ii. The Mission Capability Volume shall, at a minimum, be prepared in a form consistent with the evaluation criteria for award set forth in Section 00100 of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the offeror’s technical competence and ability to comply with the contract task requirements specified in Section 00800 and Division 1, General Requirements (Technical Exhibit A). The offeror shall be responsible for employing trained personnel to perform the requirements of the contract and subsequent task orders.

The plan shall clearly describe the work performed by subcontractors and teaming partners and explain any mentor/protégée agreements, partnerships, or joint ventures. This shall not limit the offeror's ability to propose alternative staffing solutions as long as these minimum requirements are met.

The QCM SHALL NOT HAVE OTHER DUTIES THAN QUALITY CONTROL. The primary responsibility of the QCM is to implement and enforce the Contractor's Quality Control Plan (refer to detailed quality control plan requirements at Division 1, General Requirements, Technical Exhibit A). There shall only be one QCM under the contract; the expectation is that the contractor shall provide sufficient quality control inspector staff to effectively and efficiently inspect all active projects on a daily basis. The quality control staff shall be capable of detecting construction violations in all construction phases and all disciplines to include, mechanical, electrical, plumbing, and civil quality/construction. The Government has determined that, in order to provide sufficient quality control under this contract, the contractor shall provide support in all four disciplines identified above. The quality control support staff shall be directly accountable to the QCM.

In the absence of the Project Manager, the Estimator shall prepare and negotiate project proposals. The Estimator shall have thorough knowledge of Government labor laws, the Wage Rate Requirements (Construction) formerly known as the Davis-Bacon Act, and the prevailing wage determination for the area. The Estimator shall also have the capability to supervise subcontractors and perform periodic construction inspections.

As a minimum, the COM should have extensive background in accounting and bookkeeping, be computer literate, a proficient typist. The COM shall be capable of dealing with all levels of management, contractor, subcontractor, and Government personnel. The COM shall be capable of establishing, managing, and maintaining file systems; be familiar with proposal preparation; know and understand the JOC concept and this contract’s requirements; have knowledge and understanding of Government labor laws and regulations as well as subcontractor payrolls. The COM should have the capability of acting as a purchasing agent and expeditor.

(4) Subfactor (c) - Notional Task Order Requirements: Attachment 4 and 4a provides a fictional workload scenario of five (5) notional task order projects that are typical of a JOC. Offeror shall provide a detailed proposal for each of the notional task orders that demonstrates the offeror’s ability to plan, schedule, and execute the work anticipated for the requirement. See Attachment 4 and 4a for further instructions regarding the submission under this subfactor.

c. Volume III – Past Performance

i. The Government will perform a Confidence Assessment of the Offeror’s past performance to arrive at a confidence rating. The Confidence Assessment represents the evaluation of an Offeror's past work record to assess the Government's confidence in the Offeror's probability of successfully performing as proposed. Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform. In addition, the offeror shall detail the percentage of work performed by each subcontractor or partner based on the total proposed price. The offeror shall submit, along with the information required in this paragraph, a consent letter (see Attachment 1), executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.

ii. The offeror shall include documentation regarding their relevant past performance as it directly relates to the work being procured under this solicitation. The offeror SHALL NOT go back any farther than six (6) years from the issue date of this RFP for the submitted data. The past performance data shall document a successful history of past contract performance. This volume has no page limitation. Relevant efforts are defined as services/efforts that are the same as or similar to the effort (as compared to NAICS code 236220) required by the RFP including work on an active military installation, work in occupied buildings, and work with same/similar state and federal construction codes. Projects considered relevant may include JOC, Simplified Acquisition Base Engineer Requirements (SABER) contracts, or Construction, Repair, Renovation, Sustainment, Restoration, and Modernization (SRM) contracts of at least $2 Million and a duration of no less than 60 days of performance. Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, teaming partners, and/or joint venture partners in alphabetical order. In the case of a joint venture, the prime offeror joint venture should demonstrate successful experience and past performance as that joint venture, not just as separate companies.

iii. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance Volume and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources. Offerors are reminded that both independent data and data provided by offeror in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offeror. Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government.

iv. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)) and, as a result, will receive an "Neutral Confidence" rating for the Past Performance factor. A strong record of relevant present and past performance may be considered more advantageous to the Government than a "Neutral Confidence" rating. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received.

v. Submission Requirements. The offeror shall submit a Past Performance Volume containing the following:

(1) Table of Contents

(2) Consent Letters (Attachment 1): Executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing the release of past performance information so the offeror can respond to such information.

