ADDENDUM TO FAR 52.212-1
ADDENDUM TO FAR 52.212-1, INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS
(a) FAR 52.212-1 Addenda
(1) FAR 52.212-1, paragraph (b), Submission of Offers, is changed to read:
The offeror’s quote shall be submitted electronically by the date and time for receipt of offers indicated in the solicitation. These instructions prescribe the format for the quotation and describe the approach for the development and presentation of your information.
The offeror’s quote shall contain Controlled Unclassified Information (CUI) markings in accordance with DoD
Instruction 5200.48. CUI markings and dissemination controls indicate that the offeror provides adequate security to safeguard CUI information that resides on or is transiting through the offeror’s internal information system or network.
These instructions generally describe the type and extent of information you should provide and emphasize the significant areas you should address in your offer. It is imperative that offerors complete all documents and provide all necessary documentation as required by this solicitation. Failure to follow these instructions may result in the
Government not being able to properly evaluate your response. As a result, you may be removed from consideration for award. The quote shall be clear, concise, and shall include sufficient detail for effective evaluating and for substantiating the validity of stated claims. The qoute should not simply rephrase or restate the Government’s requirements, but rather shall privet convincing rationale to address how the contractor intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their experience and will base this evaluation on the information presented in the quote. Elaborate brochures or documentation, detailed artwork, or other embellishments are unnecessary and are not desired.
(2) FAR 52.212-1, paragraph (c), Period for acceptance of offers, is changed to read:
Acceptance: The Government may accept an offer (or part of an offer) before the offeror’s specified expiration time, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
All offers shall be valid at least 90 days following the solicitation close date.
(3) FAR 52.212-1, paragraph (e), Multiple Offers, is deleted in its entirety.
(b) General
(1) The Government intends to make award without discussions (except clarifications as described in FAR
15.306(a)). Therefore, the initial offer should contain your best terms, however, the Government reserves the right to make clarification or request revised responses if later determined by the Contracting Officer to be necessary. The
Government may reject any or all responses if such action is in the public interest and/or waive informalities and minor irregularities in your submitted offer. By responding to this solicitation and submitting an offer in response, the offeror understands that the Government will not be liable for any cost incurred by the offeror in preparation of their response.
(2) Solicitation Questions. To request the PWS, Interested offerors shall contact the Contract Specialist and
Contracting Officer and provide proof of SAM registration under NAICS 561710 and confirm they understand the requirement in FAR 52.219-14 for small business to perform at least 50% of the services.
Offerors may email questions regarding this solicitation to the Contract Specialist, SFC Michelle Royall
(michelle.r.royall.mil@army.mil) and Contracting Officer, Ms Natalie Rodriguez
(natalie.j.rodriguez9.civ@army.mil). The Government will answer all questions provided that the questions are received by 12:00 CST, 29 September 2022. The Government reserves the right not to respond to any questions received concerning this solicitation after the question receipt date and time above. Accordingly, Offerors are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the offer cycle.
(3) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of a offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract resulting from this solicitation. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.sam.gov.
(4) Late Offers. (i) Any offer, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) It was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) It is the only offer received.
(ii) However, a late modification of an otherwise successful offer that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(iii) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal
Government processes resume.
