At any time during the performance of this contract, the Contracting Officer, or COR may direct the Contractor to immediately remove any Contractor employee whose actions or impaired state raises reasonable suspicion that clear and present danger of physical harm exists to Government personnel or to the impaired individual. This provision will be used in emergency situations only and not for the purpose of bringing performance issues or other non-urgent concerns to the attention of the Contractor.

1.4.2. If, after any investigation deemed necessary by Government representatives and discussions with the Contractor's representative, the COR and Contracting Officer conclude that the Contractor employee impairment requires permanent removal from performance under the contract, the Contracting Officer will notify the Contractor that permanent removal is required. In the event of disagreements between the Government and the Contractor's representative concerning matters of impaired Contractor employee’s, the decision of the Contracting Officer will be final.

In the event that the tested samples reveal nonconformance with the quality standards of this PWS, equitable adjustments shall be made to compensate for lesser quality on the lots of gases represented by such samples.

1.5.2.2 The absence of any inspection requirements in the PWS shall not relieve the Contractor of the responsibility of ensuring that all products or supplies submitted to the Government for acceptance comply with all requirements of the contract. Sampling inspection, as part of manufacturing operations, is an acceptable practice to ascertain conformance to requirements, however, this does not authorize submission of known defective material, either indicated or actual, nor does it commit the Government to accept defective material.

5.12.1.3 Argon 99.999% / Methane 99.995%, 90/10 mix shall be Electronic Capture Device (ECD) quality. The Contractor shall accomplish delivery in accordance with the special handling and filling associated with ECD’s.

5.12.3.1 Gas Quality:

5.12.3.1.1 Impurities. Oxygen shall be free from all contaminants known toxicity to the maximum practicable extent. Oxygen shall contain no odor.

5.12.3.1.2 Moisture. Moisture shall not exceed 7 ppm of water vapor or a maximum dew point of -82 degree Fahrenheit when tested.

5.12.3.1.3 MEDICINAL GASES: Medicinal gases are identified as such in each CLIN and shall be of the grade/purity and quality as described in each individual CLIN and shall be delivered in conformance with requirements set forth in the DAB, EUAB and the “United States Pharmacopeia”, latest revision.

5.13 TALLY AND ACCOUNT:

5.13.1 The quantity of compressed liquefied gases furnished within any cylinder is equal to the weight difference in kilogram or pounds between the gross weight of the filled cylinder and the net weight of the empty cylinder. The conversion formula is as follows:

1 Kilogram (KG)= 2.205 pounds (lbs)
1 pound (LB)= 0.4536 kilogram

5.13.2 The content in liter or cubic feet (CF) or cubic meter (CZ) of compressed gas within any cylinder will be computed by multiplication of the water capacity of the cylinder (liter, CF or CZ) with its settled pressure (bar, 15 degree C).

SAMPLE: A 40 liter cylinder x 200 bar =8,000 liters or
8 cubic meters or 282 CF

THE FOLLOWING ACCOUNT IS ALSO ACCEPTABLE:

1,650 gal cylinder (44 liters water volume) at 150 bar = 230 CF
1,650 gal cylinder (44 liters water volume) at 242 bar = 353 CF