(3) Client Authorization Letters: For each identified effort for a commercial customer authorizing release to the Government of requested information on the offeror’s performance under a specific contract.

(4) Organization Structure Change History: Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant present or past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of your company. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider present and past performance information provided by other sources as well as that provided by the offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.

(5) Specific Relevant Contracts Format (Attachment 2): is limited to four (4) pages per reference. The offeror shall provide documentation outlining the offeror’s past performance with contracts, as a prime or major subcontractor, which is the same or similar in nature, size, and complexity to the services being procured under this solicitation. The submittal shall include specific narrative explanation and rationale supporting objectives achieved and assertion of relevance and how it was determined that the work performed previously was the same or similar in nature, size, and complexity to the work specified by this solicitation. For any contracts that did not/do not meet original schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcomings and any corrective action(s) taken to avoid recurrence. The offerors shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. The offerors shall also provide a copy of any Cure Notices or Show Cause Letters received on each contract listed and a description of any corrective action implemented by the offeror or proposed subcontractor. The offerors shall indicate if any of the contracts listed were terminated and the type and reasons for the termination. Additionally, provide a narrative describing any litigation activity (i.e. bond claims, liquidated damages, insurance actions, or claims related to project performance, etc.) that the Offeror has been, or is currently party to involving its subcontractors, customers or any Surety within the past six (6) years. The narrative should include the Parties involved, the magnitude of the Claim and the resolution.

vi. Past Performance Questionnaire (Attachment 3): is for the contracts identified on each Specific

Relevant Contract Reference. The offeror shall forward a copy of the Past Performance Questionnaire to the points of contact responsible for monitoring performance under such contracts. The points of contact shall return the questionnaires directly to the usarmy.hood.acc-micc.list.418th-csb-joc@mail.mil not later than 15 August 2017.

Any questionnaires not returned directly to the usarmy.hood.acc-micc.list.418th-csb-joc@mail.mil will not be reviewed and evaluated. The information contained in the questionnaires will be used to evaluate the offeror’s past performance. New entities formed for the purpose of proposing on this solicitation (joint venture, teaming partners, or mentor protégé) that have no past performance history under that business arrangement are permitted to submit past performance information for the individual entities forming the arrangement.

d. Volume IV – Price

i. General. The Government reserves the right to require the submission of Other Than Certified Cost or Pricing Data as is deemed necessary to arrive at a fair and reasonable price. All Excel formulas, lookup tables, and links should be intact, and no links should exist to files not included with the submission. Excel workbooks should not contain hidden spreadsheets. PDF or flat files will not be considered adequate. Failure to comply with these formatting requirements may result in rejection of the proposal. Offeror’s submittals shall be free of viruses, Trojans, spyware, and other malicious code for which appropriate detection and removal/quarantine software exists.

ii. The basis for pricing this JOC is the use of a commercial cost estimating and project management software tool (e.g., WinEst, MS Project, e4Clicks) which employs a price modifier known as a coefficient. A coefficient is a numerical factor that is multiplied by the estimated project costs to derive the task order price to the Government. The coefficient includes a factor reflecting the contractor’s cost of doing business (labor, field overhead, corporate overhead, and profit) and a factor reflecting an evaluation of the accuracy of a contract-specified cost estimating tool to the local subcontractor/supplier market. This is generally done using a Unit Price Book (UPB) such as RSMeans, generally referred to as the “value of the book.” The Government uses e4Clicks as the RSMeans reference and estimator. All estimates shall be submitted using a commercial cost estimating software and shall contain all of the line items found in the RSMeans bound volumes. For this solicitation, the Government will provide a location for the contractor’s use on the installation, see Section 00800, Special Contract Requirements for additional details.

iii. Submission Requirements. The offeror shall submit a Price Volume containing the following:

(1) Bondability Letter: The offeror shall provide a letter from a qualifying surety that validates the ability to provide bonding at the contract’s program ceiling and specifies the offeror’s aggregate and single project limits, remaining bond capacity, and impact anticipated from the proposed contract. The program ceiling is $15 Million/year for $75 Million/5-year contract.

