PWS
PERFORMANCE WORK STATEMENT (PWS)
CLEAN AND DISPOSE CONTAMINATED POL WASTE MIXTURES FROM OIL WATER
SEPARATORS, KUNSAN AIR BASE.
PART 1
GENERAL INFORMATION
1. GENERAL INFORMATION: This is a non-personal services contract to provide services for removal, transportation and disposal of oil/water mixture and contaminated sludge/sand/soil from various oil water separators (OWS) at the U.S. Installation, Kunsan Air Base. The Government will not exercise any supervision or control over the contract service providers performing the services herein. The contractor shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the contract.
1.2 Background: The number of Oil Waster Separators (OWSs) on Kunsan AB is Twelve (12) as indicated in
Technical Exhibit #1 with respective cleaning frequencies, and Estimated Workload Data in Technical Exhibit
#2. The location of these OWSs may be referenced in Technical Exhibit #3.
1.3 Objectives: To provide removal, transportation, and disposal services of oil/water mixtures, contaminated sludge/sand/soils from different size/locations of OWSs on Kunsan AB.
1.4 Scope: The contractor shall provide all personnel, equipment, labor, supplies, tools, material, supervision, licenses and permits, and any other non-personal service necessary for removal, transportation, and disposal of oil/water mixtures and sludge/sand/soils from OWSs on Kunsan AB in compliance with all the provisions of the contract as specified in this Performance Work Statement (PWS) as well as all laws and regulations of ROK, State, and Federal Regulation, International agreement, Status of Forces Agreement (SOFA) and USFK Regulation 201-1
Environmental Governing Standards (EGS) or, in their absence, the Overseas Environmental Baseline Guidance
Document (OEBGD). After the completion of performance, all reports with related documentation shall be submitted to the Contract Officer Representative (COR) for review.
1.5 Period of Performance: The period of performance shall be for one (1) Base Year of 6 months and four (4)
12-month option years. The respective Periods of Performance are as follows:

Option Year I: (1 Dec 2024 ~ 30 Nov 2025) Option Year II: (1 Dec 2025 ~ 30 Nov 2026)
Option Year III: (1 Dec 2026 ~ 30 Nov 2027)
Option Year IV: (1 Dec 2027 ~ 30 Nov 2028)
1.6 Quality Control: The contractor shall develop and maintain an effective Quality Control Plan (QCP) to ensure services are performed in accordance with (IAW) this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which he assures himself that his work complies with ALL requirements of the contract. The Contractor shall submit a QCP within 10 calendar days after the contract award date. An updated copy of the Contractor’s plan shall be provided to the Contracting Officer (KO) and COR within 5 duty days as changes occur. At a minimum, the contractor shall use the Performance Requirements Summary (PRS) below to develop a satisfactory QCP. Before any changes to the original QCP can be made, the contractor must receive the KO’s acceptance in writing of any proposed changes to his QCP.

1.6.1 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). The
COR will inspect by watching the actual task performance, physically checking an attribute of the completed task, checking contractor’s report, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task to determine whether or not the performance meets the standards contained in this PWS. When a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate and provide the contracting officer a Contract Discrepancy Report for issuance to the Contractor.

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0800-1700 hours, Monday thru Friday except for ROK and U.S Government legal holidays and days when Government facility’s areas are closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Any other contract type, except firm fixed price contracts, the contractor shall not be reimbursed when the government facility is closed for the above reasons. The Contractor must maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.5 Environmental Requirement
Contractor shall ensure all workers are familiar with the goals of the Kunsan AB Environmental Management System
(EMS) as stated in the installation’s Environmental Policy Statement.
The Environmental Policy Statement commits the installation, 1) to compliance with the requirements of USFK regulation 201-1 and other applicable legal and policy requirements, 2) to continued environmental improvement and pollution prevention, 3) to reduce risk from environmental impacts of base activities, and 4) to understanding that everyone on the installation is responsible for complying with the environmental regulations.
The Contractor's work under this contract shall conform with all operational controls identified in Kunsan AB’s EMS.
The contractor shall provide monitoring and measurement information necessary for the Government to evaluate the contractor’s conformity to the goals of the EMS.
When environmental training is required for contractor employees to complete contract requirements, the Contractor shall provide proof of completion of training to the Contracting Officer (KO).
