(Lowest Price Technically Acceptable (LPTA))

Submitted proposals will be evaluated according to the Lowest Price Technically

Acceptable “LPTA” criteria listed in this document. Award will be made based on the technically acceptable proposal that is Lowest Price to the Government; price and other factors considered.

The following factors will be used to evaluate proposals:

Factor 2: Technical Capability - Procedures

Factor 3: Price

The combination of technical evaluation criteria Technical Capability - Equipment and

Technical Capability - Procedures are equal– Procedures are approximately equal to Price. The

Government intends to use a “LPTA” process during the award process.

1.0 Proposal Evaluation

The agreement(s) will be awarded to the offering firm(s) whose proposal provides the best value to the Government. Each contractor’s proposal will be evaluated by a technical team based on the technical evaluation criteria listed below (found technically acceptable), as well as the price proposal. All technical evaluation criteria combined are approximately equal in weight to the submitted price proposal. The total proposal page count shall not exceed 5 pages, excluding the price proposal. Minimum font size for proposals is 12 point.

Proposals shall be submitted in two volumes. Volume I contains technical information and Volume II contains pricing information. Email submissions are encouraged and will be accepted.

1.1 Technical Evaluation Criteria (Proposal):

Technical Capability - Equipment: Describe the equipment (make, model, year, type) in sufficient detail to ensure it is well maintained and capable of clearing the types of vegetation on the terrain indicated.

Technical Capability - Procedures: Provide brief clearing procedures that describes the work hours, labor and work procedures to clear the four areas in the timeframe provided and on the terrain indicated.

STATEMENT OF WORK

SCOPE OF WORK

CHENA RIVER LAKES FLOOD CONTROL PROJECT

Tree and Brush Clearing

February 3, 2014

GENERAL: The Contractor shall furnish all labor, equipment, materials, supplies, transportation, fuels and other items necessary to clear and remove or chip trees and brush within an area of approximately 53 acres. These 53 acres include four separate treatment areas located within or near the Chena River Lakes Flood Control Project, are designated Areas 1, 2, 3, and 4, and described below. All trees and brush will be felled and masticated to ground level as prescribed. All tree stumps will be cut to no greater than 6-inches high from ground level and all trees of firewood size within Areas 2 and 3 will be salvaged and stacked at designated areas as specified below. Photos 1 through 8 depict three of the four treatment areas. One drawing show the road side slopes in Area 3 to be cleared and 5 maps show the limits of the work areas.

LOCATION: The Chena River Flood Control Project is located approximately 18 miles east of

Fairbanks, Alaska, near the community of North Pole. The Project encompasses approximately

20,000 acres of Federal land owned and operated by the U.S. Army Corps of Engineers, Alaska

District.

DESCRIPTION OF WORK: All areas will be cleared of trees and brush under this contract as specified.

All trees and brush less than 6-inch diameter breast height will be completely masticated to chips no larger than 3 foot long by 3 inches wide and left on site. Tree species vary from pure to mixed stands of white birch, balsam popular, white spruce, black spruce, tamarack, willow, and alder.

The Contractor can expect to encounter soft, boggy ground and standing water within the treatment areas where equipment access may be difficult. Birch stands are heaviest on the north half of the Project with balsam poplar and aspen found more prevalent on the south end. Only birch, balsam poplar, quaking aspen, and spruce trees will be salvaged for Corps distribution as public firewood.

All trees and brush in each area will be felled and masticated to ground level. Some large trees will be marked and designated “Leave Trees” and will not be cut or damaged. These “Leave

Trees” will be marked with “blue” tree paint at breast height. All birch, balsam poplar, quaking aspen, and spruce trees that are 6 inches diameter breast height and greater will be felled limbed and topped to a 4-inch diameter top and located in designated areas for public firewood. These firewood trees will be stacked in neat horizontal piles. Stacked piles will include no more than

30 trees per stack in areas where stem density is heavy. All tops within the area to be cleared will be reduced to chips. Trees felled outside the boundary of the area to be cleared will be dragged back in and chipped.