(2) Section 00010 (Solicitation Contract Form): Section 00010 shall be submitted fully completed and error free. It shall contain the offeror’s coefficient rates for the established Contract Line Items (CLINs).

(3) Development of Coefficient for Normal Working Hours (Attachment 5): The Development of

Coefficient for Normal Working Hours proposal for the CLINs X001 contained in Section 00010 shall contain all the specific narrative explanations used in deriving calculated coefficient (including appropriate references to individual spreadsheets as they appertain) to determine the Coefficient for Normal Working Hours. This narrative shall clearly explain the methodologies, calculations, exceptions, and assumptions used in developing the coefficient to include information to validate the assumed “value of the book” plus all cost inputs for direct labor, operating costs, field overhead, bonding, equipment, corporate overhead, profit, etc. See Attachment 5 for further instructions regarding the submission of the proposal for the CLINs X001.

(4) Development of Coefficient for Other than Normal Working Hours (Attachment 6): The

Development of Coefficient for Other than Normal Working Hours proposal for the CLINs X002 contained in Section 00010 shall contain all the specific narrative explanations used in deriving calculated coefficient (including appropriate references to individual spreadsheets as they appertain) to determine the Coefficient for Other than Normal Working Hours. See Attachment 6 for further instructions regarding the submission of the proposal for the CLINs X002.

(5) Development of Coefficient for Non-Pre-Priced (Attachment 7): The Development of

Coefficient for Non-Pre-Priced (NPP) items for the CLINs X003 contained in Section 00010 shall contain all the specific narrative explanations used in deriving calculated coefficient (including appropriate references to individual spreadsheets as they appertain) to determine the Coefficient for NPP. NPP items may arise from tasks not included at contract initiation, but are within scope. NPP work shall not exceed 10% of the contract value/task order. No task order will consist solely of NPP work. The offeror shall propose the indirect costs and profit rate to be used. Task order NPP items shall be proposed in bare costs only (material, equipment, and labor) multiplied by the quantity and the NPP indirect costs and profit rate of the contract to arrive at the total price for the NPP work. See Attachment 7 for further instructions regarding the submission of the proposal for the CLINs X003.

(6) Contractor Manpower Reporting: Offeror shall determine, for the CLINs X004, to price or not-separately-price the CMRA requirement. As part of its proposal, the offeror shall provide the estimated total cost (if any) incurred to comply with the enterprise Contractor Manpower Reporting Application (eCMRA) requirement. Instructions, including the Contractor and Subcontractor User Guides, are available at http://www.ecmra.mil.

Evaluation Factors for Award

A. Basis for Contract Award

1. This is a best value source selection conducted in accordance with FAR Subpart 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The Government will select the best overall offer that is determined to be the most beneficial to the Government, with appropriate consideration given to the following three evaluation factors: Mission Capability, Past Performance, and Price. A single contract may be awarded to the offeror who is deemed responsible in accordance with the FAR, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this solicitation) and is judged by an overall assessment of the evaluation factors and subfactors to represent the most advantageous offer to the Government.

2. All proposals will be evaluated for technical acceptability. Those proposals determined to be technically acceptable will be evaluated for past performance and price. The final award decision will be based on an overall tradeoff between past performance and price, or a Performance Price Tradeoff (PPT). Past performance is more important than price. THEREFORE, THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOWEST PROPOSED PRICE. Careful, full, and impartial consideration will be given to all proposals received in response to the solicitation. Award will be made on an all or none basis. The Government may select for award that offer in which the Total Evaluated Price (TEP) is not necessarily the lowest, but whose overall response is deemed sufficiently more advantageous to the Government so as to justify the payment of a higher price. Conversely, the Government may select for award the Offeror whose TEP is the lowest, when other responses are not sufficiently more advantageous so as to justify the payment of a higher price. The Government may reject any or all responses if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in the submitted responses.

