About this file
This document is an amendment to a federal solicitation for removal of accumulated sludge services at various locations in Daegu, South Korea. The solicitation is seeking proposals for hazardous waste collection, transportation and disposal services for five base years plus four option years. Key details include changing certain contract line item numbers (CLINs) from centimeters to cubic meters as the unit of measure, and modifying the descriptions of those CLINs. The document also adds evaluation criteria requiring offerors to provide a valid waste collection license from local authorities and at least two years of relevant experience. A pre-proposal conference is scheduled for interested vendors to visit work sites. Proposals are due by November 13th, and will be evaluated on technical acceptability, past performance, and price. The lowest priced technically acceptable offeror will be awarded a requirements contract for the sludge removal services.

ADDENDUM TO 52.212-2
ADDENDUM TO FAR Clauses 52.212-2
EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
In accordance with FAR 15.101-2, the Government will award a contract resulting from this solicitation to the responsible offeror submitting the lowest priced, technically acceptable offer that satisfies all terms and conditions of this solicitation.
Award will be made to the responsible Offeror submitting the Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and condition of the solicitation. Offers will be evaluated for acceptability, but not ranked using non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
The following ratings will be used in evaluating all non-price technical factors and subfactors.
FACTOR I TECHNICAL: Each factor and subfactor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or subfactor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the three (3) subfactors below, the subfactor, and overall proposal will be rated “unacceptable” and will not be eligible for award.
Technical Ratings Rating Description
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Subfactor 1 (Prime Contractor’s Business License): The offeror will be evaluated on provided a copy of current and valid business license of human waste collection/transportation/disposal (분뇨수집/운반업 허가증). The registration of subcontractor cannot be substituted for the prime contractor’s registration.
Subfactor 2 (Prime Contractor’s Prior Experience): The offeror will be evaluated on provided evidence of at least two (2) years’ experience within the last five (5) years in removal of accumulated sludge from the issuance date of this solicitation. The experience of a subcontractor cannot be substituted for the prime contractor’s experience. The offeror shall provide evidence of prior experience as required below:
- Title of the contract/Project
- A description of work completed
- Length of contract/Project (year/month/date – year/month/date)
- Amount of Contract
- Complete name and phone number of point of contact at Client Organization
Subfactor 3 (Contract Manager (CM): The offeror will be evaluated on provided CM's resume with at least two (2) years of experience as a CM within the last five (5) years from the issuance date of this solicitation in removal of accumulated sludge. The resume shall clearly identify the information required below:
- Name and position.
- A description of qualifying work experience
- Length of work experience (year/month/date – year/month/date)
- Company Name, Employer name, and phone number of validating point of contact (POC)
FACTOR II. PAST PERFORMANCE: Past performance will be evaluated on an acceptable/unacceptable basis.
Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.
The offeror shall provide recent and relevant past performance in removal of accumulated sludge. Recent past performance is within the last five (5) years from the issuance date of this solicitation. Relevant past performance are those that are the “same or similar” services based on size, scope, complexity, and contract type. The past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:
(1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.
(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.
Past Performance Evaluation Ratings Adjectival Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above).
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305(a)(2)(iv).
Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered "acceptable".
FACTOR III. PRICE: Price analysis will be conducted for each proposal to ensure completeness and reasonableness IAW FAR 15.404-1(b). The following applies to that evaluation.
(1) Completeness. The offeror shall complete the pricing information for all CLINs identified for total five (5) years.
Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.
(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offers.
(3) Price is not scored. The proposed price shall include all CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
(4) FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror's final option period prices to the Offeror's total price. Thus, the Offeror's total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.