All areas may contains various water features, rocks, culverts, steel relief wells, PVC piezometer well pipes, concrete structures, steel structures, survey monuments and markers, ruts, and irregularities which will require working around.

Area 1 is located on the South end of the Chena Floodway downstream of the Sheet Pile Sill.

This area was cleared in 2009 and vegetation is a re-growth.

Area 2 is the East Cutoff Dike, a low crested saddle dam 5,600 feet in length and 5 feet in height that lies between Moose Creek Bluff and higher ground to the east. In addition to the saddle dam, 50-feet beyond the toe of the saddle dam shall be cleared.

The midsection of the saddle dam was cleared in late 2013, and does not require cutting. In the mid section, a 10 foot wide section on both side slopes was cut to the toe for about a half mile.

This area, about 10 acres, is not included in the bid schedule.

Salvage trees shall be stacked as indicated on either side of the crest.

About 25% of Area 2 is covered in grass, and does not require cutting. An estimated 5 acres has grass cover, and this acreage is not included in the bid schedule.

Area 2 contains marked Section corners, property corner monuments, dam crest monuments, and boundary stakes; all of these survey markers and any others encountered shall be protected from damage. Any damaged or destroyed marker/monument shall be replaced at the Contractor’s expense.

Area 3 is the South Seepage Collector road berm, west side, which runs from the Project Office to the weir at the Chena River and includes the area 5 feet out from the toe. The drawing titled

“South Seepage Collector Road” shows the road side slopes, which vary between no slope and

63 percent near the Chena River weir. Stationing starts as 0+00 feet at the Project Office and ends at the Chena weir.

Salvage trees shall be stacked on the mowed bank of the seepage collector channel, on the opposite side of the road as the work area.

Area 4 is at the North Pond and designated vistas; clearing provides access for disabled veteran moose hunters. This area was cleared 8 to 10 years ago, and is covered with a re-growth of vegetation.

SITE INVESTIGATIONS AND REPRESENTATIONS: It is highly recommended that all bidders visit all treatment areas to aid them in their bidding process. The selected Contractor assumes responsibility for all investigations as to the nature and location of the work, the general and local conditions (particularly weather and season), the surface soil, snow, ice, and water conditions at the equipment staging and work areas, and those conditions having bearing upon access to the treatment areas. The Contractor assumes responsibility of considering in the bid: all uncertainties of weather, flood/ground water stages, topography including conditions of the ground, the character of equipment and facilities needed preliminary to and during prosecution of the work, and all other matters upon which information is reasonably obtainable and which can in any way affect the work or the cost thereof under this contract. Any failure by the Contractor to acquaint himself with all the available information will not relieve him from responsibility for estimating properly the difficulty or cost of successfully performing the work. The Government assumes no responsibility for any understanding or representations made by any of its officers or agents during or prior to the execution of this contract, unless (1) such understanding or representations are expressly stated in the contract and (2) the contract expressly provides that the responsibility therefore is assumed by the Government. Representations made but not so expressly stated and for which liability is not expressly assumed by the Government in the contract shall be deemed only for the information of the Contractor.

EQUIPMENT REQUIREMENTS:

Equipment shall be capable of completing all of the requirements of this scope of work.

Equipment required for this contract shall be capable of efficiently and safely masticating trees and brush into chips not larger than 3 inches wide by 3 feet long. Equipment shall be capable of skidding, lifting, and stacking felled and sawed trees in full tree lengths at several locations without excessive damage to the soil. Due to the potential of equipment downtime, the

Contractor should anticipate and plan for additional equipment and repair time in order to complete the job in a timely manner. Contractor shall coordinate work with Mr. Tim Feavel, Project Manager, at (907) 488-2748.