3. Award for All of the Work: The Government intends to award a single Firm-Fixed-Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) JOC as a result of this solicitation. Offers received for less than the stated number of items listed in the Bid Schedule will be considered ineligible for award.

4. Award Without Discussions: As set forth in FAR 52.215-1(f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Accordingly, offerors are advised to submit initial proposals that are fully and clearly satisfactory without the need for additional information or explanation and contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the KO determines them to be necessary.

5. Competitive Range Determination: As set forth in FAR 15.306, in the event that discussions are held, a competitive range determination will be made. If the KO determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the KO may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

B. Evaluation Criteria

1. Evaluation criteria consist of factors and subfactors. The proposals will be evaluated under three (3) evaluation factors:

a. Factor 1: Mission Capability:

i. Subfactor (a): Technical Capability

ii. Subfactor (b): Proposed Staffing

iii. Subfactor (c): Notional Task Order Requirements

b. Factor 2: Past Performance

c. Factor 3: Price

2. All Factor 1, Mission Capability, subfactors are of equal importance. Any subfactor that receives an unacceptable rating will result in an unacceptable rating for the Mission Capability Factor and not be eligible for award. Failure of an offeror to provide required information pertaining to a factor or subfactor will result in a rating of unacceptable. An offeror must receive an overall rating of acceptable at the factor level to be eligible for award.

A proposal must be determined technically acceptable to be evaluated for past performance and price. The price will be evaluated to determine whether it is fair and reasonable.

3. All proposals will be evaluated by a team(s) of Government personnel. The Government’s evaluation team will use formal source selection procedures to evaluate each offeror’s capability to perform, and understand the solicitation requirements. The evaluation team will rate each proposal based strictly on the proposal contents and will not assume performance or expertise that is not specified in the offeror’s proposal.

a. Factor 1 – The Mission Capability: The Government will evaluate technical proposals to determine the offeror’s capability to satisfy the Government’s requirements. Under the Mission Capability factor, the proposal will be evaluated for meeting the following minimum standards:

i. Subfactor (a) - Technical Capability: The Government will evaluate the clarity, adequacy, and capability of the offeror’s described plan to: respond to the Government’s notification of a task order requirement;

the ability to estimate, prepare, submit, and negotiate a proposal; interface with the Government for informational, collaborative, and historical purposes; task order management including tracking high volume task orders simultaneously. The Government will evaluate the clarity, capability, and benefit of the offeror’s demonstrated resources, reach-back support in a timely manner, especially at times of increased workload in a compressed timeframe. The Government will evaluate the offeror’s narrative on the clear understanding and description of utilizing a unit price book. The evaluation will include determination of demonstrated ability for simultaneously managing multiple tasks at various stages without delays.

ii. Subfactor (b) - Proposed Staffing: The Government will evaluate the offeror’s proposed approach to determine whether it demonstrates adequate oversight for the performance of the contract and all task orders. To be considered to be technically acceptable, proposals shall consider the following positions to be the absolute minimum staffing requirements: Project Manager, Quality Control Plan Manager, Estimator, and Contractor Office Manager. The evaluation will encompass if the offeror’s staffing has met the minimum positions and qualifications that explains the work they are responsible for managing and accomplishing to include estimating support and other related administrative support functions. In order to be considered acceptable, the evaluation will include the assessment of the process for recruiting and replacing key personnel as vacancies occur, giving special attention to seasonal workload fluctuation, and the management of the work performed by subcontractors and teaming partners and the use of any mentor/protégée agreements, partnerships, or joint ventures.

iii. Subfactor (c) - Notional Task Order Requirements: The Government will evaluate the offeror’s response to…