1.6.5.1 Air Emission
Dust Control: The Contractor shall take appropriate measures to minimize the generation of dust as a result of their works, operations and activities IAW KEGS Section 2-3.l during and after construction until the site is reclaimed.
These measures shall include regular and effective treatment of gravel roads and working areas, use of dust extractors on drilling equipment, wet drilling equipment and operation, water sprays on aggregate crushing and screening operation etc. Dump trucks to be used in the transportation of materials are to be fitted with tarpaulins to prevent dust or other material spilling during transportation.
Best Management Practices for Dust Reduction

1 Field storage (when powdery material is stored in the field)
a. Field stored material shall be covered by anti-dust cover.
b. Anti-dust cover wall of 1/3 of field storage height shall be installed and anti-dust net (screen) of 1.25 times the height of storage shall be installed. For construction site, landscaping site, and demolition site, the boundary shall be guarded with anti-dust wall of 1.8m or more. When two or more sites are adjacent to each other, the inner boundary does not need a wall.
c. Field stored material shall have water content of 7-10% and sprinkler shall be installed to maintain the water content. (For iron scrap site, this does not apply)
d. When the same measures equivalent to or better than a – c are taken, those measures may substitute a – c.
2 Loading/unloading criteria for potential dust-generating activities, such as those involving soil, coal, and concrete/cement
a. Install portable dust booth or spraying dust booth to control flying dust produced during the work processes (limited to coal manufacturing industry, iron/steel industry, and grain transportation industry).
b. Install and use fixed or portable water sprays (spraying radius ≥ 5 m and water pressure ≥ 3 kg/cm2) to control flying dust (grain processing and loading facilities are excluded).
c. Stop working when wind velocity ≥ 8 m/sec (~18 miles per hour).
d. If current actions are more effective than a – c, then implementation of a – c is exempted.
3 Transportation [cement, coal, soil, feeds, grain, scrap iron are limited to a, b, f, g and wood is limited to g and h]
a. Cover the loaded materials.
b. Loaded materials shall not extend above 5 cm (~2 inches) below the top of the truck bed.
c. If 10 or more residences are located with 500 meters of the road, pavement, temporary pavement, or appropriate covering (with water spray application) shall be provided on the unpaved roads within the 1 km radius.
d. One of the following will be made available:
(1) Automatic wheel washer
(2) Automatic wheel washer with a water containment basin with the following specifications:
(a)Area of basin: ≥ 1.2 times area of the truck (b)Depth of basin: ≥ 20 cm (~8 inches)
(c)Length of basin: ≥ 2 times of truck length (d)Equipment to assure continuous water flow within the basin.
e. Install side water sprinkler IAW the following criteria:
(1) Water sprinkler should reach bottom of wheels to lower portion of truck bed.
(2) Length: ≥ 1.5 times of truck length
(3) Pressure of water spray: 3 kg/cm2
f. Truck sides and wheels must be washed before exiting site.
g. Speed limits within work site shall not exceed 20 km/hr to prevent excessive dust.
h. The work site shall be sprayed at least once a day while there is traffic.
4 Conveyance a. Outdoor conveyance equipment shall be covered and sealed to prevent the release of dust.
b. Appropriate dust booths shall be installed at the entrance, exit, falling points, and ventilation areas.
c. Water spray or other dust control measures shall be available using non-mechanical devices.
d. If current actions more effective than a through c are being practiced, then implementation of a through c is exempted.
5 Outdoor cutting a. It is recommended that iron scrap cutting be conducted indoors.
b. Partitions will be installed for dust control when outdoor cutting is necessary.
c. Stop working when wind velocity ≥ 8 m/sec (~18 miles per hour);
for ship industries, stop working when wind velocity ≥ 10 m/sec (~22 miles per hour).
d. If current actions more effective than a through c are being practiced, then implementation of a through c is exempted.
6 Outdoor media blasting
a. Media blasting will be conducted indoors if the length of an object is less than 15 cm (~6 inches).
b. Install partitions for dust control.
c. Use portable dust booths if conducting outdoor media blasting. If dust booths are not feasible, media blasting area will be cleaned with vacuum truck.
d. Blasting media, dust, and debris will be contained to prevent dust.
e. Stop working when wind velocity ≥ 8 m/sec (~18 miles per hour); for ship industries, stop working when wind velocity ≥ 10 m/sec (~22 miles per hour).
f. If current actions more effective than a through e are being practiced, then implementation of a through e is exempted.
