The Government intends to use obtained past performance results from the CCASS/CPARS database.

Information on significant problems encountered, customer dissatisfaction, and corrective actions taken should be provided. In the event that no record of relevant past performance exists, the Offeror’s past performance will be evaluated neither favorably nor unfavorably.

For non-DoD work. The Past Performance Questionnaire included in the solicitation is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 2 “Past Performance for the Prime Contractor”. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Attachment B), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Christine A. Dale via email at christine.a.dale@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also include performance recognition documents received within the last five years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

For DoD projects submitted under Factor 2 “Past Performance for the Prime Contractor”, the Government will rely on finalized

Construction Contractor Appraisal Support System (CCASS) or Contractor Performance Assessment Reporting System (CPARS) Reports. In addition, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Information on significant problems encountered, customer dissatisfaction, and corrective actions taken should be provided. In the event that no record of relevant past performance exists, the Offeror’s past performance will be evaluated neither favorably nor unfavorably. Past performance includes: the company’s record of conforming to contract requirements and standards of good workmanship, the firm’s adherence to contract schedules including the administrative aspects of performance, the firm’s history of reasonable and cooperative behavior and commitment to customer satisfaction on past projects and the firm’s general business-like concern for the interest of the customer.

The Government will evaluate how effectively and completely this section discusses past performance as shown in the table below:

FACTOR 2 PAST PERFORMANCE ACCEPTABLE/UNACCEPTABLE

VOLUME II – PRO FORMA REQUIREMENTS AND PRICE PROPOSAL

The Offeror shall submit in Volume II the price information described below to be evaluated. Volume II will not be point scored but will be subjectively evaluated to determine the reasonableness, affordability, and value of the price data. The price proposal shall be organized sequentially under tabs to facilitate evaluation, and shall include the following:

A. Standard Form 1442 signed by the Offeror with amendments acknowledged.

B. Proposal Schedule/Price Information. The price information supporting the Technical Proposal shall be in the form of the proposal schedule contained in the front of this solicitation. Include Corporate Certificate.

C. Completed Section 00 45 00, Representations and Certifications

D. Pre-award Survey/Bank Reference E. Letter from their bonding company indicating the Offerors ability to obtain performance and payment bonds in the amount of their proposal price.

The Government will evaluate those factors as follows:

FACTOR 3 PRICE (Standard Form 1442, Proposal

Data Sheet, and Contract Line Item Schedule)

LOW PRICE

N/A Required Pre-Award Information NOT RATED

1. RELATIVE IMPORTANCE OF THE EVALUATION FACTORS

The relative importance of the evaluation factors (Capability and Process, and Past Performance) are equal. The Government considers the non-price factors to be approximately equal to price.

2. EVALUATION PREFERENCE: All Hubzone firms submitting as prime contractors will be provided a price evaluation in accordance with

FAR Clause 219-4. (Section 00 45 00).

3. THE DETERMINATION OF BEST OVERALL VALUE

The firm that is rated acceptable for all Factors and with the lowest overall price will be rated as the Best Value to the Government.

RELATIVE IMPORTANCE OF INDIVIDUAL EVALUATION FACTORS

Volume I (non-price)

The relative importance of the evaluation factors (Capability and Process, and Past Performance) are equal.

Volume II (price and pre-award requirements)

PRICE

The Government will perform a price analysis and evaluate each proposed price by comparing it against other proposed prices, the average of the Offerors, the Government estimate, available funds and affordability.

The Government will also evaluate each line item as priced to ensure no individual item is priced unrealistically high or low. In accordance with FAR 52.215-1 Instructions to Offerors - Competitive Acquisition (Jan 2004) para. (f)(8), “The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.”

4. EVALUATION PROCEDURES

a. SOURCE SELECTION EVALUATION BOARD (SSEB)

The SSEB will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal and any subsequent discussions required, as well as information obtained from other sources, e.g.

past performance information. The SSEB will not consider any information incorporated by reference, except as expressly allowed by this solicitation.

b. EVALUATION

1) The SSEB will evaluate the proposals and assign a consensus rating for each evaluation factor and subfactor.

2) The Government intends to award without discussions. Offerors are cautioned to put forth their best efforts, and to furnish all information clearly to allow the Government to evaluate proposals. Offerors should not assume that they will have an opportunity to clarify or correct anything in their proposal after submitting it.

3) A “Competitive Range” is a subjective determination of the acceptable proposals in the event that the Government decides that discussions with Offerors are required or are considered to be in the Government’s best interests.

4) If discussions are held, the Government may engage in a broad give and take with those Offerors in the competitive range, in accordance with FAR 15.306(d). During discussions, the Government may ask the Offeror to further explain its proposal and to answer questions about it.

5) Upon conclusion of discussions, those Offerors still considered acceptable will be afforded an opportunity to submit their proposal revisions for final evaluation and selection.

c. DEFINITIONS

1) Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

2) Strength: Any aspect of a proposal when judged against a stated evaluation criterion enhances the merit of the proposal or increases the probability of successful performance of the contract.

3) Significant Strength: A significant strength appreciably enhances the merit of a proposal or appreciably increases the probability of successful contract performance.

4) Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.

5) Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.

6) Uncertainty: Any aspect of the proposal for which the intent of the Offeror is unclear because there may be more than one way to interpret the offer or because inconsistencies in the offer indicate that there may be an error, omission, or mistake.

7) Deviation: Proposal implies or specifically offers a deviation below the specified criteria. The Offeror may or may not have called the deviation to the Government’s attention. A deviation is a deficiency. The proposal must conform to the solicitation requirements for award.

d. EVALUATION AND RATING SYSTEM

General: The Government will review the proposals and rate the quality of each evaluation Factor and subfactor (if any). The SSEB will rate each proposal against the specified evaluation criteria in the Solicitation requirements. They will not compare proposals in terms of technical requirements.

Review Write-up: The Government will support each rating with a narrative, separately listing all strengths, weaknesses, deficiencies, and required clarifications.

Rating System: After listing proposal strengths, weaknesses and deficiencies, the SSEB will assign an adjective rating of “Acceptable” or “Unacceptable” to each Factor and subfactor, which reflect the Government's confidence in each Offeror's ability, as demonstrated in its proposal, to perform the requirements stated in the RFP. The adjectival ratings shall be assigned using the following criteria, which incorporate a proposal risk assessment:

Capability and Process:

Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Past Performance:

Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner.

There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements.

The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.
