Emergency Planning and Community Right-to-Know Tier II Reports

Fort Wainwright, Fairbanks, Alaska

Alaska District, U. S. Army Corps of Engineers January 2013

1.0 Introduction

The Emergency Planning and Right-to-Know Act (EPCRA) was established to provide the public with information regarding hazardous chemicals in their communities, to enhance community awareness of chemical hazards, and to facilitate the development of State and local emergency response.

Extremely Hazardous Substances (EHS) and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) chemicals present above Reportable Quantities (RQ) or Threshold Planning Quantities (TPQ) are subject to reporting under Section 302 of EPCRA. The State of Alaska also requires municipalities to report hazardous substances under Alaska Statute Section 29.39.500.

All organizations and units on Fort Wainwright are directed to complete an inventory of all hazardous materials used to support their missions and to attach Material Safety Data Sheets (MSDS) for each material listed on the survey form. To comply with federal and state community right-to-know regulations, the named Army posts and facilities are required to submit a Tier II report of all hazardous materials used or stored equal or greater to RQ or TPQ to the State Emergency Planning Committee (SERC), the Local Emergency Planning Committee (LERC), and post fire departments. EPCRA Tier II forms are standardized forms established to report these hazardous materials. The Tier II reports compile the Tier II forms for each respective post.

2.0 Objective

The objective of this scope of work is to generate annual EPCRA Tier II reports for Fort Wainwright. EPCRA Tier II reports for Fort Wainwright have been completed for 1990 through 2012. The contractor will inventory the hazardous material used and stored by units and organizations within Fort Wainwright.

The contractor shall furnish all necessary labor, equipment, materials, and transportation necessary to perform the work described in this Statement of Work (SOW). The Contractor shall provide adequate professional supervision and quality control to assure the accuracy, quality, completeness, and progress of the required work. Work shall be performed in accordance with common industry standards/practices and all applicable federal, state and local regulations. The Contractor shall be responsible for identifying the applicable federal, state and local regulations that will affect this contract.

3.0 Description of Tasks

The Contractor shall prepare Tier II reports for the 1 January to 31 December 2013 time period.

These reports detail the calendar year 2013 inventory of hazardous material used and stored by units and organizations within Fort Wainwright.

The following describes the required tasks to be performed:

3.1 Task 1- Project Management

The project schedule shall be provided in Gantt chart format and shall include dates for starting and completing critical features of the work. The Contractor shall update and resubmit the schedule when changes to the schedule are realized and with each monthly status report submission.

The Contractor shall participate in quarterly progress meetings. The purpose of these meetings is to discuss project status and results. Presentation materials shall be prepared for these meetings. Materials shall be provided for review ten (10) days prior to each meeting. Meeting minutes shall be prepared by the Contractor and provided to the USACE PM within seven days of the conclusion of each meeting.

3.2 Task 2- Fort Wainwright Field Visit

The Contractor shall visit individual units at Fort Wainwright to gather, update provide a thorough check of the information sufficient to populate and update EPCRA Tier II forms used for the calendar year 2013 EPCRA Tier II reports. A thorough check consists of the verification and/or identification of all units, their names, and locations; update of chemical inventories; and the determination of hazardous chemicals, materials, munitions used and/or wastes quantities meeting or exceeding reporting thresholds on the respective posts and facilities. Coordination with the U.S. Army, Alaska shall occur to identify all units present on post. Table 1 lists buildings and corresponding units visited for the 2012 report. This list is subject to change; the Contractor should structure his or her proposal to account for the fact that an additional ten buildings/inspections may be added and/or deleted. Some units and/or buildings not listed may have changed material handling practices from previous years altering reportable quantities. The Contractor shall update the building list and make any changes regarding unit names and building locations and the Contractor shall include these changes in the calendar 2013 EPCRA Tier II reports.

3.3 Task 3- Draft Tier II Reports for Fort Wainwright

The Contractor shall prepare a draft EPCRA Tier II Report for Fort Wainwright. For efficiency and accuracy, the Contractor should use prior EPCRA Tier II reports as a template and reference for this work. In preparing the draft EPRCA Tier II report, the Contractor shall:

QASP

QUALITY ASSURANCE SURVEILLANCE PLAN

FOR

Fort Wainwright Emergency Planning and Community Right‐to‐know Act

Project Support Fort Wainwright, Alaska

Contract: TBD 5 February 2014

1. PURPOSE. This Quality Assurance Surveillance Plan (QASP) is a Government developed document used to ensure that the Government receives quality services, and pays only for services actually provided. The QASP provides a systematic method to evaluate the services the Contractor is required to furnish.

2. SCOPE. The role of Government Quality Assurance is to ensure contract standards are achieved. The QASP provides guidelines and methods for the Government’s oversight of the Contractor’s quality control efforts to assure timely, effective services are provided IAW the contract/order. The Contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract.