Ozone Depleting Substance (ODS) Control: The Contractor is prohibited from installing any new equipment using
Class I & II ODS. The contractor shall not intentionally release any Class I or Class II ODS refrigerant in the course of maintaining, servicing, repairing, or disposing of appliances, industrial process refrigeration units, air conditioning units, or motor vehicle air conditioners.
Contractor shall collect refrigerant from all potential sources, including, but not limited to, air conditioners, refrigerators, freezers, and chillers, found remaining in the work areas prior to commencing removal or demolition.
If collection is not possible, all equipment containing chemical refrigerants shall be appropriately moved and placed into segregated storage areas for either re-use or recycling.
Volatile Organic Compound Control: The contractor shall use low concentration volatile organic compound (VOC) materials where possible to reduce/minimize VOC emissions, and maintain fossil fuel burning equipment to reduce nitrogen oxides emissions in an effort to not increase ambient ozone levels
1.6.5.2 Storm water Pollution Prevention Measures
The Contractor shall ensure all workers are familiar with the applicable Storm water Pollution Prevention Best
Management Practices in KEGS Section 4-3.f (1) and Table 4-8. Hazardous materials must be stored indoors, in non-rusty drums or under a man-made cover sufficient to provide protection from sun, wind, and precipitation events and painting clean-up materials (thinners, reinstates) must be captured. Oil leaks or spills from all equipment and vehicles must be captured using drip pans. Spill response pads and booms must be available where hazardous materials, including fuel, are stored, used and transferred. Sediment, trash, litter, wash water and any solid objects must be kept out of the storm water sewers. Contractors will implement Air Force Civil Engineer Support Agency
(AFCESA) ETL 03-1, Storm Water Construction Standards, specifically Sections 7, 8, 9 & 10, excluding CONUS requirements in 8.5, 8.5.1, 8.5.2.
1.6.5.3 Erosion and Sediment Control
The Contractor shall submit an erosion control plan to the COR for approval prior to any site work. The erosion control plan is required to implement erosion control IAW the KEGS, the Kunsan AB Storm Water Pollution
Prevention Plan and the Kunsan AB Integrated Natural Resources Management Plan, including site stabilization in accordance with KEGS Section 13-3, j. Key elements to address are the control of dust, prevention of sediment leaving the site and on roads, vegetation cover and slope stabilization. Some examples of control methods include silt fences, terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels and sedimentation basins. Any temporary measures shall be removed after the area has been stabilized. 8 CES/CEIE will inspect construction sites to ensure the approved erosion control measures are implemented, adequate and effective.
1.6.5.4 Hazardous Materials
The Contractor using hazardous materials (HAZMAT) on base must comply with the authorization procedures
IAW AFI 32-7086, Hazardous Materials Management.
Prior to commencement of the project, the Contractor shall submit the information and AF Form 3952, Chemical
Hazardous Material Request Authorization (including Safety Data Sheets, formally known as material safety data sheets, written in English and Hangul) to obtain HAZMAT usage approval from the CE Environmental Office.
The Contractor shall submit a current monthly quantitative and qualitative inventory of all HAZMAT brought onto the installation to Environmental Office beginning within 5 days after the first HAZMAT are delivered. The monthly inventory must include the following: name of HAZMAT and a common name, if applicable; major use of
HAZMAT (paint, lubricant, adhesive, etc.); quantity (number of containers and volume of each container); and verification that the shelf-life has not expired. The approved AF Form 3952, and SDSs for all HAZMAT must be on file near the HAZMAT storage area. After the contracted work is completed and before contract closeout, the
Contractor must remove all HAZMAT from the installation and arrange a final environmental site-visit so 8
CES/CEIE personnel can inspect the area for HAZMAT spills or solid waste violations. The Contractor is required to store HAZMAT in accordance with requirements in Chapter 5 of the KEGS and other DoD policies including the
Joint Service Publication on Storage and Handling of Hazardous Materials and AFMAN 23-209. Common storage requirements include keeping the storage area neat and orderly and ensuring incompatible materials (for example, flammables and oxidizers) are not stored together. All HAZMATs must be stored in a locked enclosure with a current inventory posted nearby. A sign with emergency response actions in English and Hangul must be posted where HAZMAT is stored. Containers of hazardous materials must be legibly labeled and closed when not in use.
Appropriate spill kits and fire extinguishers must be located near the HAZMAT storage areas.
