About this file

This document is a Standard Form 30 Amendment to a Request for Quote (RFQ) for medical and industrial gases for the Medical Readiness Command-Europe (MRC-EUR). The solicitation seeks multiple medical gases including liquid nitrogen, carbon dioxide, medical air, nitrous oxide, oxygen, and propane in various container sizes and purities. The government intends to issue single Indefinite Delivery/Indefinite Quantity (ID/IQ) contracts for Germany and Belgium, with an "ALL OR NONE" award basis per country.

The solicitation covers five ordering periods from October 2025 to September 2030, with delivery locations spanning multiple military healthcare facilities in Germany and Belgium. Quoters will be evaluated on three factors: Technical Capability (compliance with salient characteristics), Past Performance (relevant experience in medical gas deliveries), and Price. Quoters must be registered in the System for Award Management (SAM), provide pricing in Euros, and submit quotes electronically. The evaluation will use an acceptable/unacceptable rating method, with technical and past performance equally weighted when compared to price.

Addendum to Contract Clauses

Additional Information/Notes

The following clauses were modified:

52.212-2Evaluation-Commercial Products and Commercial Services.Oct 2021 hereby reads as follows:

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract(s) resulting from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

I. Technical Capability II. Past Performance III. Price

Technical and past performance, when combined, are equal, when compared to price.

. The Government will evaluate offers for award purposes by adding the total price for all (b) Options options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

Addendum to 52.212-1, Instructions to Offerors - Commercial Products and Commercial Services

Miscellaneous text in this section has been modified to:

The following paragraphs are hereby amended to read as follows:

Paragraph 52.212-1(a), North American Industry Classification System (NAICS) code and small business size standard. The small business size standards and any resulting set asides or preferences do

W9114F26QA0030001

not apply to this acquisition.

Paragraph 52.212-1(c), Period for acceptance of quotes. The quoter agrees to hold the prices in its quote firm for 120 calendar days from the date specified for receipt of quotes unless another time period is specified in an addendum to the solicitation.

Paragraph 52.212-1(e), Multiple quotes. Quoters are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.

However, acceptance of an alternative quote is a unilateral decision made solely at the discretion of the Government. Quotes that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

Paragraph 52.212-1(g), Contract issuance (not applicable to Invitation for Bids). The Government intends to evaluate quotes and issue a contract without discussions with quoters. Therefore, the quoter's initial quote should contain the quoter's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received. After evaluating quotes, if discussions are deemed necessary, the contracting officer may determine that the number of most highly rated quotes that might otherwise be included in the evaluation process exceeds the number at which an efficient competition can be conducted. In this event, the contracting officer may limit the number of quotes in the evaluation process to the greatest number that will permit an efficient competition among the most highly rated quotes.

Paragraph 52.212-1(h), Multiple awards. The Government intends to issue a single Indefinite Delivery / Indefinite Quantity (ID/IQ) contract per country (one for Germany and one for Belgium) from this Request for Quote (RFQ). Issuance will be on an "ALL OR NONE" basis per country. Quotes that failed to quote all prices in any of the countries will be rejected as nonconforming and unacceptable to the RFQ.

The following paragraphs are hereby added:

Paragraph 52.212-1(m) The non-FAR Part 12 discretionary FAR, DFARS, AFARS, and LOCAL provisions included herein are incorporated into this solicitation either by reference or in full text. If incorporated by reference, see provision 52.252-1 herein for locations where full text can be found. All questions received will be answered officially through an amendment for distribution to all prospective vendors.

Paragraph 52.212-1(n) Quoters shall ensure that the original RFQ's Standard Form (SF) 1449, Blocks 12, 17A (with quoter's name, address, telephone number and CAGE/NCAGE Code), and 30A through 30C, are completed in their entirety. Quoters shall also acknowledge each amendment by completing each SF 30, Blocks 8 and 15A through 15C, or submit the completed conformed document, if any amendments are issued. Documents shall be signed by corporate officer authorized to negotiation for the company. As an alternative quoters can submit the latest conformed copy (SF1449) which includes all amendments if filled out as described in this paragraph.

The following Technical Acceptable/Unacceptable Rating Method apply:

Rating Description

Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

FACTOR II - PAST PERFORMANCE

Note: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305). Therefore, the quoter will be determined to have unknown (or "neutral") past performance.

In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

The Contracting Officer will evaluate relevant past performance information of all quoters based on (1) the past and present effort provided by the Quoter and (2) data independently obtained from Government and commercial sources. Relevant performance includes performance of efforts involving deliveries of medical gases that are similar or greater in scope, magnitude and complexity to the effort described in this solicitation. The assessment process will result in an overall performance rating of Acceptable or Unacceptable as defined in the table below. past performance of subcontractors will be rated individually.

A past performance rating of either the quoter or its subcontractor of "Unacceptable" will result in the overall past performance rating being "Unacceptable" and therewith ineligible for award.

The following Past Performance Acceptable/Unacceptable Rating Method apply:

Rating Description

Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

FACTOR III - PRICE

(1) Prices will be determined reasonable based on adequate price competition. The determination of relative overall price to the Government will be established by totaling the quoted price for the entire ordering period.

(2) The total amount of all CLINS will be the total evaluated price for each quote.