3. ROLES AND RESPONSIBILITIES.

Contracting Officer (KO) ‐ A person duly appointed with the authority to enter into, administer and terminate contracts on behalf of the Government. The KO is the only person who can legally commit the Government and only the KO, as the Government’s agent, can modify the contract/order. The KO is the final authority for determining the adequacy of the Contractor’s performance. KO decisions arising under or relating to the contact are final.

Contracting Officer’s Representative (COR) – An individual designated in writing by the KO to perform specific technical and administrative functions within the scope and limitations of their written appointment (e.g., surveillance of Contractor’s performance, accept services). The COR is not empowered to make any contractual commitments or authorize any changes to the order/contract or in any way obligate additional funds by the Government; such authority rests solely with the KO.

Quality Assurance Evaluator (QAE) – An individual designated by the requiring activity, typically the Project Manager, to assist the COR and provide technical oversight of the Contractor’s performance. The QAE’s primary duty is to monitor the Contractor’s performance by physically checking to see that tasks are completed, reports are submitted, and desired outcomes are achieved. When a surveillance observation results in an unacceptable evaluation, the QAE will report the unacceptable performance to the COR. The QAE is not authorized to direct work, offer advice on how the work should be performed, change the contract, or in any way obligate payment of funds by the Government.

4. METHODS OF SURVEILLANCE. Surveillance is performed by the Government to provide objective quality evidence that there is a reasonable level of confidence that the services provided by the Contractor have met all the requirements of the contract before authorizing payment. The primary methods of surveillance are periodic inspections and customer feedback.

Periodic Inspection: Inspections are planned as determined by the surveillance schedule and project needs.

Periodic inspections will be performed at random times, as needed, during all hours of the Contractor’s operation.

Periodic inspections may be performed more frequently if the COR/QAE discovers the quality of the Contractor’s performance is less than acceptable.

Customer Feedback: Customer feedback is firsthand information from the actual users of the service and is typically obtained via telephone or email. Customer complaints obtained via telephone must be followed up in writing/email. The customer complaint must clearly articulate the nature of the complaint, time, date, etc. The COR/QAE will validate the complaint and forward a copy to the KO for resolution with the Contractor as needed. If a complaint is determined to be invalid, the COR/QAE, will communicate this decision and the rational used in making this determination to the customer. Customer feedback will be used to supplement other forms of performance evaluation, but will not be the only method of evaluating the Contractor’s performance.

5. SURVEILLANCE PROCEDURES.

a. The COR/QAE will monitor performance in accordance with the schedule and will ensure all services required by the contract are successfully performed. All inspections will be documented and include as a minimum date and time, who performed the inspection, what was inspected, to what standard and the results. Successful or exceptional performance will be documented as well as deficiencies in Contractor performance. Documentation will be maintained for future reference, audit, and proof of inspection. Any uncorrected unacceptable observation will result in an unacceptable rating, a corrective action request to the Contractor and notification to the KO.

b. The COR will notify the Contractor each time an unacceptable observation has been recorded and ask the Contractor to correct the problem. The COR/QAE will record the contract requirement , the specific deficiency to the requirement, the date and time it was discovered, and have the Contractor sign the associated documentation. The Contractor will be given two working days after notification to correct the deficiency in accordance with requirements of the contract. Deficiencies that cannot be corrected within two working days will be reported to the Contracting Officer.

c. The COR will report to the KO more serious (systemic in nature) deficiencies or recurring deficiencies in the same area that could indicate a trend. The KO will notify the Contractor and request corrective action. The KO may require the Contractor to re‐perform any services that do not meet contract requirements at no additional cost to the Government.

d. The COR/QAE will re‐inspect services that were found deficient to ensure corrections were made within the timeframe outlined in the contract or other agreed upon time. The COR/QAE will not consider the services complete until all deficiencies have been corrected. Contractor’s failure to complete corrective actions will be reported immediately to the KO for further action.

e. The COR/QAE will accept the services provided and authorize payment, typically on a monthly basis or upon satisfactory completion of the work.

6. QUALITY ASSURANCE SURVEILLANCE FILE. The COR/QAE file shall contain:

a) Copy of the COR appointment letter from the KO, any changes to that letter, and any termination letters; b) Training Certifications for COR; c) Copy of the contract and all contract modifications; d) Copy of the applicable Quality Assurance Surveillance Plan (QASP); e) Copy of the contractor’s Sampling Plan; f) Correspondence initiated by authorized representatives (Contractor or Government) concerning performance of the contract; g) Records of inspections performed and the results; h) Customer Feedback; i) Documentation of meetings, telephone conversations, or discussions with the contractor or others pertaining to the contract or contract performance; j) Documentation pertaining to acceptance of services, reports, or data.

7. RECORDS: All records will be retained for the life of this contract.

8. CHANGES: The QASP is a living document and, as such, may be changed as needed. However, the KO must approve changes. The COR will submit recommended changes to the KO for approval.