1.6.5.5 Waste Management and Disposal
1.6.5.5.1 Disposal of Hazardous Waste:
Contractors are prohibited by 10 U.S. Code 2692 from storage, treatment, or disposal of any contractor owned hazardous waste (HW) on the installation. Contractors shall manage HW generated on the installation IAW KEGS
Chapter 6. Contractors may seek approval from the HW Program Manager, 8 CES/CEIE, for HW accumulation at a hazardous waste accumulation point (HWAP) on the installation if the waste will be or has been generated on-site in connection with a contract activity. When the contractor obtains approval for a HWAP on the installation, he/she shall:
(1) Be responsible for ensuring compliance with all US Air Force, KEGS, and host nation HW laws and regulations. Ensure HW are managed and transported IAW the KEGS and local requirements to a certified disposal facility. Ensure proper labeling, handling, segregation, collection and accumulation of HW IAW
Hazardous Waste Management Plan of Kunsan Air Base.
(2) Ensure all personnel are properly trained for handling the HW they generate.
(3) Provide proper documentation for HW disposal to the installation Environmental Office.
1.6.5.5.2 Disposal of Electric Light Fixtures, Ballasts and Polychlorinated biphenyls (PCB) transformers:
The Contractor shall segregate the light bulbs and ballasts by brand and type. Florescent lights containing mercury shall be disposed of in accordance with the KEGS.
Removed PCB containing equipment shall be turned in to the Kunsan AB Hazardous Waste Storage Area
(Bldg. 843). The contractor shall comply with UN Standards for Performance Oriented Packaging (POP) and any additional requirements established by DLA. For example; PCB Transformers shall be set on a drip pan large enough to hold 125% of the remaining liquid and crated by processed wood packaging materials IAW
DoD Directive 4140.1.
Disposal of PCB items shall only be conducted through the servicing DLA IAW DOD 4160.21-M. Disposal of
PCBs within Korea requires coordination with and concurrence of appropriate Korean authorities.
1.6.5.6 Historical & Archeological Finds:
All items having any apparent historical or archeological interest, which are discovered in the course of any construction activity shall be carefully preserved and reported to the Environmental Office through the
Contracting Officer.
1.6.5.7 Natural Resources:
The Contractor shall perform all work and take such steps required to minimize interference with or disturbances to flora and fauna. Protected species, which include the Narrow-mouthed Frog and the Korean Golden Frog, are present on Kunsan AB. If trees and bushes interfere with the construction work and need to be relocated or removed, consult with the installation Environmental office for proper clearance prior to relocating or removing.
1.6.5.8 Polychlorinated Biphenyls (PCB) Free Equipment:
The Contractor is required to assure that all electrical equipment including, but not limited to transformers, capacitors, circuit breakers, recloses, voltage regulators, switches, electromagnets, and cable, shall be PCB free or not be contaminated with PCBs in detectable concentrations in accordance with the KEGS. In addition, newly procured transformers and equipment shall have permanent labels affixed stating they are PCB free (no detectable
PCBs). The contractor shall submit PCB Free certification prepared by the manufacturer for the equipment installed under the project to the Kunsan AB Environmental Office.
1.6.5.9 Lead Based Paint:
The Contractor is required to use “lead free” coatings (liquid paints or coatings with less than 0.05 percent lead by weight of the non-volatile solids) during project execution. The Contractor shall provide a certificate or SDS, written in English, from the manufacturer showing the product is lead free.
1.6.5.10 Spill Prevention and Response Planning:
In the event of a fuel or other hazardous substance spill during the performance of this contract, the Contractor shall be responsible for its containment, clean up, and related disposal costs. Maximum effort must be made to keep the spill from reaching the storm water or sanitary sewers and the contractor must have sufficient spill containment supplies readily available on vehicles and/or at the work site to contain any spillage. Refer to the installation Spill Prevention, Control, and Countermeasure (SPCC) Plan. In the event of a Contractor-related release, the Contractor shall immediately notify the Fire Department (911), Environmental Office (DSN 782-
6240/3701 or 063-470-6240/3701), and the Contracting Officer and take appropriate actions to correct its cause and prevent future recurrence. The Contractor shall submit a completed spill report within 24 hours to the installation Environmental Office detailing the spill location, type of material and quantity spilled, the cause of the spill and description of the event, whether the spill reached the storm water or sanitary sewer, the containment and cleanup actions and the POC and contact number.