JOB COMMENCEMENT AND COMPLETION: Work periods for this contract are from award to 30 April 2014 and from 16 July 2014 through 15 October 2014. No work is permitted from 1 May to 15 July due to the presence of migratory birds. The Contractor shall determine the length of his workday. Weekend and holiday work will be permitted. If the Contractor is unable to complete the job due to unforeseen circumstances, such as impoundment of floodwaters, payment will be made for work based upon the Corps’ measurement of acreage cleared and the bid price per acre. Determination of cleared acreage completed will be accomplished using geographic information system data developed from global information system measurements.

Failed or inadequate equipment will not be treated as an unforeseen circumstance. This contract may be terminated for convenience or default if there is a failure to perform.

ACCESS: The Corps will supply to the Contractor all necessary keys to access the tree and brush clearing areas. The Contractor will be permitted to park a travel trailer and support equipment in the clearing area for the duration of the job if desired. Equipment may also be secured inside the Project Office compound; however, overnight habitation within the compound will not be permitted. All tree clearing and support equipment must be removed from Project lands within two weeks after the completion of the job. The Contractor will be required to move any and all equipment out of the contract area at the direction of the Project Manager in the event of any water impoundment.

SAFETY PLAN: The Contractor shall submit a written safety and accident plan to the Corps

Project Manager 7 days before the pre-work conference to be scheduled in coordination with the

Contractor and held at the Chena Project Office, 3800 Laurance Road, North Pole, AK 99705.

The plan will be prepared in accordance with EM 385-1-1 Accident Prevention, and specifically address emergency communications in the field, an emergency contact list, first aid preparedness, personal protective equipment, equipment fueling, fire suppression and public safety considerations.

PRE-WORK CONFERENCE: The Contractor and the Corps Project Manager, or his authorized representative, will meet at the Project Office at least 3 days prior to the commencement of the work to inspect tree and brush clearing equipment, review contract requirements and evaluate/discuss the Contractor’s safety plan. This pre-work conference shall be scheduled during Project Office work hours, 7:30AM to 4:00PM Monday through Friday.

Pre-work Notice: a minimum of 3 days notice shall be given to the Chena Project Manager prior to the start of any work.

BASIS FOR CONTRACT EVALUATION AND AWARD: This contract will be awarded to the offeror with the lowest price and a technically acceptable proposal. The Contractor’s proposal shall address the following:

1. Brief clearing procedures that describes the equipment (make, model, year, type), work hours, labor and work procedures to clear the four areas in the timeframe provided and on the terrain indicated. Equipment should be described in sufficient detail to ensure it is well maintained and capable of clearing the types of vegetation on the terrain indicated.

Proposals shall be rated as either “acceptable” or “not acceptable” based on the Contractor’s demonstration of providing the proper equipment, labor, and management to complete the tasks described in the scope of work. Proposals shall not exceed 5 pages in length.

1. OVERVIEW

1.1 Purpose. The purpose of this plan is to identify the methods and procedures the

Government will use to ensure it receives the services under contract as identified in the

Statement of Work (SOW). This plan will focus on the level of performance required by the

SOW, not the methodology or process.

1.2 Intent. The intent of this plan is to rely on the Contractor’s quality control, thus changing the Government’s role from “oversight” to “insight”. Performance Objectives (PO) will be periodically monitored and the quality program evaluated but the Contractor is left as free as possible to develop the most efficient methodology to meet and exceed the required thresholds of service.

2. DESCRIPTION OF SERVICES

2.1 Scope of Work. Non-Personal Services: The Contractor shall furnish all labor, equipment, materials, supplies, transportation, fuels and other items necessary to clear and remove or chip trees and brush within an area of approximately 53 acres. These 53 acres include four separate treatment areas located within or near the Chena River Lakes Flood Control Project, are designated Areas 1, 2, 3, and 4, and described below. All trees and brush will be felled and masticated to ground level as prescribed. All services requested under the SOW are non-personal in nature.

2.2 Contract. This contract is a Firm-Fixed-Price (FFP) contract for Tree and Brush Clearing services. The Inspection of Services FAR Clauses 52.246-4 applies.

