------ADDENDUM TO FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021) ------
1. BASIS OF AWARD: This source selection follows the procedures outlined in FAR Part 13.
Offers will be evaluated based on criteria outlined in ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS. The Government will base the award decision on price and other factors. Noncompliance with the Request for Proposal (RFP) requirements may hinder the Government’s ability to properly assess the proposal, potentially leading to its elimination from further consideration for contract award. The contract will be awarded to the responsible contractor whose proposal conforms to the solicitation’s requirements (including all stated terms, conditions, representations, certifications, and other required information) and is deemed most advantageous to the Government.
2. Award for the Entirety of the Work: The Government intends to award one Firm Fixed Price (FFP) contract based on the complete specifications in the Statement of Work (SOW). Proposals that include fewer items or work than those listed in the specifications will be deemed ineligible for award. The Government plans to evaluate proposals and award the contract without interchanges with contractors. Therefore, contractors should submit their best terms in their initial proposal, considering both price and technical aspects. However, the Government reserves the right to conduct interchanges if deemed necessary by the Contracting Officer.
3. Evaluation Criteria: Proposals will be evaluated based on two factors and will be applied in accordance with the SOW:
FACTOR I - TECHNICAL: The proposal shall be evaluated to determine the offeror's ability and technical approach to satisfactorily accomplish the Government's intent and achieve the desired quality end-products. A proposal demonstrating an adequate understanding and approach to meeting the requirements will be deemed technically acceptable. If an offeror fails to meet the minimum requirements outlined in one of the two (2) subfactors below, the subfactor, and overall proposal will be rated “unacceptable” and will not be eligible for award.
Technical Ratings Ratings Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation
(i) Subfactor 1 – Prime Contractor’s Prior Experience: The prime Contractor shall be evaluated on provided evidence of at least five (5) years of experience within last seven (7) years from the closing date of the solicitation in maintenance and repair of scale. Relevant prior experience shall be the “same or similar” as determined by the U.S Government, for services on size, scope and complexity. The Contractor shall provide all necessary information of prior experience as a part of technical evaluation factor when submitting the proposal. The experience of a Subcontractor cannot be substituted for the Prime Contractor’s experience. The offeror shall provide evidence of relevant prior experience as required below:
- Title of the contract/project
- A brief description of work completed
- Amount of contract
- Complete name of point of contact for client organization.
(ii) Subfactor 2 – Key Personnel:
The Contractor shall be evaluated on provided evidence of an individual(personal) resume and copy of license both in English and Korean versions to demonstrate for each of the position titles listed in below;
a. Contract Manager (CM): The contract manager shall be evaluated on provided resume with at least five (5) years of experience within last seven (7) years from the closing date of the solicitation as a CM in maintenance and repair of scale and others, and possess valid and current license in Industrial Engineer Electronics (전자산업기사 자격증) and Industrial Engineer Precision Measuring (정밀측정 산업기사 자격증) issued by the Republic of Korea (ROK) Government.
- Name of Contract Manager
- Length of contract/project (year/month/date – year/month/date)
b. Technician(s): The technician shall be evaluated on provided resume with at least five (5) years of experience within last seven (7) years from the closing date of the solicitation in maintenance of equipment listed in paragraph 5.4 in Performance Work Statement and possess valid and current license Vehicle Machine Maintenance Technician Licenses (자동차기관정비기능사 자격증) issued by the Republic of Korea (ROK) Government.
- Name of technician(s)
- Length of contract/project (year/month/date – year/month/date)
FACTOR II - PAST PERFORMANCE: The past performance factor considers the Offeror’s demonstrated recent and relevant record of performance that meets the contract requirements.
Past performance will be evaluated on an acceptable/unacceptable basis.
Offerors are required to identify contracts, either commercial and government contracts for the same or similar services. The Government may ascertain past performance information on the Offeror from sources other than the contracts/references provided. The Government reserves the right to obtain past performance for other government reporting systems, including the Contractor Performance Assessment Reporting System https://www.cpars.gov/.
The offeror shall submit recent and relevant past performance in preventive maintenance and repair of scale and other equipment listed in in paragraph 5.4 in Performance Work Statement. Recent past performance shall be within the last seven (7) years as of the closing date of the solicitation. Relevant past performance are those that are the “same or similar” services based on size, scope, complexity, and contract type.
The Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
http://www.cpars.gov/
*NOTE: As part of the Responsibility Determination, the Contracting Officer will evaluate past performance to determine the offeror’s capability to perform the contract. Failure to submit data or lack of any performance history will not in itself be a reason for determination of non-responsibility. The Contracting Officer is not limited to the information provided. The Contracting Officer may use this data along with data obtained from other sources the Contracting Officer determines appropriate to obtain sufficient information on the offeror’s past performance to make a responsibility determination.
Factor III - Price: The proposal shall be evaluated using one or more of the techniques outlined in FAR 13.106-3 to determine whether it is complete and reasonable. A pricing proposal that is both complete and reasonable will be deemed acceptable.
A. Pricing shall be included for all CLINs and ELINs for each year and a total for all five years (Prices shall be in local currency-Korean Won). The proposal will be evaluated to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is consistent with performance described in the technical and management proposals. In order to perform price analysis, the Government requires that Offerors submit sufficient detail relative to direct and indirect rates, subcontracts, material, equipment, and other direct costs.
(1) Completeness: The Offeror shall complete the pricing information for each contract line item identified for each year and option year. (Include total price for all five (5) years). Price proposals, which are unrealistically low, will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal. Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.
(2) Price Reasonableness: Price analysis techniques will be used to evaluate the Offeror’s full understanding of the requirement is realistic for the work to be performed, and is consistent with approaches in the Offeror's technical proposal. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate.
FAR Clause 52.217-8 Option to Extend Services.
(a) As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