1.6.5.11 Conflicts:
In case of a conflict or discrepancy between environmental regulations or laws and the contract specifications, the
Contractor shall immediately submit the matter in writing to the Contracting Officer for a determination. Without such determination any actions taken shall be at the Contractor’s own risk and expense.
1.6.6 Safety Requirement: The Contractor shall comply with EM 385-1-1, US Army Corps of Engineers Safety and
Health Requirements Manual, Revised Version dated Sep 08. English versions are available for reference in the 8th
CES, Operation Support Office (CEOS), and Building 702. The Contractor shall be responsible for ensuring that all work performed under this contract is accomplished in a safe manner. The Contractor shall ensure that all employees are instructed on accident prevention and safety. Special emphasis shall be placed on the safe operation of equipment and safe working conditions. Training shall be conducted for all employees by the Contractor on appropriate safety measures and on the employee's obligation to obey all existing base safety regulations.
1.6.7 Security Requirements:
1.6.7.1 Physical Security: The Contractor and employees shall comply with all security requirements imposed by the local installation commander at all times while on this military installation.
1.6.7.2 Key Control: The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The
Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The
Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.
1.6.7.3 In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the
Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the
Contractor.
1.6.7.4 The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the
Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.
1.6.8 AT Level I Training: All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled-access areas shall complete AT Level I awareness training within 30 calendar days after the contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within
10 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website: http://jko.jten.mil
1.6.8.1 Access and general protection/security policy and procedures: Contractor and all associated sub-contractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office.
Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition
(FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
1.6.8.1.1 For contractors that do not require CAC, but require access to a DoD facility or installation: Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the
National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database
(TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.6.8.2 iWATCH Training: The contractor and all associated sub-contractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 40 calendar days after contract award.
1.6.9 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the
Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the
Contracting Officer and Contractor of any deficiencies and provide means of site entry to Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The
COR is NOT authorized to change any of the terms and conditions of the resulting order. If told to change the terms and conditions of this contract by the COR or any Government employees, the contractor must contact Contracting
Officer prior to commencement of any work.
1.6.10 Qualification Requirement:
1.6.10.1 The Prime contractor shall maintain the respective qualifications throughout the life of the contract. The
Prime Contractor shall continuously meet or exceed the minimum qualifications for this requirement that were established in the solicitation evaluation criteria during the entire performance of this contract.

(1) The Prime Contractor shall have at least two (2) years’ experience in cleaning and disposing contaminated POL waste mixtures from Oil Water Separators.
(2) The Prime Contractor shall possess/maintain a valid Business Permit in Waste Pickup and Transport for the business categories of Designated Wastes (폐기물 수집 및 운반업 허가증 – 지 정 폐기물) issued by ROK
Government OR Business Permits in Intermediate/ Synthesis/ Final Treatment of Facility waste for the business categories of Designated Wastes (사업장폐기물 중간/종합/최종처리업허가증 – 지 정폐기물) issued by ROK
Government. Agreement with Disposal Company for final waste processing (폐기물 최종 처리 방법에 대한 증빙) is required for offeror(s) who submit a business permit in waste pickup and transport.
1.6.10.2 Key Personnel/ Personnel: Definition: “Key Personnel” means employees of the Prime Contractor that are considered to be essential to the work being performed under this contract. Key Personnel are as follows: Contract
Manager.
1.6.10.3 Before removing, replacing, or diverting any of the listed or specified key personnel, the Contractor shall:
(1) Notify the Contracting Officer 14 calendar days prior to the anticipated start date of the new personnel.
(2) Submit justification (Including proposed substitutions with resumes of equal qualifications IAW section 1.6.10 of this PWS) to the COR in sufficient detail to facilitate evaluation of the impact on this contract. The 8 CES has the right to review/accept proposed substitutions with resumes first and should report to the KO in the case any job qualification discrepancies are found.
(3) Obtain the Contracting Officer's written approval. Notwithstanding the foregoing, if the Contractor deems immediate removal or suspension of any member of its management team is necessary to fulfill its obligation to maintain satisfactory standards of employee competency, conduct, and integrity under clause 48 CFR 970.5203–3, Contractor's Organization, the Contractor may remove or suspend such person at once. However, the Contractor shall notify the Contracting Officer prior to or concurrently with such action.