4. CONTRACT QUALITY REQUIREMENTS

4.1 Quality Program. The Contractor's Quality Control Program requirements are defined in in the SOW. The Contractor shall develop, maintain, enforce and document a Quality Control

Plan (QCP). The QCP shall ensure the Government receives the level of quality that is consistent with the requirements specified in the contract. The Quality Control Plan will be submitted with the award proposal and accompanying Scope of Work.

5. PERFORMANCE ASSESSMENT APPROACH

5.1 Purpose. This section details the method(s) used to verify Contractor compliance with

SOW requirements. The key elements of this process are the Contractor's quality program and

Government identified Performance Objectives. The Performance Objectives from Paragraph

7.0 of this Quality Assurance Surveillance Plan (QASP) dictate the minimum inspection requirements Quality Assurance Evaluators (QAE) must accomplish on a periodic basis. This

QASP provides the procedures on how to conduct the evaluations for Performance Objectives and how to document them in a correct and effective manner.

5.2 Performance Assessment Approach. To facilitate the Performance assessment of the

Contractor's quality program, Government representative(s) will verify Contractor compliance with designated Performance Objectives. The intent of the Performance assessment approach is to gain confidence in the Contractor’s ability to provide satisfactory services.

5.3 Annual Review. The COR must review QASP Performance Objectives, assess their applicability and recommend the addition or subtraction of Performance Objectives as conditions warrant. This review must be accomplished annually as a minimum.

5.4 Special Audits. The COR must be alert to conditions that would warrant a special quality audit. Any time the COR observes that a functional area is out of acceptable performance or that the technical expertise is not available, a request for a quality audit should be addressed to the

Contracting Officer.

5.5 Section 1. Approved QUALITY ASSURANCE SURVEILLANCE PLAN (QASP).

5.6 Section 2. CONTRACTOR’S QUALITY CONTROL PLAN (QCP).

5.7 Section 3. ACTIVITY LOG. A chronological log of actions taken in the accomplishment of Quality Assurance assigned Performance Requirements. The purpose of this log is to provide a brief synopsis of an inspection of Contractor provided services or a meeting/conversation with the contractor regarding SOW performance in a given functional area.

5.8 Deficiency Identification. Effective contract Performance assessment relies on two methods for identification of unacceptable performance – Contractor Identified Discrepancies and Government Identified Discrepancies.

5.6.1 Contractor Identified Discrepancies (CIDs). Generated when contract employees detect discrepancies during performance of routine daily services or through the contractor’s

Quality Control Program. When reviewed by the applicable representative, that person will take the following actions:

5.6.1.1 Review corrective actions taken by the contractor to resolve a discrepancy.

5.6.1.2 Determine whether the discrepancy has been corrected. If the discrepancy has been resolved, review the corrective action taken and any applicable procedures the contractor has established to preclude recurrence of the problem.

5.6.1.3 If not been resolved and the Contractor has established an Estimated Completion Date for resolution of the discrepancy, the representative will monitor the Contractor’s efforts in resolving the discrepancy. If it is determined the estimated completion date for resolution of the discrepancy is excessive based on the nature of the discrepancy, the Contracting Officer (CO) will be notified. The Government can then evaluate the recommendation to determine the appropriate course of action.

5.6.1.4 If not resolved and the COR determines that the Contractor has not established a resolution of the discrepancy or has failed to perform a follow-up action for resolution of a discrepancy, the COR will issue a report. The Contractor will be given a suspense date to provide corrective action to the Government’s findings and describe the Contractor’s plan to preclude repeat deficiencies.

5.7 Government Identified Discrepancies. Generated as a result of inspection of contractor performance that identifies noncompliance with contractual requirements. The Contractor will be given the opportunity to show whether the discrepancy has already been identified and in work.

6. PERFORMANCE ASSESSMENT DOCUMENTATION

6.1 Corrective Action Report (CAR) Used by QAP to document contract requirement findings and subsequent corrective actions to be taken. A computer-generated CAR may be used provided the information on the CAR remains the same. See attached CAR and instructions for filling it out.

