Offeror Questions and Answers Solicitation No. W911KB-09-R-0043

International and Interagency Support Indefinite Delivery Type (IISIDT)

Contractor Questions (Q=Question A=Answer) Past Performance Surveys Deliverable

Q1. After reviewing the RFP, it’s our conclusion that Volume 1 Tab B of our proposal will be blank when provided to the COE and that you will fill in this tab with the past performance surveys that are faxed into you. Is this understanding correct?

A1. Yes, unless you want to submit additional information.

Q2. May our past customers submit the Past Performance Evaluation Questionnaire to you via e-mail, or do you prefer fax?

A2. Email is preferable, but, fax is fine Summary Answer: Volume 1 Tab B will be blank, unless the Offeror would like to submit additional information other than the past performance surveys received by COE. Delivery of Past Performance Evaluations Questionnaires from reference is prefer via email, but fax is acceptable.

Past Performance Surveys Page Limits

Q3. Is there a maximum and/or minimum number of past experience projects assigned to Volume 1 Tab A?

A3. No

Q4. Are the faxed in performance surveys counted against the 30 page limitation of Volume 1?

A.4. No

Q5. On page 22 of 73, Part III: Proposal Submittal Requirements, paragraph 6 says Volume 1 may be up to 30 pages (including table of contents, charts, other tables and the summary). Then on page 26 of 73, Volume 1 – Technical Proposal, Tab B – Past Performance, we are directed to submit the Past Performance Evaluation Questionnaire (3 pages each) as part of our package. Are we to get these back from our customer/clients even though they are sending them to your attention, 10 days prior to the proposal due date and then submit them with our Volume 1?

A5. Past Performance Questionnaires should be returned directly from the evaluator but may be included in the proposal without counting against the 30 (now changed to 40 per this amendment) page maximum.

Q5a. If so do these 15 pages count towards our 30 page total? We have 5 customer/clients submitting on our behalf.

A5a. Past Performance Evaluation Questionnaires do not count toward the 30 (now changed to 40 per this amendment) page limit. They may be included for reference if desired, however, there are to be sent directly from the evaluator.

Q5b. If not, do we need to submit a page referencing them under Tab B – Past Performance?

A5b. No - note in Table of Contents.

Q5c. If we submit a page referencing them under Tab B – Past Performance does that page count towards our 30 page total?

A5c. No.

Q6. If it is considered part of the 30 pages total for Volume 1 that only leaves us with 5 pages left for Tab C – Understanding of Requirement. Is this correct?

A6. See response to Q6c.

Q7. Is the proposed Safety Program to be considered part of the 30 pages total for Volume 1? As a point of reference, our corporate Safety Program is in excess 300 pages.

A7. This amendment includes Spec Section 01 35 36 for reference and well as clarifying that the intent is a narrative describing the safety program, not the submittal of a corporate safety program.

Q8. We have noted that the 30 page limit for Volume 1 excludes the Certificates and resumes. Does it also exclude those evaluations submitted in lieu of duplicating the requirement to owner(s)/client(s) under Tab B?

A8. Yes, see amendment language.

Q9. We have assembled a rather large team in order to accommodate the diverse requirements of this contract. In doing so we would like to submit a project example from each key member of the team. With each Project Experience Form beginning at 2 pages in length the number of pages for just one project example will consist of 2-3 pages. Are the completed Project Example Forms excluded from the page count? If they are not, we would request that this be consider or that the overall page count be extended.

Thank you.

A9. The Project Experience Forms (TAB A) does count against the proposal page limit. The limit has increased with this amendment to 40 pages.

Q10. On page 27, under the paragraph bolded “Safety,” Offerors are instructed to provide resume of SSHO meeting requirements of spec 01 35 29, paragraph 1.5.1.1, Site Safety and Health Officer. That spec does not appear to be included. Can you provide that?

A10. New Safety specifications are included in this amendment.

Q11. With respect to the CQC Personnel, spec 01 45 0400 29, paragraph 3.4.3, page 5, under the experience matrix, the qualifications state for several disciplines state: Graduate Civil Engineer or Construction Manger with 4 years experience in the type of work being performed. Our question is: may this individual have four years of project management experience in the type of work being performed, or does the individual need a construction management degree?

A11. It must be a person with a degree in civil engineering or construction management who has four years of experience in the type of work to be performed.

Q12. Page 15, paragraph 2 requires work plans based on two sample projects, and at page 28, under Part 2 Offerors are directed to apply a management plan to one of the projects. Are we to prepare two work plans and one management plan?

A12. TAB C – UNDERSTANDING OF REQUIREMENT Consists of Part 1 – their management approach to this contract and Part 2 – a Work Plan for one of the three project concepts. Page 15, paragraph 2 has been corrected.

Q13. For Volume I – Tab B; Please clarify whether copies of the blank Past Performance questionnaires and transmittal documents demonstrating submittal to the client should be included in Tab B. If these documents are to be included in Tab B, do they count towards 30 page limitation for Volume 1?

A13. Blank copies of the Past Performance questionnaires are not required. If Performance Questionnaires are provided (should be sent by the evaluator) they do not count against the 30 page (now changed to 40 per this amendment) maximum.

Summary Answer: Page limitation has been increased with this amendment from 30 pages to 40 pages. Past Performance Questionnaires are no counted towards the page limitation.

