About this file

This solicitation is for Per-and Polyfluoroalkyl Substances (PFAS) soil washing treatment services at Eielson Air Force Base in Alaska. The contractor will treat approximately 130,000 cubic yards of PFAS contaminated soil stockpiled from eight F-35 construction projects through on-site soil washing. The contractor must ensure all awarded soil volumes are either treated to meet Alaska's cleanup levels for migration to groundwater or disposed of at a permitted landfill or EPA-approved Class I Underground Injection Control facility. Post-treatment confirmation sampling is required to verify compliance with applicable cleanup levels. Treated soil will be placed at an approved on-installation location. This competitive total small business set-aside solicitation was issued by the Department of the Army Corps of Engineers Engineering District Alaska. Offerors must register in the Procurement Integrated Enterprise Environment system and establish a proposal manager role to submit proposals, which are due through the listed website.

This solicitation is being procured under NAICS 562910 -Environmental Remediation Services with a size standard of 750 people. Per the SBA, for purposes of classifying a Government procurement as Environmental Remediation Services, the procurement must be composed of activities in three or more separate industries with separate NAICS codes or, in some instances (e.g., engineering), smaller sub-components of NAICS codes with separate and distinct size standards. These activities may include, but are not limited to, separate activities in industries such as: Heavy Construction; Special Trade Contractors;

Engineering Services; Architectural Services; Management Consulting Services; Hazardous and Other Waste Collection ;

Remediation Services; Testing Laboratories; and Research and Development in the Physical , Engineering, and Life Sciences. If any activity in the procurement can be identified with a separate NAICS code, or component of a code with a separate distinct size standard, and that industry accounts for 50 percent or more of the value of the entire procurement, then the proper size standard is the one for that particular industry, and not the Environmental Remediation Service size standard . Given that the procurement is for Remediation Services, where such services represent more than 50 percent of the value of the entire procurement, we request the Air Force procure this stand-alone requirement under NAICS 562910 - Remediation Services, with a size standard of $22M.

On: Jul 18 2022.

Government Response. . The use of NAICS 562910 - Environmental Remediation Services is applicable to this solicitation. This NAICS has been approved by the SBA due to the note in 14b. The government has specified the use of soil washing as the exclusive technology that is acceptable to perform the Eielson AFB PFAS Soil Treatment work. As the government is aware, there is a current, active lawsuit between contractors where one firm claims a broad patent over PFAS soil washing of contaminated soil. Since the government is driving contractors to this process, we ask that the government to provide indemnification from potential patent infringement lawsuits.

The contractor for the soil characterization report has had the field investigation data (boring logs, lab results, etc.) for over 2 years and the soil characterization report for almost 8 months.

o There is a high likelihood that they have information that is not available to competitive bidders (draft reports, email discussions with USAGE, AF, ADEC). We ask that the government consider them to have an OCI due to these proprietary conversations and exclude them from bidding.

o We ask that all draft reports and project email that were excluded from the GFI be made available to all bidders.