6.1.1 The individual identifying the discrepancy is responsible for completing the CAR utilizing the instructions attached. If there are other questions as to how the CAR is completed, that individual should consult the COR.

6.1.2 Consult the assigned contract COR/Government Representative to give them the opportunity to assist and advise how the CAR is to be worded..

6.1.3 The CAR Issuing Authority will elevate any CARs that cannot be resolved with the contractor to the Government Contracting Officer for resolution.

6.1.4 Categories of Findings. A finding is any Government-identified noncompliance with contract requirements that specifies that an activity or action did not take place or was not performed to the quality or timeliness standard required by the contract or Task Order. A finding can be categorized as either Major or Minor. Major/Minor Findings are defined as follows:

6.1.4.1 Major Finding. A conclusion that identifies a condition having a significant adverse effect on the quality of the activity under review such as:

a. Failure to meet a Performance Threshold.

b. Significant mission degradation in any Contractor operated function.

c. A situation that is likely to result in hazardous or unsafe conditions for individuals

(or any other Government resource) coming into contact with the work.

d. Failure to provide adequate corrective action to preclude reoccurrence of

Government identified findings.

e. Failure to provide corrective action to deficiencies identified by the Contractor within a prescribed suspense period

f. Any failure to adhere to security regulations that results in a security incident.

6.1.4.2 Minor Finding. A departure from established standards having little bearing on service provided. However, if the same minor finding is repeatedly identified, it may be an indication that Major Finding (d) above is occurring or has occurred because the contractor quality system has not acted to prevent recurrence. In this case, the Minor Finding should be elevated to the level of a Major Finding and a new CAR initiated.

6.2 Performance Assessment Log. COR/QAR must document Performance assessment as it is accomplished. The Performance Assessment Log is an official government record of inspections of the performance objectives and other inspection items contained in this QASP.

6.2.1 The Performance Assessment Log is locally developed. A sample is attached to this

QASP as an example. It must contain the following items as a minimum:

6.2.1.1 Contract No. – self-explanatory.

6.2.1.2 Contract Requirement – functional area of inspection, if always the same area, just fill in the first block on each page.

6.2.1.3 Contract Paragraph Number - enter the contract paragraph number of the critical operational requirement.

6.2.1.4 Method of Performance Assessment – if inspections were conducted in accordance with the QASP, enter “IAW QASP.” If the inspection method deviated from the procedures of the

QASP, indicate what inspections were completed.

6.2.1.5 Date Accomplished/Initial – enter date accomplished and initial to show verification that the performance assessment was accomplished. An electronic initial is acceptable if the

Performance Assessment Log is maintained in soft-copy form.

6.2.1.6 Where Accomplished – enter location where inspections were accomplished. If always the same, one entry in the first block of each page will suffice.

6.2.1.7 Compliance – enter the results of the inspection. If applicable, list control number(s) of any CARs.

6.2.1.8 Date Next Due – Enter the date the inspection is next due. This will serve the purpose of showing, at a glance, status of inspection activities.

6.2.1.9 Completed Performance Assessment Logs will be maintained until such time as they are stored in the contract administration files with the USACE Contracting Division.

7.0 Performance Objectives. The following is a list of the contractual Performance

Objectives to be validated by the Government. Each Performance Objective includes a government-determined Performance Threshold and is used to perform the verification. The

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Offers will be technically evaluated in accordance with the requirements set forth in the Performance Work

Statement. Award will be made to the lowest-priced technically acceptable offeror. The Government reserves the right to make award on the initial offer received without discussions. The following factors will be used to evaluate proposals:

The combination of technical evaluation criteria Technical Capability - Equipment and Technical

The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JULY 2013)

An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via https://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily https://www.acquisition.gov/ business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. Inverted domestic corporation, as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United

States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C.

(4) FSG 89, Food and Related Consumables;

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the

Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment

Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

(50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