1.6.10.4 Contract Manager (CM): The Contractor shall provide a Contract Manager (CM) who shall be responsible for the performance of tis work. The CM shall have full responsibility to act for the contractor on all contract matters relating to daily, monthly, and annual operations of this contract.
1.6.10.4.1 Prior Experience: The CM shall have a minimum two (2) years’ experience as a CM (현장소장) in cleaning and disposing contaminated POL waste mixtures from Oil Water Separators. The CM shall be able to read, write, speak, and understand English at a level that will enable them to communicate effectively with the
COR in performance of all assigned duties.
1.6.10.4.2 Availability: The CM shall be available to meet the COR within one (1) hour during normal duty hours from Monday through Friday to discuss work related issues. After normal duty hours, the CM shall be available within two (2) hours. The CM shall be available by cell phone and shall provide their cell phone number to the
Contracting Officer and COR.
1.6.11 Uniform: Contractor personnel shall be easily identified as a Contractor employee. This shall be accomplished by wearing an appropriate jacket or uniform which contains the company name and employee’s name. Such jacket or uniform shall be furnished and controlled by the Contractor. The Contractor's employees shall not be authorized to enter Government facilities other than those requiring services under this contract. The
CM shall ensure that all employees understand this policy and abide by it.
1.6.12 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal
Acquisition Regulation Subpart 42.5. The Contracting Officer (KO), Contracting Officers Representative
(COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.13 Base Passes: It is the Contractor’s responsibility to arrange for base passes and necessary vehicle permits required for entry onto this installation prior to starting any work. The temporary base pass takes at least two (2) weeks to process and is issued for only three (3) months. The permanent base pass requires three (3) months to process. The Government will not be responsible for providing escorts for the Contractor.
1.6.14 Escort Privileges: The CM shall be authorized escort privileges for on base passes. The maximum number of individuals escorted shall not exceed three (3) persons per base pass. Individual base passes for Contractor employees other than the CM shall not include escort privileges unless approved by the KO or COR by extension. It is the Contractor’s responsibility to ensure that the escorting official has full control over all escorted individuals at all times. Any individual found on the installation without a pass and unescorted will be removed from the installation and the escort official’s privilege shall be withdrawn. Any individual removed from this installation shall not be authorized further access to this installation.
1.6.15 Vehicle Passes: All Contractor vehicles used in the performance of work under this contract shall be registered on the installation. Contractor personnel operating a vehicle on this installation shall be aware of current driving policies and abide by these policies. Any Contractor committing traffic violations may result in the termination of further driving privileges on the installation.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1 DEFINITIONS:
2.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2 CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the
Performance Work Statement.
2.1.5 DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.
2.1.6 INLET SYSTEM - Any form of infrastructure whereby fluid or solids are conveyed toward/into a particular containment. In the context of this PWS, the inlet system takes several distinct forms, including concrete channels, storm water drain systems (the storm water drain systems are extensive, only the last 10’ to the DWV pipe inlet or mesh filter inlet is expected to be cleaned), wash rack drains, maintenance bay drains, and inlet piping terminating inside OWS (See Attachment #1 – OWS Inlet System).
2.1.7 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.8 PERFPRMANCE REQUIREMENTS SUMMARY (PRS): The PRS identifies key performance indicators and standards that represent logical service outputs that will be evaluated by the Government to assure the
Contractor is fulfilling the terms of the contract.
2.1.9 PRESSURE WASHER - A pressure washer is a high-pressure mechanical sprayer with a gun and wand used to remove various things including grime, dust, mud, and dirt from surfaces and objects such as buildings, vehicles, and concrete surfaces.
2.1.10 QUALITY ASSURANCE (QA). The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.11 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.12 QUALITY CONTROL (QC). All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.13 SEWER. A general term designating any kind of waste, whether Human waste or Designated waste. A sewer line is simply any line which conveys waste, designated or human. The inlet systems of the OWSs do not contain any human waste.
2.1.14 SOLIDS. Anything that is not a liquid, which is not intended to be inside of the OWS or component inlet system or not conducive to proper function of the OWS and inlet system. Includes but is not limited to: sludge, sand, soil, trash, vegetation, etc…
2.1.15 SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.16 WATER JETTER - A machine, either a portable unit, trailer, or truck whereby a professional plumber may use to clean slow-moving or clogged sewage lines. It uses water to scour heavy buildup from sewer pipes. It can easily break up clogs made of all kinds of materials, including soil/vegetation/debris. Plumbers must use this method judiciously, however. Older pipes may not be able to withstand the high water-pressure of hydro jetting without cracking. Reference National Association of Sewer Service Companies (NASSCO), Jetter Code of Practice as a definition and guideline for Sewer Jetting.
