC to evaluate the quotes for compliance with the requirements detailed in the Purchase Description (PD). Information includes, but is not limited to: brochures, videos, drawings, and testimonials.
(c) Price Evaluation Factor: Offerors shall complete the Schedule B with pricing for each
Contract Line Item Number (CLIN).
(d) Proposals will be evaluated initially independently of the price to determine the Offerors’ ability to meet the Government’s requirement set forth in the solicitation. The Government may make a final rating determination based on the proposal as submitted without requesting any further information. For all proposals determined to be Technically Acceptable, the offer providing the lowest price will receive the contract award.
a. Offerors’ technical proposals will receive an overall rating based on the following:
i. Technically Acceptable: Offeror meets all requirements or technical specifications or has submitted all documentation requested in any technical evaluation criteria and all documentation meets the standard set forth in the solicitation.
ii. Technically Unacceptable: Offerer fails to meet all requirements or technical specifications or has failed to comply in submitting requested documentation in any technical evaluation criteria or the submitted documentation fails to meet the standard set forth in the solicitation.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
STATEMENT OF COMPLIANCE
The offeror’s proposal shall be in sufficient technical detail that its key design and operation features can be compared & contrasted with those of a comparison unit.
Each offeror must fully complete the attached statement of compliance. Failure to complete the statement of compliance can result in a bidder not being considered for award of this project.
If the offeror is unable to meet the requirement as stated in a paragraph, the offeror must mark “NonComply,” and provide the rationale for non-compliance or an alternative method of achieving the performance intent of the paragraph. Alternatives to the specified requirement should be described in sufficient detail to allow the government to determine if the alternative meets the performance intent of this specification.
Indicating “Comply” means that the offeror understands and intends to comply with that paragraph and its sub-paragraphs. If the offeror feels that any paragraph in the specification is unclear or needs to be revised, this needs to be covered with the contracting officer and resolved prior to submitting the statement of compliance. Any revisions to this purchase description or statement of compliance will be coordinated through the contracting officer so that all interested parties are properly notified.