Projects/Concepts

Q14. Section 00100 – NOTES TO OFFERORS: item 2 (page 15 of 73) states “Additionally, a Project Work Plan will be prepared by bidders based on 2 sample projects.” Section 00120, Paragraph III, Volume I – Technical Proposal, Tab C – Understanding of Requirement, Part 2 (page 28 of 73) states “Offerors will apply their management approach from Part 1 to one of the three included project concepts.” Please clarify if we are to apply our approach to 2 (two) or to 1 (one) of the sample projects?

A14. Section 00120 is correct. Tab C, Part two requires Offerors to choose 1 of the three project concepts provided.

Q15. The following questions relate to the concept projects:

Q15a. Does the Offeror need to submit a concept for each of the three (3) conceptual projects contained in the RFP?

A15a. Select 1 of the three Concept Projects included.

Q15b. May the Offeror submit on an individual conceptual project or on multiple conceptual projects?

A15b. Select 1 of the three Concept Projects included.

Q15c. Does the Offeror need to price the conceptual projects?

A15c. No

Q16. On Page 15 of the solicitation; Notes to Offerors (2) states that work plans will be prepared by Offerors based on two sample projects. This contradicts with the top paragraph on page 28 which requires writing a work plan for one of the three included project concepts. Please clarify whether a work plan is required for one or two projects.

A16. Offeror is to select One (1) from the three project Concepts.

Summary Answer: Select one of the three concept projects.

Direct Labor Rates Q17. The following questions relate to Section 00100 – Bidding Schedule / Instructions to Bidders, found on pages 13, 14, and 15 of the RFP:

Q17a. What is the definition of "Principle" as it applies to this solicitation?

A17a. “Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a subsidiary, division, or business segment; and similar positions).

Q17b. What is their definition of Senior Associate as it issued under the "Management" heading?

A17b. "Senior Associate" under the Management Heading is removed from the Labor Rate Sheets by this amendment.

Q17c. Under "Estimating", is that intended for a member of the contractor's staff or a person outside the contractor’s or the design consultant’s staff?

A17c. Estimator was intended to be a supporting contractor performing estimation services as a result of a task order requirement. It is not intended to replace the proposal or bid preparation procedures or roles.

Q17d. Labor costs differ by location. This RFP covers a broad area including international locations. How should the Offeror address this difference in labor costs as it relates to the bid schedule found on pages 13, 14, and 15? Is it permissible to submit a separate schedule for the different geographical locations covered by this RPF?

A17d. Labor Rates should be base hourly adjusted direct rates before per diem or remote/regional differential.

Q18. On Page 15 of the solicitation; Notes to Offerors (2.) states that cost proposals or unit rates will not be required under this proposal. This contradicts the requirements under Volume II submittal. Please clarify whether unit rates are required.

A18. Notes to Offerors is corrected per this amendment.

Q19. Please define “direct charge labor rates” as requested in Section 00100. How are general contractor overhead rates to be accounted for or separated from typical consulting positions? Total Cost Input or Value Added GA&A Cost Accounting methods will produce very different labor rates.

A19. Direct Labor Rates will be the burdened hourly rate before applying OH, G&A. The labor rate sheet is modified in this amendment to distinguish the Prime Contractor’s staff/Construction Contract Management Staff from A-E and support services subcontractor support. (Only “Management” is Prime Contractor’s staff/Construction Contract Management Staff while all others relate to A-E services role and should reflect the labor rates of those consultants.) Staff of the prime contractor, or construction subcontractors, in the disciplines listed under A-E and Support Services will not be subject to the rates submitted in the proposal.

Q20. DV Contracting Services (DVCS) intends to use a sub-consultant for this contract, are we still required to provide labor rates for the services provided by a sub-contractor/sub-consultant in Section 00100, IDIQ Labor Rates?

A20. Yes

Q21. Should the Section 00100 IDIQ Labor rate table include profit and overhead?

A21. No

Q22. Please clarify, how will the Government apply the labor rate table against the 3 dummy projects? Is the labor rate table even a consideration in the evaluation of the dummy projects?

A22. A Cost estimates for the selected (1 of 3) project concept is not requested.

Only a work plan is required for one of the three project concepts.

Q23. The labor rate tables don’t include construction labor rates. Should the contractor provide labor costs as part of the dump project proposal?

A23. There are no labor cost are required for the dump project proposals, only a work plan is required.

Q24. How will the government address construction labor rates on the individual task orders?

A24. Task orders will generally be competed amongst the awarded contractors.

Davis Bacon Rates are required under this contract. In the event of a negotiated procurement, Davis Bacon rates are applicable and proposals should be based accordingly.

Q25. What scope should the contractor anticipate for the interpretative design?

A25. No interpretative design is required.

Q26. Under the Estimating portion of Section 00100, IDIQ Labor Rates; does this section apply to actual construction estimating efforts? Or are these rates for validating an estimate? Do the persons that perform these tasks need to be familiar with the Corps MACES or TRACES estimating system?

A26. The estimation labor rates are only for professional estimation services as required under a specific task order. These do not replace your proposal – bid processes.

Summary Answer: The labor rate sheet is modified by this amendment to distinguish that the only rates request are for the Prime Contractor’s Management Staff (or subcontract support to perform construction management) and the Professional Services performing design phase services. Construction Contractor’s staff performing estimating activities are not subject to these rates, nor is a Mechanical Engineer performing non-design roles.