2.1.17 WORKDAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.18 WORK WEEK. Monday through Friday, unless specified otherwis

CONTRACTOR FURNISHED ITEMS AND SERVICES
3. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
3.1 General: The Contractor shall furnish all transportation, equipment and materials required to perform this contract. Equipment and materials used in the performance of this contract shall be recognized as standard in the trade, and in accordance with manufacturer’s specifications and condition of equipment.
3.2. Pump: The contractor’s tanker truck shall include a heavy-duty suction/vacuum pump to remove the oil/water mixture and /or contaminated sediment/sand/soil in the oil water separator(s).
PART 4
SPECIFIC TASKS
4. SPECIFIC TASKS:
4.1 Work Schedule: The Contractor shall provide the COR with a document detailing the projected working days of any given month IAW the frequencies specified in technical exhibit #1 not later than ten (10) calendar days before the start of that month. The schedule shall include the OWS location, date, and, if multiple OWSs are being serviced in a day, the sequence of work to be performed. Contractor will not schedule work on any ROK or U.S. Government Legal
Holiday.
4.1.1 Items Incidental to Performance of Services:
(1) Weight Scale: The scale located near Building 843 on Kunsan AB will be available to the Contractor for work performed under the obligations of this contract. The COR shall facilitate coordination between the
Contractor and the 8th CES/CEIE Environmental Protection Specialist to acquire weight cards for each respective vehicle used for oil/water mixtures and solids removal. The contractor will utilize the scale to measure the total amount of kilograms of solids and oil/water mixture removed whilst performing services on OWSs. The original weight ticket generated after service has been completed (and/or after the vehicle is full) shall be attached to the completion report and submitted to the COR for approval/disapproval within three (3) duty days after completion of services IAW Part 4 of the PWS. ALL Kilograms of oil/water mixtures and solids removed shall be accounted for by the above means with one (1) exception:
a. The scale is not operational. If this is so, the contractor will notify the COR immediately. After receiving direction from COR, the contractor may continue work IAW part 4 of the PWS, acquiring weight tickets from building 843 scale exempted. In such cases, the contractor will use a scale off-base in the prescribed manner. The following is an example of a scale to be used:
i. Address: 242, Gonghang-ro, Gunsan (군산시 공항로 242)

(2) Utilities: All reasonable quantities of water and electricity will be available at no charge to the Contractor for work performed on USFK installations. Coordination shall be made with the installation engineer for locations of water and electrical supply points. Temporary connections shall be made and removed at the
Contractor’s own expense, regardless of distance or accessibility of existing service. All connections shall be made by experienced and licensed craftsmen and shall be coordinated with the COR. Costs for repair of utility systems, damaged by the Contractor, shall be paid for by the Contractor.
4.2. Removal/Disposal of oil/water mixture-CLIN X001AA (폐유/수 제거 및 처리).
4.2.1 The contractor shall remove all existing oil/water mixture from the oil water separator(s). All oil water separators shall be empty. A completion report detailing quantities removed from the OWS shall be submitted to the COR within three (3) working days for review and approval/disapproval.
4.2.2 The contractor shall dispose of all removed oil/water mixtures and products by transporting to an approved (by the local
Government) environmental disposal facility in the ROK and the original weight ticket/disposal receipt shall be attached to the completion report to validate/substantiate performance of services.
4.3 Removal/Disposal OWS Solids-CLIN X001AB (폐슬러지/침전물 제거 및 처리)
4.3.1 Upon completion of oil/water mixtures removal from the oil water separator, the contractor shall start to clean the oil water separator and component inlet systems with a commercial duty Pressure Washer and/or Water Jetter to remove all solids, such that they are free of obstructions and clean. Begin by removing all solids from OWS inlet systems, ensuring there are no obstructions preventing waste flow into and out of the OWS containment as intended. After all solids are removed from the OWS inlet system, the contractor shall clean the walls and bottom of the designated oil water separator(s) and place the solids into contractor furnished containers that are certified by current Korean Environmental Law and Regulation. All containers shall be properly marked and identified as containing POL contaminated solids.
