QUESTIONS AND ANSWERS

Question 1. Paragraph 7.16/Paragraph 52.212-2 SUBFACTOR 7: CONTINGENCY PLAN. Paragraph 7.16 requires the Contingency Plan to be submitted no later than 3 months following start of work; Paragraph 52.212-2 requires submission of Contingency Plan with solicitation proposal. Please clarify which is correct.

Answer 1. The contingency plan will be required to be submitted with the submission of solicitation proposal as stated in accordance with FAR Provision 52.212-2 – Evaluation. See revised PWS paragraph 7.16.

Question 2. Is there an incumbent on this effort? If so, what is the current contract number? If there is an incumbent, are the positions filled?

Answer 2. This a new requirement for PHC-E and LRMC.

Question 3. This paragraph contains sub-paragraphs that state resumes must be required to demonstrate knowledge and experience, however, no resumes are required in the evaluation factors. Are resumes required for this solicitation? If so, are resumes required for all personnel?

Answer 3. Resumes are required to meet the minimum requirements for LPTA under this solicitation, but they are not evaluated separately. Once minimum experience levels are met, it is deemed technically acceptable. Further, under Subfactor 1, it is captured as compliance with the minimum requirements of the PWS.

Question 4. Paragraph 2: This paragraph contains sub-paragraphs that state certifications must be required to demonstrate knowledge and experience and Addendum to 52.212-2 excludes certifications from page count. However, no resumes are required in the evaluation factors. Are certifications required for this solicitation? If so, are resumes required for all personnel?

Answer 4. Certifications are required in order meet the minimum requirements for LPTA under this solicitation, but not separately evaluated. Once minimum certification levels are met, it is deemed technically acceptable. Further, under Subfactor 1, it is captured as compliance with the minimum requirements of the PWS.

Question 5. Paragraph 7.4.1.2: This paragraph does not indicate that non-US citizens will be allowed temporary site access (with command approval) while awaiting results of Local National Screening Program (LNSP) checks. Is the Government willing to consider this?

Answer 5. The Government will consider temporary access on a case by case basis contingent upon its need and the situation. Each case will be reviewed on its own merits and should not be depended on.

Question 6. Paragraph 1.2.7/Paragraph 7.17/Paragraph 7.18.4: These paragraphs indicate SOFA status through DOCPER approval is expected, however, Paragraph 7.18.1.4 states logistical support is not provided. Please clarify if there will be an expectation of SOFA status.

Answer 6. No SOFA status will be required. See revised PWS paragraphs 1.2.7, 7.17.

Question 7. Paragraph 7.7.2: This paragraph specifies a limit of 20 days unpaid leave, and any leave in addition is a need-only/emergency basis. This seems to indicate that normal paid time off/leave is not allowable. Will the Government please clarify this?

Answer 7. The requirement for 1920 hours per FTE is inclusive of standard time off associated with a full 2080 work year. This statement is in the event additional time off under the 1920 requirement is needed. The Government will negatively rate (In CPARS or equivalent system) the awardee for approved hours below 1920 up to 160 years per annum.

Question 8. Paragraph 7.18.1.1: This paragraph indicates that a candidate denied SOFA status shall not be employed. This suggests that contracting companies who have the ability to do so will not be allowed to hire qualified Ordinarily Residents, thus dramatically reducing the candidate pool for this contract. Will the Government please clarify if candidates must meet SOFA status approval on this contract?

Answer 8. No SOFA status will be required. See revised paragraph 7.18.1.1.

Question 9. 52.212-2 SUBFACTOR 6: TRANSITION PLAN: A 2 week transition period is typically not possible for OR personnel in Germany, as German laws requires a minimum 30 days' notice to resign from a current employment. Additionally, the LNSP checks typically take more than 30 days. Is the Government willing to consider a minimum 45 day transition period?

Answer 9. See Revised Subfactor 6 in FAR Provision 52.212-2 Evaluation.

Question 10. Paragraph 2.3 states the Industrial Hygienist Must serve as an Industrial Hygiene Technician in the Public Health Command-Europe (PHCE) United States Army Garrison (USAG) Wiesbaden Industrial Hygiene Program Office (IHPO) under the qualifications. Is this to say that in order to qualify for the position, any candidate must currently serving in the position for this command, have experience in this position for this command, or is this simply stating that a candidate, once hired, will serve in this capacity?

Answer 10. See revised PWS Paragraph 2.3.
