FAR 52.212-1, Instructions to Offerors -- Commercial Items (APR 2014), applies to this acquisition. No addenda to this provision. The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
FAR 52.212-2, Evaluation--Commercial Items (Oct 2014), applies to this acquisition. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) technical capability of the item(s) offered to meet the Government requirement; technical capability includes the offeror’s delivery capability to meet the schedule as set forth in the RFQ; (2) Past Performance and (3) price. The Government intends to award to one vendor on an all or none basis. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
• Award will be made that represents the Best Value considering the three factors stated above that meet the technical requirement of the scope of work, delivery schedule and a demonstrated record of successful past performance at a fair and reasonable price.
• The Offeror that provides the earliest delivery date shall be rated higher than those that provide a later date.
• The offeror who submits a quote on all items that is technically acceptable and has the most favorable timeline for delivery will receive greater consideration for award than those that propose a longer timeline for delivery with all other factors being considered.
• Offerors are encouraged to submit records of past performance for the past three years that demonstrate successful completion of similar requirements. The Contracting officer may consider past performance data from a wide variety of sources both inside and outside the Federal Government in accordance with agency procedures.
