(a)The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and sub-factors in the solicitation. The Contract will be Firm Fixed Price Contract. Award will be made using source selection procedures in accordance with Federal Acquisition Regulation (FAR) Part 12 "Acquisition of Commercial Items" and in conjunction with the policies and procedures prescribed in FAR Part 13.5 "Simplified Acquisition Procedures for Certain Commercial Items."
This acquisition will be conducted using the Lowest Priced, Technically Acceptable (LPTA) process; therefore, award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. In order to be considered for award, there must be an "acceptable" rating in every non-price factor/sub-factor. A rating of "unacceptable" for any factor or sub-factor will result in the entire offer being rated "unacceptable". No other rating or qualitative value will be assigned.
In accordance with FAR 52.212-1 “Instructions to Offerors-Commercial Items (JUN 2008), the Government reserves the right, based on the Government’s best interests, to make a determination to: 1) award without discussions; 2) make a single award for this requirement; 3) establish a competitive range in order to conduct discussions (the Government retains the right to limit the competitive range to the “most highly rated proposals” for the purpose of efficiency); and/or 4) make no award if, upon evaluation, none or the proposals are deemed likely to meet the requirements.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The following ratings will be used in evaluating all non-price factors and subfactors except Past Performance: Acceptable Proposal clearly meets the minimum requirements of the solicitation Unacceptable Proposal does not clearly meet the minimum requirements of the
The following ratings will be used in evaluating all non-price factors and subfactors except Past Performance:
Acceptable
Proposal clearly meets the minimum requirements of the solicitation
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation
FACTOR I. TECHNICAL CAPABILTY
Sub-factor 1. Prime Contractor's License:
The offeror shall be evaluated on their submittal of a current and valid license to Pick Up and Transport Human Waste (분료수집운반업) issued by Pyeongtaek City Government Office IAW Korean Environmental Law. A Subcontractor's license cannot be substituted for the Prime contractor’s registrations.
Sub-factor 2. Prime Contractor's Prior Work Experience:
The contractor will be evaluated on submitted documentation demonstrating a minimum of two (2) years verifiable experience within the last five (5) years from the issuance date of the solicitation in performing maintenance and cleaning service of portable latrines, septic tanks and grease traps. The prime offeror’s experience shall not be substituted by sub-contractor’s prior experience. The offeror shall provide prior experience in below format:
· The title of the contract/project
· A brief description of performance
· Period of contract/project (year/month/date – year/month/date)
· Value of contract/project
· Complete name and phone number of point of contact at Client Organization
FACTOR II. PRICE
No Page Limit. 1 Original shall be provided by Excel Sheet and provided price total summary including prices of base and options of 1st, 2nd, 3rd, and 4th.
(a) The offeror shall provide complete CLINs/Sub-CLINs identified for base period plus four (4) one year options. Proposed price will be reviewed to determine if the estimate price is complete and reasonable. The pricing proposals will be evaluated in accordance with FAR 13.106-3(a).
(b) Price Analysis in conjunction with Technical Analysis will be used to perform a Price Reasonableness Analysis to determine if the price is fair and reasonable for the work to be performed. Pricing shall be included for all CLIN for each year and a total for all five years (Prices shall be in local currency-Korean Won). The proposal will be evaluated to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is consistent with performance described in the technical proposal.
The following applies to that evaluation
- Completeness. The Offeror shall complete the pricing information for each contract line item identified for each year and option year. (Include total price for all five (5) years). Price proposals, which are unrealistically low, will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal. Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.
- Reasonableness. Price analysis techniques will be used to evaluate the Offeror’s full understanding of the requirement, is reasonable for the work to be performed, and is consistent with approaches in the Offeror's technical proposal. Price should also reflect fair market value and be reasonable when compared to the other offers.
- Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the base year and all option periods. Price must include all CLINs as listed on the Price Schedule, including option CLINs/subCLINs. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
(c) As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.
(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Factor III. PAST PERFORMANCE
Past performance shall be evaluated on an acceptable/unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
The contractor shall have minimum two (2) years recent and relevant past performance within the last five (5) years as of the opening date of the solicitation. Relevant past performance are those that are the “same or similar” services based on scope and contract type. The past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:
Past Performance Acceptable/Unacceptable Rating Method
Adjectival Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown (see note below).
Unacceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.
References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance. The offeror shall provide past performance information on past or current contracts (including Federal/local Government and private) for efforts that are the same or similar to the Government’s requirement during the past five (5) years. Offerors are authorized to provide information on problems encountered on the identified contracts and the offeror’s corrective actions. (2) The time specified in the solicitation for receipt of offers;

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
