The following have been added by full text:
Questions & Answers Lease and Cleaning of Portable Latrine, Dumpster, Shower Trailer, Removal of Human Waste and Trash &
Garbage for Military Exercise in USAG Casey
1. Among the five BPA holders currently under contract, there is only one company that has both licenses required in the bidding document. Such bidding conditions will inevitably result in a single company's sole source bid. Seems like the Government wants to benefit that company. In this case, there are no competitors, which may result in negative effects such as an increase in bid price or a decrease in service quality, which will result in a different direction than the BPA is pursuing.
a. The questioner’s information is incorrect. In fact, three out of the five current BPA holders possess both “human waste collection and transportation business license” and “waste collection and transportation business license for plant household waste” required in the bidding document. Additionally, as a result of market research via internet, fifteen local vendors were found which possess both licenses required for bidding. Therefore, the questioner’s prediction does not match reality.
2. It's related to the subcontractor of excreta treatment. My company is located in Paju-si, and according to the authoritative interpretation of the Paju-si Government, it is illegal for an excreta treatment company located in Paju-si to perform excreta treatment work outside of Paju-si. Therefore, we need to collaborate with subcontractors who can perform excreta treatment work outside of Paju-si as my company has performed in the past ten years BPA.
a. According to the Korea Sewerage Act (하수도법), business activities in Korea for removal, transportation and disposal of human waste are only possible in local municipal government areas where a license has been issued. However, business activities on U.S military bases in Korea under the SOFA Agreement are not bound to the regulation. Nevertheless, one of the current BPA holder which is located Paju-si signed a subcontract with a company and entrusted it to that company to perform portable latrine services for allocated Call Orders to the prime contractor. By the way, due to poor subcontract management by the prime contractor, it was recently revealed that the subcontracted company which does not have a waste disposal permit had been illegally processed industrial waste for a long time without entrusting it to a licensed company in accordance with environmental laws. Because of this, the prime BPA holder is being disciplined. Therefore, the Government wants portable latrine and cleaning services to be carried out directly by the prime contractor to ensure satisfactory service results.
3. It is about the status of equipment related to excreta treatment. As you can see in the attached, the installation status of equipment that my company has performed excreta treatment work for the past five years is very different from the equipment requirements presented in this bidding document. Please refer to attached equipment installation history.
a. The Contractor shall have sufficient equipment, taking into account peak demand, to be able to provide portable latrine services without any defect during the entire period of contract.
According to historical data performed by the three BPA holders from the past five years, peak demand occurred on 16 March 2023 as follow (two BPA holders were not utilized due to high unit price).
Portable latrine: 412ea Hand wash station: 186ea Dumpster: 187ea Food waste drum: 62ea Grey water container: 77ea
As shown on the above, the number of equipment requested by the Government is a minimum requirement considering maximum demand.
4. Can XXXXX, as the primary contracting entity, participate in the bid if we do not hold the required licenses directly but have subcontractors who do?
a. It is not possible. The prime contractor must possess the necessary licenses in order to participate in the bidding.
5. For Item no. 0001D "Lease and cleaning service for dual-type hand wash station including fresh water supply" - Could you clarify if separate dual-type hand wash stations are required? The portable latrine units we can provide already include both male and female restrooms, each equipped with a hand wash station, as shown below.
a. Container-type toilet shown in the photo is not suitable for the USAG Yongsan Casey, because of most training sites in USAG Yongsan-Casey are located in the mountains.
Therefore, dual type hand wash stations and movable dumpsters are required for sanitation and environmental control along with portable latrines in support of off post training exercise in appropriate manner.
6. For Item no. 0011 "Removal of Trash & Garbage from the exercise area," - Could you confirm if this includes cleaning the restrooms, trash bins, and the surrounding training area?
a. In accordance with Para 5.9.2 of the PWS, the Contractor shall empty and fully remove all trash and garbage from field dumpsters and clean the surrounding area of each dumpster.
7. For Item no. 0022, "Water sprinkling service on dirt roads by using a 15-ton water truck (Four times per day)," - Could you confirm if a 15-ton water truck should be used four times (totaling 60 tons) per day, or if the 15-ton truck should be used in four separate applications (3.75 tons each time) over the course of the day?
a. In accordance with Para 5.10.1 of PWS, water sprinkling on the requested dirt roads shall be performed four times a day at 0800, 1000, 1400 and 1600 hours by using 15 ton size water truck in support of troops off post training exercise during the limited exercise period.
8. For Item no. 0023, "Supply item" – Could you confirm if there is a storage available for a one-time bulk delivery of supplies (hand towels, toilet paper), or if these should be provided on a regular delivery schedule?
a. In accordance with Para 7.4 of the PWS, the Government will not provide any facilities for BPA portable latrine services.

The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition--

Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
